ORDINANCE NO. 0 88-10
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN
OF TROPHY CLUB, TEXAS, ESTABLISHING A TWENTY
(20) MILE PER HOUR SCHOOL ZONE ON VILLAGE
TRAIL ROAD FROM THE ZERO (0) BLOCK TO THE 200
BLOCK; PROVIDING FOR THE POSTING OF SCHOOL
ZONE AND SPEED LIMIT SIGNS; PROVIDING A
SAVINGS CLAUSE AND REPEALING ORDINANCE NO.
86-15; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A PENALTY NOT TO EXCEED THE SUM OF
FIVE HUNDRED DOLLARS ($500.00) FOR EACH
OFFENSE AND A SEPARATE OFFENSE SHALL BE
DEEMED COMMITTED EACH DAY DURING OR ON WHICH
A VIOLATION OCCURS OR CONTINUES; DECLARING
AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Town Council of the Town of Trophy Club,
Texas (the "Town") is empowered under articles 1011 and 1015 of
the Texas Revised Civil Statutes Annotated (Vernon), as
amended, to do all acts and make all regulations which may be
necessary or expedient for the promotion of the public health;
and
WHEREAS, the Town under article 1016 of said State
statutes is given control and power over the streets and roads
of the Town including the power to regulate said streets and
roads; and
WHEREAS, the Town Council is authorized under sections 26
and 27 of article 6701d of said State statutes to adopt local
traffic regulations with respect to streets and roads under its
jurisdiction; and
WHEREAS, the Town Council is authorized under section 169
of article 6701d of said State statutes to alter the prima
facie speed limits within the corporate limits of the Town; and
WHEREAS, the Town Council desires to establish
regulations governing the maximum speed of vehicles as they
travel through school and playground areas within the corporate
limits of the Town; and
WHEREAS, many school children must use certain streets
within the Town to travel to and from school and playground
areas and it is deemed necessary by the Town Council to protect
such children by reducing the speed on such streets; and

WHEREAS, the Town Council hereby finds that the reduction
of the speed of motor vehicles in and around school locations
is in the best interest of the health, safety and welfare of
the citizens of the Town.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
Section 1. That all of the above premises are found to
be true and correct and are incorporated into the body of this
ordinance as if copied in their entirety.
Section 2. No person shall drive a vehicle on a street
or highway within the Town at a speed greater than is
reasonable and prudent under the circumstances then existing;
provided, however, that the following areas, streets or
portions thereof shall be designated special speed zones and it
shall be unlawful for any person to drive any vehicle thereon
at a speed greater than twenty (20) miles per hour during the
designated times:
A. On Village Trail Road from the 0 block to the 200
block, between the hours of 7:00 a.m. and 9:00 p.m., 7 days a
week, Sunday through Saturday.
For purposes of this ordinance, the term "vehicle" shall
mean every device in, upon., or by which any person or property
is or may be transported or drawn upon a street or highway,
except devices used upon stationary rails or tracks.
Section 3. That school zone and speed limit signs in
conformity with this ordinance and the manual and
specifications for uniform traffic control devices as adopted
by the State Highway Commission shall be and hereby are
directed to be erected at the appropriate locations as
determined by the Town Marshal.
Section 4. That the Town Marshal or such representative
as he may appoint is hereby authorized and directed to cause
school zone and speed limit signs to be posted and maintained.
Section. 5. This Ordinance shall be cumulative of all
other ordinances of the Town of Trophy Club, Texas, affecting
traffic control and shall not repeal any of the provisions of
said ordinances except in those instances where provisions of
those ordinances are in direct conflict with the provisions of
this Ordinance. Provided, however, that Ordinance No. 86-15 of
the Town, is hereby repealed, but shall remain in full force and
effect until such time as this ordinance takes effect.
Section 6. That if any section, paragraph, sentence,
clause, phrase or word of this ordinance, or application hereof
to any person or circumstance, is held invalid by any Court of

competent jurisdiction, such holding shall not affect the
validity of the remaining portions of the ordinance; and the
Town Council hereby declares it would have passed such
remaining portions of the ordinance despite such invalidity,
which remaining sections and parts shall remain in full force
and effect.
Section 7. That it shall be unlawful for any person to
violate any provision of this ordinance, and any person
violating any provision of this ordinance shall be deemed
guilty of a misdemeanor and upon conviction thereof shall be
subject to a fine in an amount not to exceed the sum of Five
Hundred Dollars ($500.00) and a separate offense shall be
deemed committed upon each instance during or on which a
violation Occurs or continues.
Section. 8. That this ordinance shall be effective from
and after its date of passage and publication as provided by
law.
PASSED AND APPROVED by the Town Council of the Town of
Trophy Club, Texas on this 23 day of May , 1988.
