Discussion and interpretation on the request for classification of unlisted uses
related to off -premise signs on a property known as the Trophy Club Plaza, PD -21.

STAFF COMMENTS: Mr. Parrow would like to place 5 signs at various entrances of the
Trophy Club Plaza (PD -21). Mr. Parrow is sponsoring a website to promote the Town of Trophy
Club. Initially he looked at the Town's sign ordinance in order to research any signage
restrictions. However, as you know the Plaza is a PD zoning district and therefore has signage
criteria specific to the Plaza PD.
The zoning ordinance for PD -21 covers signage requirements from "Monument" and "Building"
signage to "Directional" signage. Also, it states: Special sign considerations may be approved
by the Town Council and the Planning & Zoning Commission.
It is my interpretation that this provision is referring to signage in direct relation to businesses
within the site. However, as it does not specifically state such, or that off -premise signage is
prohibited, I am requesting the Commission make an interpretation as to whether this provision
is referring to on-site signage or off-site signage.
Section 12 of the Zoning Ordinance states the following:

A. Referral to Planning and Zoning Commission: The Planning and Zoning
Administrator shall refer the question concerning any new or unlisted use to the Planning
and Zoning Commission, requesting an interpretation as to the zoning classification into
which such use should be placed. The referral of the use interpretation question shall be
accompanied by a statement of facts listing the nature of the uses and whether it involves
dwelling activity, sales, processing, type of product, storage, and amount and nature
thereof, enclosed or open storage, anticipated employment, transportation requirements,
the amount of noise, odor, fumes, dust, toxic material and vibration likely to be generated
and the general requirements of public utilities, such as water and sanitary sewer.
Mr. Parrow has received approval for the placement of the signs from the property owner,
Regency Centers, however Regency understands that there are Town requirements that must be
met as well.
I have included everything Mr. Parrow has given me in your packet. Please note that his website
information will not be included in the Town's newsletter, as referenced in an email transmittal.

Thank You for your Approval of our Community web site sign Site Plan. After I had submitted my location Site Plan request It
was suggested to me that the signs would be better placed if they were all adjacent to the exit side of the shopping center
drives and on the corner of Trophy Lake & Trophy Club drives since all cars stop at these exits to enter the street and at the
comer when they do not stop to enter the center. It was also recommended that I not use the 114 & Trophy Lake location due
to the Guard Rail obstruction and traffic light distractions.
After reviewing these suggestions I again drove the center and must agree with these suggestions. I am therefore requesting
that you review the revised site pian and adjusted locations of the Community Web Site signs and find them acceptable in
the revised locations.

I hope you have had the opportunity to review the two web sites I have set up www. OurTr9R.hyC.lub__Q0M 8
wtw.OurRoanoke.Com . As you will see these are FREE community sites that were created to enhance community
interaction and communication while providing an internet avenue for Merchants to increase their customer base and market
share.
I am requesting your authorization to place these signs at the entry and exit driveways located at the 114 -Trophy Lake drive
and Trophy Lake Drive and Trophy Club drive from Friday Noon until Monday Noon. I would also request, if possible, that I
be permitted to install a few signs on the islands, within the parking area, to remain in place for fib days to insure the
residents have an opportunity to see the signs and log on, to everyone's mutual benefit. As time goes by, and the
participants increase, the Merchants will have a smaller version of this sign in their windows as they sign on to list their
business on the sites to better market themselves. I feel the 64 days requested should be adequate time to accomplish this
transition from street to window signs.

with the advertising.

TOWN'S EAST TOWN LIMIT LINE, AND APPROXIMATELY 600 FEET SOUTH OF THE
TOWN'S NORTHEAST TOWN LIMIT LINE.
Mr. Durbin addressed the Commission. This pad site is more than 1,000' from developed
property and therefore does not require a waiver.
There were no requests to speak from the public.

The Town Council convened into Public Hearing at 7:42 p.m. Chairman Hill explained
that Planning and Zoning Commission reviewed this request at their September 21, 2004
meeting and unanimously recommended approval.

WAIVER REQUEST TO THE REQUIREMENTS SET FORTH IN TOWN ORDINANCE NO.
2002-42 P&Z, SECTION 3 ENTITLED "FENCES", SUBSECTION "B" ENTITLED "HEIGHT
REQUIREMENTS", (1) PERTAINING SPECIFICALLY TO THE HEIGHT OF SIDE YARD
FENCES FOR A PROPERTY LOCATED AT 16 CIMARRON DRIVE, LOT 849 OF VILLAGE
WEST, SECTION "A". APPLICANT: RODNEY WAGNER (FW -04-016)
Vice Chairman Stephens asked the applicant to address the Commission. Mr. Wagner
stated that he had already addressed his comments in his letter of waiver request.
Commissioner Bradley had no comments for the applicant.
Commissioner Moss had no comments for the applicant.
Commissioner Reed addressed the applicant and stated that he could not
recommend approval of the request because he found it hard to believe the applicant
has lived in Trophy Club for over 20 years and he was unaware of any fencing
requirements such as the need to pull a permit as well as height limitations.

Due to the length of the applicant's residency and his line of work, (commercial
masonry company) the Commission moved to deny the request. Surrounding fences
are constructed of wood and it was the opinion of the Commission that cinder block
materials were inconsistent with the surrounding fence materials.
