members of the Commision on October 4, 2012. They were appointed on October
15, 2012.
A motion was made by Commissioner Forest, seconded by Commissioner
Reed, that this Agenda Item be Approved . The motion carried by the following

Chairman Hill announced the case and asked for a staff report.
Ms. Huggins explained that Neighborhood 5, Phase 2E plats 18 residential lots and 4
common areas. The 18 residential lots consist of four (4) lot type 1 lots and fourteen
(14) lot type 2 lots. The lots are located on the north side of Trophy Club Drive
between Highlands Drive and Trophy Park Drive.
The property is currently vacant.
A preliminary plat was approved on December 18, 2006, and the final plat conforms
to the preliminary plat. The plat is in conformance with the subdivision rules and
regulations, the zoning ordinance and PD-27.
The engineering documents have been reviewed and approved by the Town
Engineer and staff recommends approval of this plat.
Kyle Salzman, Jacobs Engineering, is present representing the applicant and is
available to answer questions from the Commissioners.
Chairman Hill called the applicant to the podium. Kyle Salzman, Jacobs Engineering,
came forward and thanked the Commission for hearing this request and stated that
he would be glad to answer any questions.
Tom Rutledge, Town Engineer, stated that the comments were pretty straight forward
and the engineering documents for this plat were pretty simple.
The Commissioners had no questions and Chairman Hill called for a motion.
A motion was made by Commissioner Reed, seconded by Vice Chair Stephens,
that this Agenda Item be Recommended for Approval to the Town Council on
12/10/2012. The motion carried by the following vote.

Ms. Huggins gave the Commissioners an overview of the work that staff will be
performing over the next couple of months in order to bring a revision of the Sign
Ordinance to the Planning and Zoning Commission for a recommendation to the
Town Council.

“NS” Neighborhood Services District Regulations: The purpose of the NS
Neighborhood Service District is to provide limited low impact service type
facilities to residential areas. Services permitted in this district do not involve
retail activity. The uses allowed in these districts should not have an adverse
effect on adjacent residential areas, and may be located close to residential
uses, with appropriate buffers and landscaping. The NS district regulations and
the zoning use tables are attached.
Comprehensive Land Use Plan: The Comprehensive Land Use Plan (1997)
calls for this property to be used as Public/Governmental/Church. The current
and proposed uses of this property meet the Comp Plan.
Public Hearing and Property Owner Notification: As required by ordinance, a
notice of public hearing for this zoning change request was published in the local
newspaper at least 15 days prior to the public hearing by the Planning and
Zoning Commission. The publication occurred on November 21, 2012 and the
public hearing will be heard on December 6, 2012. In addition, property owners
within 200-ft. of the church property were notified of this zoning change request.
Thirty-four (34) property owners received notification. As of November 30, 2012,
there have been no responses, for or against.
SUMMARY: The existing use of the property as a church and daycare do not fit
with R-12 zoning. Rezoning to NS will bring the property into zoning compliance
as a church, daycare and private school are allowed uses in the Neighborhood
Services zoning district.

Chapter 13 - Zoning
Section 4.14 NS - Neighborhood Service District Regulations
A. Purpose: The purpose of the NS Neighborhood Service District is to provide limited low impact
service type facilities to residential areas. Services permitted in this district do not involve retail
activity. The uses allowed in these districts should not have an adverse effect on adjacent residential
areas, and may be located close to residential uses, with appropriate buffers and landscaping.
B. Uses Generally: In a NS Neighborhood Service District, no land shall be used and no building or
structure shall be installed, erected for or converted to any use other than as set forth in Section 3.03,
Use Tables, and in accordance with the following:
1. Accessory Uses: Accessory uses shall be permitted within the NS Neighborhood Service
District in accordance with the regulations provided in Section 5.03, Accessory Structures.
2. Conditional Uses: Conditional uses may be permitted within the NS Neighborhood Service
District in accordance with the regulations provided in Section 6.01, Conditional Permit.
3. Limitation of Uses: Any use not expressly permitted herein or allowed by permit is prohibited.
C. Plan Requirements: No application for a building permit for the construction, erection or placement of
a building or structure shall be approved unless:
1. A plat, meeting all requirements of the Town of Trophy Club, has been approved by the Town
Council and recorded in the official records of the County in which the property is located;
2. Site Plan: A Site Plan has been approved meeting the conditions as provided in Section 5.09,
Site Plan Requirements.
3. A Landscape Plan, meeting the requirements of Section 7.03, Landscaping Regulations, has
been approved.
D. Density Regulations: None.
E. Height Regulations: Except as provided by Section 5.04, Height Limits, no building or structure shall
exceed 40' feet or two (2) stories in height. Any building or structure adjoining or contiguous to a
residentially zoned district shall not exceed 28 feet or one (1) story in height.
F. Area Regulations: The following minimum standards shall be required, measured from property
lines:
AREA DESCRIPTION AREA REGULATIONS
1. Minimum Open Space At least twenty percent (20%) of the total lot area shall be
devoted to non-vehicular open space. (non-vehicular open
space is any area not devoted to buildings, parking, load,
storage, or vehicular use.)
2. Maximum Building Coverage The combined area covered by all main and accessory
buildings and structures shall not exceed sixty percent (60%)
of the total lot area.

