ORDINANCE NO. Q$5 15
AN ORDINANCE ESTABLISHING AND LEVYING A PRIVATE CLUB
REGISTRATION PERMIT FEE AND A PRIVATE CLUB LATE
HOURS PERMIT FEE IN ACCORDANCE WITH THE TEXAS
ALCOHOLIC BEVERAGE CODE, SECTION 11.38; PROVIDING A
PENALTY NOT TO EXCEED THE SUM OF TWO HUNDRED
DOLLARS ($200.00) AND A SEPARATE OFFENSE SHALL BE
DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH
A VIOLATION OCCURS; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING AN EFFECTIVE DATE AND DECLARING AN EMER-
GENCY
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL
OF THE TOWN OF TROPHY CLUB:
Section 1. That a private club registration permit fee and a private
club late hours permit fee is hereby established and levied pursuant to the Texas
Alcoholic Beverage Code, 11.38, as follows:
There is hereby levied as an annual fee, pursuant to Article
11.38 of the Alcoholic Beverage Code of the State of Texas, the
following schedule of fees for a license or permit issued for
premises located within the Town under the Alcoholic Beverage
Code, which fees shall be equal at all times, irrespective of the
dollar amount delineated, to one-half of the fee assessed by the
State of Texas for each license or permit pursuant to the Alcoholic
Beverage Code:
(a) For each private club registration permit
which fee is based on the highest number
of members in good standing during the
year for which the permit fee is to be
paid according to the following rates:
Members Fee
0 to 250 $375.00
251 to 350 525.00
351 to 450 675.00
451 to 550 825.00
551 to 650 975.00
651 to 750 1,125.00
751 to 850 1,275.00
851 to 950 1,425.00
951 to 1,000 1,500.00
Over 1,000 1.50 per member
(b) For each beverage cartage permit for
each holder of a private club registration
permit 10.00
(c) For each private club late hours
permit . 375.00
(d) For each caterer's permit 250.00
Section 2. All permit fees are due at the same time the state permit
fees are due, provided all 1985 permit fees are due and payable within thirty (30)
days of the effective date of this Ordinance at the rate of one-half (1/2) of the
total annual fee.
Section 3. if any section, article, paragraph, sentence, clause, phrase or
word in this Ordinance, or application thereto any person or circumstance is held
invalid or unconstitutional by a Court of competent jurisdiction such holding
shall not affect the validity of the remaining portions of the Ordinance; and the
Town Council hereby declares it would have passed such remaining portions of
the Ordinance despite such invalidity, which remaining portions shall remain in
full force and effect.
Section 4. Any person violating any of the provisions of this Ordinance
shall be deemed guilty of a misdemeanor and upon conviction thereof shall be
fined in a sum not to exceed Two Hundred Dollars ($200.00) and a separate
offense shall be deemed committed upon each day during or on which a violation
occurs or continues.
Section 5. The fact that the present Ordinances and Regulations of the
Town of Trophy Club, Texas, are inadequate to properly safeguard the health,
safety, morals, peace and general welfare of the inhabitants of the Town of
Trophy Club, Texas, creates an emergency for the immediate preservation of
public business, property, health, safety and general welfare of the public which
requires that this Ordinance shall become effective from and after the date of
its passage as provided by law and it is accordingly so ordained.
