ORDINANCE NO. p 85-14
AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS,
ADOPTING AND AMENDING THE 1985 EDITION OF THE
UNIFORM FIRE CODE; PROVIDING AN ENFORCEMENT CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY,
AND DECLARING AN EMERGENCY
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY
CLUB, TEXAS:
Section 1. Adoption. That there is hereby adopted by the Town of
Trophy Club, Texas, for the purpose of prescribing regulations governing
conditions hazardous to life and property, the 1985 edition of the Uniform Fire
Code, and it is hereby incorporated herein as if fully set out in length herein and
from the date on which this ordinance shall take effect the provisions thereof
shall be controlling within the limits of the Town of Trophy Club. A copy of
the said Code shall be kept on file in the office of the Town Secretary.
Section 2. Enforcement.
(a) The enforcement of this Code shall be by the Town Council of the
Town of Trophy Club, Texas, or through any person whom it may designate
provided that such person is employed as an employee or under a contract with
the Town.
(b) Notice Required. That before the filing of a criminal complaint
hereunder, notice of the specific violation shall be posted at the building site and
sent by U. S. Mail. The notice shall state a reasonable time within which
correction of the violation shall be allowed. Within the discretion of the
designated person charged with enforcement of this ordinance, the particular
building or structure under construction shall be allowed to continue except for
that portion specifically cited to be in violation of this ordinance.
Section 3. Severability. Provisions of this ordinance shall be, and they
are hereby, declared to be severable, and should any portion of it be declared
to be invalid for any reason by a court of competent jurisdiction, such holding
shall not affect the remaining portions thereof.
Section 4. Penalty. That it shall be unlawful for any person to
violate any provision of this ordinance, and any person violating any provision of
this ordinance shall be deemed guilty of a misdemeanor and upon conviction
thereof shall be subject to a fine in an amount not to exceed Two Hundred
Dollars ($200.00), and a separate offense shall be deemed committed upon each
day during or on which a violation occurs or continues.
Section 5. Emergency. The fact that the present ordinances and
regulations of the Town of Trophy Club, Texas, are inadequate to properly
safeguard the health, safety, morals, peace and general welfare of the
inhabitants of the Town of Trophy Club, Texas, creates an emergency for the
immediate preservation of the same which requires that this ordinance shall
become effective from and after the date of its passage and it is accordingly
so ordained.
