ORDINANCE NO. 0 85-8
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN
OF TROPHY CLUB, TEXAS DESIGNATING STOP
INTERSECTIONS WITHIN THE TOWN; PROVIDING FOR THE
POSTING OF STOP SIGNS; PROVIDING A SEVERABILITY
CLAUSE, PROVIDING A PENALTY OF NOT LESS THAN ONE
DOLLAR NOR MORE THAN TWO HUNDRED DOLLARS FOR
EACH OFFENSE; PROVIDING AN EMERGENCY AND
DECLARING AN EFFECTIVE DATE.
WHEREAS, the Town Council is empowered under Articles 1011 and 1015,
Vernon's Annotated Texas Civil Statutes, ("V.A.T.C.S.") to do all acts and make all
regulations which may be necessary or expedient for the promotion of the public
health; and
WHEREAS, pursuant to Article 1016, V.A.T.C.S., the Town Council is given
control and power over the streets and roads of the Town including the power to
regulate said streets and roads; and
WHEREAS, the Town Council is authorized under Sections 26 and 27 of
Article 67014, V.A.T.C.S. to adopt local traffic regulations with respect to streets
and highways under its jurisdiction; and
CWHEREAS, the Town Council is authorized under Section 91 of Article 6701d,
V.A.T.C.S. to erect stop signs at specified entrances to highways and streets under
its jurisdiction and designate any intersections as a stop intersection and erect
appropriate signs at one or more entrances to such intersections; and
WHEREAS, the Town Council hereby finds and determines that the
designation of specified intersections as stop intersections within the Town is
necessary for the promotion of the health, safety and welfare of the Town and its
citizens.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
Section 1. That all of the above premises are found to be true and correct
and are incorporated into the body of this Ordinance as if copied in their entirety.
Section 2. It is hereby provided that stop signs shall be erected. at the
following intersections and such intersections are hereby designated as stop
intersections. Every driver of a vehicle and every motorman of a street car
approaching a stop intersection shall stop before entering the crosswalk on the near
side of the intersection or, in the event there is no crosswalk, shall stop at a clearly
marked stop line, but if none, then at the point nearest the intersecting roadway
where the drive has a view of the approaching traffic on the intersecting roadway
before entering the intersection, except when directed to proceed by a police
officer or traffic control signal. The stop intersections and locations of stop signs
Cshall be as follows:
At the corner of every street or court intersecting with and entering onto
Trophy Club Drive, with the exception of the intersection of Trophy
Club Drive and Indian Creek Drive.
At the corner of every street or court intersecting with and entering onto
Indian Creek Drive, with the exception of the intersection of Indian
Creek Drive and Trophy Club Drive.
At the corner of every street or court intersecting with and entering onto
Village Trail Drive.
At the northwest corner of the intersection of Trophy Club Drive and State
Highway 114 facing north on Trophy Club Drive.
At the northwest corner of the intersection of Trophy Lake Drive and State
Highway 114 facing north on Trophy Lake Drive.
At the northeast corner of the intersection of Indian Creek Drive and Trophy
Wood Drive facing east on Indian Creek Drive.
At the southwest corner of the intersection of Indian Creek Drive and Trophy
Wood Drive facing west on Indian Creek Drive.
At the southeast corner of the intersection of Indian Creek Drive and Trophy
Wood Drive facing south on Trophy Wood Drive.
At the northeast corner of the intersection of Inverness Drive and Forest Hill
Drive facing east on Inverness Drive.
At the northeast corner of the intersection of Phoenix Drive and Pebble Beach
Drive facing east on Phoenix Drive.
At the northeast corner of the intersection of Carnoustie Drive and Oakmont
Drive facing east on Carnousite Drive.
At the northwest corner of the intersection of Seminole Drive and Fresh
Meadow Drive facing north on Seminole Drive.
Section 3. That stop signs in conformity with the manual and specifications
for uniform traffic control devices as adopted by the State Highway Commission
shall be and hereby are directed to be erected by the Town Marshal, or his duly
authorized agent, in accordance with State law at the locations specified in Section
2 of this Ordinance.
Section 4. That it shall be unlawful for any person to violate any provision of
this Ordinance, and any person violating any provision of this Ordinance shall be
deemed guilty of a misdemeanor and upon conviction thereof shall be subject to a
fine in an amount of not less than One Dollar ($1.00) nor more than Two Hundred
Dollars ($200.00).

Section 5. If any section, paragraph, sentence, clause, phrase or word in this
Ordinance, or application hereof to any person or circumstances, is held invalid by
any Court of competent jurisdiction, such holding shall not affect the validity of the
remaining portions of the Ordinance; and the Town Council hereby declares it would
have passed such remaining portions of this Ordinance despite such invalidity, which
remaining sections and parts shall remain in full force and effect.
Section 6. The fact that the present ordinances and regulations of the Town
of Trophy Club, Texas, are inadequate to properly safeguard the health, safety,
morals, peace and general welfare of the inhabitants of the Town of Trophy Club,
Texas, creates an emergency for the immediate preservation of public business,
property, health, safety and general welfare of the public which requires that the
provisions of this Ordinance shall take effect upon the posting of the signs directed
by Section 3 above, and publication of this ordinance as provided by law, and it is
accordingly so ordained.
