ORDINANCE NO. 2001 - 03
AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS,
AUTHORIZING AND ALLOWING, UNDER THE ACT GOVERNING THE
TEXAS MUNICIPAL RETIREMENT SYSTEM, RESTRICTED PRIOR
SERVICE CREDIT TO ELIGIBLE TOWN EMPLOYEES WHO ARE
MEMBERS OF THE SYSTEM FOR SERVICE PREVIOUSLY
PERFORMED FOR VARIOUS OTHER PUBLIC ENTITIES FOR WHICH
THEY HAVE NOT RECEIVED CREDITED SERVICE; PROVIDING FOR
SEVERABILITY; PROVIDING ENGROSSMENT AND ENROLLMENT;
AND ESTABLISHING AN EFFECTIVE DATE.
NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
WHEREAS, the Town Council of the Town of Trophy Club, Texas is empowered under
Texas Local Government Code Section 51.001 to adopt an ordinance or rule that is for the good
government of the Town.
WHEREAS, Section 853.305 of the Texas Government Code authorizes the Town of
Trophy Club, Texas to grant restricted prior service credit to an eligible Town employee who is a
member of the retirement system for service previously performed; and
WHEREAS, the Trophy Club Town Council has determined that it is in the best interests
of efficient local govermnent to recognize and grant restricted prior service credit to its eligible
employees.
SECTION 1.
AUTHORIZATION
(a) On the terms and conditions set out in Section 853.305 of Subtitle G of Title 8,
Texas Governinent Code, as amended (hereinafter referred to as the "TMRS
Act"), each eligible member of the Texas Municipal Retirement System
(hereinafter referred to as the "System") who is now or who hereafter becomes an
employee of this Town shall receive restricted prior service credit for service
previously performed as a ftill-time paid employee of any of the entities described
in Section 853.305 provided that (1) the person does not otherwise have credited
service in the System for that service as provided by Section 853.305 as amended,
and (2) the service meets the requirements of Section 853.305, as amended, and
all other applicable requirements.
(b) The restricted prior service credit hereby granted may be used only to satisfy
length -of -service requirements for retirement eligibility, has no monetary value in
computing the annuity payments allowable to the member, and may not be used in
other computations, including computation of Updated Service Credits.
(c) A member seeking to establish restricted prior service credit wider this ordinance
must tape the action required under Section $53.305, as amended, while still an
eligible employee of this Town.
(d) In this Ordinance "full-time paid employee" has the meaning assigned to the term
"employee" by Texas Government Code Section 851.001, except that the services
do not have to be performed for a municipality.
SECTION 3.
SEVERABILITY
If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance, or
its application to airy person or circumstance is held invalid or unconstitutional by a Court of
competent jurisdiction, such holding shall not affect the validity of the remaining portions of this
Ordinance; and the Town Council hereby declares it would have passed such remaining portions
of the Ordinance despite such invalidity, which remaining portions shall remain in full force and
effect.
SECTION 4.
ENGROSSMENT AND ENROLLMENT
The Town Secretary is hereby directed to engross and enroll this Ordinance by copying
the caption and effective date clause in the minutes of the Town Council and by filing this
Ordinance in the ordinance records of the Town.
SECTION S.
EFFECTIVE DATE
This Ordinance shall become effective from and after its date of passage as required by
law.
