CASE REVIEW: The applicant has a request from a tenant, Tom Thumb
Grocery Store, to add a fuel station in the Plaza Shopping Center. This use is
not currently allowed as a “permitted use”. The “Plaza” shopping center, PD-21,
allows “Professional, Business and Retail uses” as outlined in the attached
“Exhibit C”, the Development Standards for this Shopping Center, as well as in
Divisions E, F, and G of the Comprehensive Zoning Ordinance. The applicant
would like to amend “Exhibit C” of the ordinance to allow this use.
The fuel station will eliminate existing parking spaces to the north of the Bank of
America Building for construction of a fuel station kiosk. If the use is
recommended for approval by the Planning and Zoning Commission and is
approved by Town Council, civil drawings and a site plan are required for Town
Engineer and Staff review prior to construction of the fuel station and the Site
Plan requires Planning and Zoning Commission review and recommendation and
Town Council approval. Review would include an examination of all aspects of

fire safety of a fuel station at this location, adequate parking for the uses in the
shopping center, landscaping, and lighting.
Tom Thumb proposes a 15-ft. x 30-ft. kiosk and a 45-ft. x 95-ft. canopy with four
(4) multiple pump dispensers, for a total of eight (8) gasoline pumps. No pumps
will dispense diesel fuel.
If approved, the PD shall be amended:
(1) To allow a fuel station as a permitted use (A. 1. (c) Permitted Uses).
(2) Remove the restriction of 5 buildings from (g) (ii) Maximum flood
area, number of buildings, to allow a fuel kiosk structure. All other
maximums and minimums to stay the same.
(3) Change Parking, loading regulations in (h) to reflect “as shown on
site plan” as the fuel station will eliminate approximately 40 parking
spaces which may take the remaining spaces to below “1 space for
each 200 sq. ft. of building area” as required by the PD.
PUBLIC HEARING:
As required by ordinance, a notice of public hearing was published in the local
newspaper and property owners within 200-ft. of the shopping center were
notified of this request. Copies of both notices are attached. No comments
have been received for or against this request.
STAFF RECOMMENDATION: Staff supports the applicant’s request to amend
the permitted uses to allow a fuel station.

Amending Ordinance No. 99-17 P&Z, Planned Development District No. 21 “Plaza”,
Trophy Club, Texas, to allow a fuel station as a permitted use, and other miscellaneous
changes to PD-21 as related to this request as deemed necessary.
The Town Council will hear the above item on Monday, January 23, 2012 in the

SUBJECT: Discussion and Recommendation regarding granting a Special
Privilege Request to the Trophy Club Women’s Club to hold two
Community Garage Sale Events in 2012. Applicant: Sally Fre eman
on behalf of Trophy Club Women’s Club.
STAFF COMMENTS:
On behalf of the Trophy Club Women’s Club, Ms. Freeman is requesting permission to
hold two community-wide garage sale events in Trophy Club in 2012.
The Women’s Club requests waiver of the $25 per event fee.
The Spring garage sale will be held Saturday, April 21, 2012 and the Fall sale will occur
Saturday, October 20, 2012. Each event will be held from 8:00 a.m. to 2:00 p.m. No
alternate rain dates will occur.
As required by ordinance, the Police Chief has reviewed this request and given DPS
approval.
Trophy Club Code of Ordinance, Chapter 13-Zoning allows a community garage sale by
special privilege upon approval by the Town Council, after recommendation by the
Planning and Zoning Commission. The ordinance stipulates that only civic organizations
or non-profit organizations shall be granted Special Privilege for a garage sale event
and that such events shall not occur more than twice annually; and each event shall be
one day in duration.

LOCATION: This property is located on the south side of Trophy Club Drive
between Highlands Drive and York Street and will be accessed from a slip road
running parallel with Trophy Club Drive. The proposed street meets the
requirements of the 35-ft. width as specified in the development standards in PD-

HISTORY:
This property is currently vacant. A preliminary plat was approved for Waters
Edge at Hogan’s Glen on December 3, 2007. The zoning of PD-22 was
approved by the Town Council on May 2, 2000.
REVIEW: The final plat has been reviewed for compliance with the Town’s
Subdivision Ordinance, the approved preliminary plat, as well as the
Development Standards as set forth in Ordinance No. 2000-09. The proposed
development indicates six (6) single family residential lots ranging in size of
15,002 sq. ft. to 29,620 sq. ft. and two (2) small common area lots adjacent to
Indian Creek Drive. In reviewing this final plat, it appears to comply with the
approved preliminary plat as well as the development standards approved in PD
22 for Estate Lots.

RECOMMENDATION: Staff recommends approval with the following
stipulations:
1. Revise the side building line from 10-ft. to 15-ft. for Lot 2, Block M and Lot
42, Block L as they are adjacent to Indian Creek Drive which requires a 15
foot side yard setback.
2. Update year to 2012 in Owner’s Dedication, Notary, and Approval
signature blocks.
3. Add a note that the Homeowners Association is responsible for
maintenance of all common areas.
4. Remove extra space between “Improvements” and “Associated” in Note 3.

REVIEW: The final plat has been reviewed for compliance with the Town’s
Subdivision Ordinance, the approved preliminary plat, as well as the
Development Standards as set forth in the Town of Trophy Club’s Zoning
Ordinance. The proposed development indicates 20 single family residential lots
ranging in size of 12,150 sq. ft. to 20,813 sq. ft. and two (2) Common Area lots
adjacent to Indian Creek Drive. In reviewing the approved preliminary plat as
well as the development standards approved in the R-12, Residential Zoning
District, it appears that the plat meets the minimum requirements.
This neighborhood will be gated and will be a part of the Hogan’s Glen
Homeowners Association. The HOA will be responsible for the maintenance of all
common areas.
There are two (2) existing roadway easements – one is shown on the final plat as
a 30-ft. road easement. This easement was granted by the Municipal Utility
District and the applicant has worked with the MUD to abandon this easement by
separate instrument. The other easement is a road easement provided by
Ordinance (No. 1999-15), which will be abandoned by Ordinance, by the Council,
when this plat is heard by Council. Abandonment of both easements, clears the
property to allow Indian Creek Drive to be continued as a paved road west and
north of Harmony Park.
