The Planning and Zoning Commission of the Town of Trophy Club met in Regular
Session on Monday, February 9th, 1987 at 7:00 p.m. at the Municipal Utility
District Building, 100 Water Plant Road, Trophy Club, Texas 76262. The
meeting was held within the boundaries of the Town and was open to the public.

Bill Tynes, Chairman, called the meeting to order at 7:07 p.m.
COMMISSION TO CONSIDER VARIANCES TO ORDINANCES AND DEED RESTRICTIONS
WALL UNIT AIR CONDITIONER AT 506 INDIAN CREEK DRIVE
The Planning and Zoning Commission was told by the City Attorney that they
could not grant variances to the deed restrictions and covenants. Bill
Richardson stated that the Architectural Control Committee could not
enforce deed restrictions that had been violated repeatedly in the past.
Because of deviations in the past to the deed restrictions they were not
enforceable. Bill Richardson requested a meeting between the Plan Review
Committee, Architectural Control Committee, Municipal Utility District,
Planning and Zoning Commission, City Council and Builders to set up procedures
for Plan Approval. The Planning and Zoning Commission agreed to the meeting
but did not set up a specific date.
No action was taken on the wall unit air conditioner at 506 Indian Creek Dr.
Commissioner Reuss made a motion to allow the Plan Review Committee to grant
or deny variances to City Ordinances unless appealed by the Owner or Builder.
If there is an appeal, the appeal would be handled by the Planning and Zoning
Commission. Commissioner Kemp seconded the motion. Motion carried unanimously.
Commissioner Reuss made a motion to add to the building permit application
a question asking the applicant if he would be using a wall unit air conditioner
or a window unit air conditioner? Commissioner Kemp seconded the motion.
Motion carried unanimously.

4 1/2 FT. FENCE ON TOP OF RETAINING WALL AT 228 OAK HILL DRIVE
Commissioner Hamper made the motion to grant the variance to the Fence Ordinance.
Commissioner Reuss seconded the motion. Motion carried unanimously.
APPROVAL FOR PROPOSED SUBSTITUTION ON CEILING MATERIAL FOR BAPTIST CHURCH
Commissioner Kemp made the motion to approve substitution of ceiling materials
for the Baptist Church. Commissioner Hamper seconded the motion. Motion carried
unanimously.
SET BACK VARIANCE FOR A PROPOSED DECK AT #1 OAK HILL COURT
Commissioner Reuss made the motion to approve a set back variance for a proposed
deck at 1 Oak Hill Court. Commissioner Kemp seconded the motion. Motion carried
unanimously.
REQUEST TO RELOCATE STREET LIGHT AT 11 WENTWORTH COURT
Commissioner Kemp made the motion to approve relocating the street light as long
as the homeowner stays within his property line. Commissioner Reuss seconded the
motion. Motion carried unanimously.
ALLOW SALES OFFICE TO PUT UP SECURITY LIGHTS IN PARKING LOT
The Planning and Zoning Commission requested more information from the Sales
Office. The location, candle power, material and height of pole for the security
lights was requested by the Planning and Zoning Commission. The Planning and Zoning
Commission also asked the recording secretary to contact Texas Power & Light to
find out why Trophy Club is the only City in Texas that requires a release from
the City in order to put up security lights.
No action was taken.
PRESENTATION: FREEZE & NICHOLS, INC., STREET AND STORM DRAIN DESIGN STANDARDS
Dan Boutwell, City Planner, made statement that in accordance with the City
Council's request to reduce the scope of work involved in the preparation of
the Street and Storm Drain Design Standards, he has developed a proposal of
services. Since the Subdivision Regulations has an engineering design section
included in it, we proposed that that section be expanded to include the basics
of the Street and Storm Drain Design Standards.
Commission Reuss made the motion to approve and recommend to the City Council that
the Street and Storm Drain Design Standards be included in the Subdivision
Regulations. Commissioner Kemp seconded the motion. Motion carried unanimously.
UPDATE FROM PLAN REVIEW COMMITTEE
Commissioner Kemp made the motion to have the building inspector check to make
sure that drainage is as shown on plans. Commissioner Reuss seconded the motion.
Motion carried unanimously.
