Minutes P&Z 05/07/2009 TOWN OF TROPHY CLUB PLANNING AND ZONING COMMISSION MINUTES MAY 7, 2009 The Planning and Zoning Commission of the Town of Trophy Club, Texas met on May 7, 2009, at 7:00 p.m. in the Council Chambers, 100 Municipal Drive, Trophy Club, and Texas 76262. Chairman Hill called the meeting to order at 7:00 p.m. with a quorum present. 1 REVIEW AND APPROVE MINUTES OF THE FEBRUARY 19, 2009 PLANNING AND ZONING COMMISSION MEETING. Commissioner Reed motioned to approve the minutes of the February 19, 2009, Planning & Zoning Commission meeting. The motion was seconded by Commissioner Forest. Ayes: Hill, Reed, Sheridan, Forest, Ashby Nays: None Abstain: None Action: 5-0-0, Approved 2REVIEW AND APPROVE MINUTES OF THE MARCH 5, 2009 PLANNING AND ZONING COMMISSION MEETING. Commissioner Ashby motioned to approve the minutes of the March 5, 2009, Planning & Zoning Commission meeting. The motion was seconded by Commissioner Reed. Ayes: Hill, Reed, Ashby Nays: None Abstain: Sheridan, Forest (absent at the March 5, 2009 meeting) Action: 3-0-2, Approved 3 PUBLIC HEARING REGARDING A PROPOSED ZONING CHANGE FROM “R-15” SINGLE FAMILY RESIDENTIAL TO “R-12” SINGLE FAMILY RESIDENTIAL FOR AN APPROXIMATE 2.3 ACRES LOCATED WHERE RIDGE VIEW LANE DEAD ENDS INTO VACANT LAND JUST NORTH OF THE INTERSECTION OF SKYLINE DRIVE AND RIDGE VIEW LANE, REQUESTED BY JACOBS ENGINEERING GROUP, INC., ON BEHALF OF BDMR DEVELOPMENT, LLC (ZCA-09-015). Chairman Hill announced the first case and opened the public hearing. There was no one present wishing to speak and the public hearing was closed. 4 DISCUSSION AND APPROPRIATE ACTION REGARDING A ZONING CHANGE REQUEST FROM “R-15” SINGLE FAMILY RESIDENTIAL TO “R-12” SINGLE FAMILY RESIDENTIAL FOR AN APPROXIMATE 2.3 ACRES LOCATED WHERE RIDGE VIEW LANE DEAD ENDS INTO VACANT LAND JUST NORTH OF THE INTERSECTION OF SKYLINE DRIVE AND RIDGE VIEW LANE, REQUESTED BY JACOBS ENGINEERING GROUP, INC., ON BEHALF OF BDMR DEVELOPMENT, LLC (ZCA-09-015). Jaison Stephen, Jacobs Engineering, spoke on behalf of Mehrdad Moayedi, Centurion American Development Group, Steve Lenart, Lenart Development Company, and David Keener, BDMR Development, LLC. Mr. Stephen stated that this is a rezoning request from R- 15 to R-12 so that this site will match the existing zoning of the adjacent development to the south and the east. He stated that this rezoning request to R-12 will also match the zoning of the proposed development to the west. He asked for a recommendation of approval to the Town Council for this request. Chairman Hill had no comments. Commissioner Sheridan asked if Mr. West understood that this zoning request matched the zoning of the surrounding neighborhoods. Mr. West is a resident in Eagles Ridge Phase I who sent an email in opposition to this request. Ms. Huggins stated that she responded to Mr. West’s email to let him know that she would pass his remarks along to the Planning & Zoning Commission, but she did not have any other specifics as to why Mr. West is opposed to the request. Mr. Sheridan asked if he is correct in that this request brings this site in line with the rest of the neighborhood. Ms. Huggins responded that he is correct. Commissioner Sheridan asked if this zoning is approved, will the lot layout as proposed be affected. Ms. Huggins responded that it won’t be affected. A preliminary plat has been approved and the lots sizes meet or exceed R-12 zoning. Commissioner Ashby asked if Lot 52 would have to be revised. Ms. Huggins explained that the lots will conform to R-12 zoning. If the zoning change request is