3. Maximum Impervious Area The combined area occupied by all buildings, structures, off-
street parking and paved areas shall not exceed eighty percent
(80%) of the total lot area.
4. Depth of Front Yard 30 feet minimum
5. Depth of Rear Yard 30 feet minimum (No rear yard shall face any street)
6. Width of Side Yard on Each
Side
15 feet minimum
*All required yards shall comply with Section 5.05, Required Yards.
G. Buffered Area Regulations: Whenever a NS Neighborhood Service Development is located
contiguous to an existing residential development or an area zoned for residential purposes, all
principal buildings or structures shall be set back a minimum of forty (40) feet from the adjoining
property line. The setback area shall contain landscape improvements, fencing, berms or trees to
provide visual and acoustical privacy and to adequately buffer adjoining uses.
H. Off-Street Parking: Off-street parking shall be provided in accordance with the provisions of Section
7.04, Off-Street Parking Requirements, and all other applicable ordinances of the Town.
I. Off-Street Loading: Off-street loading shall be provided as required by Section 7.05, Off-Street
Loading Requirements.
J. Landscaping Requirements: Landscaping shall be required in accordance with Section 7.03,
Landscaping Regulations.
K. Design Requirements: The following design requirements shall apply in the NS Neighborhood
Service District:
1. No outdoor storage, except for refuse disposal, shall be permitted. Refuse disposal areas
shall be landscaped and screened from view.
2. Mechanical and electrical equipment, including air conditioning units, shall be designed,
installed and operated to minimize noise impact on surrounding property. All such equipment
shall be screened from public view.
3. Lighting shall be designed to reflect away from any adjacent residential area.
L. Masonry Requirement: All principal and accessory buildings and structures shall be of exterior fire
resistant construction having one hundred (100) percent of the total exterior walls, excluding doors,
windows and porches, constructed of brick, stone, or stucco. All exterior chimneys surfaces shall
also be of brick, stone, or stucco. Other materials of equal characteristics may be allowed upon
approval of the Planning and Zoning Commission.

A Public Hearing will be held by the Planning & Zoning Commission of the Town
of Trophy Club in the Boardroom of the Municipal Utility District Building, 100
Municipal Drive, at 7:00 p.m., Thursday, December 6, 2012, to consider a request
for zone change for an approximate 11.603 acres of land; from its current zoning
of “R-12” Residential Single Family to “NS” Neighborhood Services; amending
Ordinance No. 2000-06 P&Z of the Town, the same being the Comprehensive
Zoning Ordinance, and Amending the Official Zoning Map of the Town by
changing the zoning, providing that such tract of land shall be used in
accordance with the requirements of the Comprehensive Zoning Ordinance and
all other applicable ordinances of the Town. (ZCA-12-018)

This notice is in reference to a zoning change request for The Church at Trophy
Lakes, 800 Trophy Club Drive, Trophy Club, Texas 76262. The property owners
wish to remodel and expand the daycare in the existing building, and add a
private school K-3, and, eventually, a larger sanctuary.
The property is 11.603 acres of land located at the roundabout intersection of
Trophy Club Drive and Trophy Lake Drive. This request is to rezone the church
from R-12 Single Family Residential to “NS” Neighborhood Services so that the
use of a church, daycare, and private school will be appropriate to the zoning.
“NS” Neighborhood Services zoning allows a church, allows a day care and
allows a school.
A zoning change request from R-12 to NS makes sense for the church as the
uses of the property match NS zoning and brings the property into conformance
with the Town’s zoning regulations.
To Surrounding Land Owners: Property owners in the Town of Trophy Club
within 200-ft. (two hundred feet) of this property receive written notification of this
request. All interested property owners are encouraged to attend these hearings.