not approved, the plat that has been submitted, based on approval of this zoning change request, will have to be revised. Mr. Ashby asked if Lot 52 would lose one-third of the lot with this zoning change. Ms. Huggins explained that the line running through one-third of Lot 52 is where the zoning split occurs and if the zoning change is approved then all of that lot will be R-12 zoning and will conform. Mr. Ashby asked how Lot 11 would be split. Ms. Huggins responded that they will not split any of the lots. Lot 11 will be the rectangular shape of the dashed line on the exhibit. \[The dashed lines show the shape of each lot that will be brought forward on a plat in the near future.\] There were no further questions and Chairman Hill called for a motion. Commissioner Sheridan made a motion recommending approval of the zoning change request from R-15 Single Family Residential to R-12 Single Family Residential. Commissioner Ashby seconded the motion. Ayes: Hill, Reed, Ashby, Sheridan, Forest Nays: None Action: 5-0, Approved 5 PUBLIC HEARING REGARDING CHANGES TO THE TOWN OF TROPHY CLUB CODE OF ORDINANCES, COMPREHENSIVE ZONING ORDINANCE, SUPPLEMENTARY DISTRICT REGULATIONS, INCLUDING WITHOUT LIMITATION, AMENDING AND ADOPTING NEW REGULATIONS AFFECTING ACCESSORY STRUCTURES, AND AFFECTING LOCATIONS OF FLAG POLES. (ADM-09-002) Chairman Hill announced the case and opened the public hearing. There was no one present wishing to speak and the public hearing was closed. 6 DISCUSSION AND APPROPRIATE ACTION REGARDING CHANGES TO THE TOWN OF TROPHY CLUB CODE OF ORDINANCES, COMPREHENSIVE ZONING ORDINANCE, SUPPLEMENTARY DISTRICT REGULATIONS, INCLUDING WITHOUT LIMITATION, AMENDING AND ADOPTING NEW REGULATIONS AFFECTING ACCESSORY STRUCTURES, AND AFFECTING LOCATIONS OF FLAG POLES. (ADM-09-002) Ms. Huggins explained that this request is to clarify the intent of the ordinance regarding locations of flagpoles. The current ordinance is confusing in that flagpoles are allowed in the front yard but must be behind the front building setback. Most homes are built on the setback which does not allow any yard between the house and the front setback line, thus there is no allowable space for a flagpole. Staff is requesting changes to item “vi” as shown on page 40 of the packet. Commissioner Ashby asked if the ordinance prevents offensive flags. Ms. Huggins responded that there is another section of the ordinance that addresses what type of flags can be flown. Mr. Ashby requested that this be looked at and possibly brought back to a future meeting for consideration. He would not wish to see skull and crossbones or swastikas flying from a flagpole in Trophy Club. He also asked if there is a limit to how many flags can be flown on each pole. Commissioner Reed asked if one flag pole should be specified, which would help limit the number of flags. Commissioner Ashby stated that he has seen many flagpoles with several flags flying from them – the National flag, the State flag, and a school flag. Commissioner Ashby made a motion recommending approval of this request. Commissioner Sheridan asked to amend the motion contingent upon adding a statement referencing the section(s) of the ordinance that indicates types of flags that can be flown. Commissioner Ashby accepted the amendment and Commissioner Sheridan seconded the motion. Ayes: Hill, Reed, Ashby, Sheridan, Forest Nays: None Action: 5-0, Approved Item “vi” will be changed to incorporate the stipulations of the Planning & Zoning Commission motion. ADJOURNMENT Chairman Hill adjourned the meeting at 7:22 p.m.
