Minutes P&Z 08/06/1992 - Joint Public HearingMINUTES OF JOINT PUBLIC HEARING/TOWN COUNCIL MEETING TOWN OF TROPHY CLUB TROPHY CLUB, TEXAS THE STATE OF TEXAS $ 3 COUNTY OF DENTON 4 The Town Council of the Town of Trophy Club, Texas met in regular session on Thursday, August 6, 1992. The meeting was held within the boundaries of the Town and was open to the Public. PLEDGE OF ALLEGIANCE TO THE AMERICAN AND TEXAS FLAGS The pledge of allegiance to the American and Texas Flags was led by Recording Secretary Pauline Shaw. Page 2, Joint Public Hearing/Town Council Mtg., 8/6/92 PUBLIC HEARING: TOWN COUNCIL TO CONTINUE A JOINT PUBLIC HEARING WITH THE PLANNING AND ZONING COMMISSION, WHICH PUBLIC HEARING WAS INITIATED JUNE 16, 1992, TO CONSIDER AMENDING THE TOWN'S COMPREHENSIVE ZONING ORDINANCE, ORDINANCE 0 91-01 BY ADDING A NEW SECTION, 15U "MH" HUD -CODE MANUFACTURED HOME/INDUSTRIALIZED HOUSING DISTRICT, TO THE SAID ORDINANCE. Mayor Carter requested Chairman Hamper open the Planning and Zoning Commission Public Hearing. Commissioner Williams made a motion to reconvene the joint public hearing on amending the Comprehensive Zoning Ordinance for the purpose of adding a new section, 15U "MH" Hud -Code Manufactured Home/ Industrialized Housing District. Commissioner Kirby seconded the motion. Motion passed unanimously. Mayor Pro Tem Hill made a motion to reconvene the joint public hearing on amending the Comprehensive Zoning ordinance for the purpose of adding a new section, 15U "MH" Hud -Code Manufactured Home/Industrialized Housing District. Council Member Glaspell seconded; motion passed unanimously. No one wished to address the Council or Planning and Zoning Commission at the joint public hearing. Commissioner Kirby made a motion to close the joint public hearing. Commissioner Williams seconded; motion passed unanimously. Mayor Pro Tem Hill made a motion to close the joint public hearing. Council Member Glaspell seconded the motion. Motion passed unanimously. Commissioner Schaaf made a motion requesting the Town Council adopt an ordinance amending the Town Comprehensive Zoning ordinance as amended by the Planning and Zoning Commission. Commissioner Williams seconded; motion passed unanimously. TOWN COUNCIL TO CONSIDER ADOPTING AN ORDINANCE AMENDING THE TOWN COMPREHENSIVE ZONING ORDINANCE, ORDINANCE 0 91-01, BY ADDING A NEW SECTION, 15U "MH" HUD -CODE MANUFACTURED HOME AND INDUSTRIALIZED HOUSING DISTRICT, AND TAKE APPROPRIATE ACTION Chairman Hamper requested the Town Planner, Mr. Dan Boutwell, to restate the reason for the "MH" district. A discussion period followed Mr. Boutwell's statement. Mrs. Jan Clinkenbeard, Town resident, had a question with regard to carports and the allowance of them in the "MH" district. Mr. Boutwell answered Mrs. Clinkenbeard's concern quoting the portion of the ordinance dealing with carports and the Page 3, Joint Public Hearing/Town Council Mtg., 8/OG/92 requirement that they be enclosed on three sides and be constructed of masonry. After the discussion, Mayor Pro Tem Hill made a motion to adopt the "MH" Hud -Code Manufactured Home/Industrialized Housing District and to amend Ordinance NO. 0 91-01 as recommended by the Planning and Zoning Commission with their amendments. Council Member Moore seconded, motion passed unanimously. Chairman Hamper informed the Council of the upcoming projects of the Commission. They are the rezoning of the entire town and modifying the Comprehensive Zoning Ordinance for simplicity which will make it user friendly. Chairman Hamper invited all Council Members to the Planning and Zoning meeting on August 20, 1992 where rezoning will be discussed. Mr. Boutwell mentioned the new Comprehensive Plan brochures will be ready for the August 20th meeting. Commissioner Schaaf made a motion to adjourn the joint public session and the meeting. Commissioner Kirby seconded; motion passed unanimously. The Town Council adjourned the joint public session with the Town Planning and Zoning Commission. Mayor Carter asked if there was any member of the Town Council who wished to remove the Minutes of the July 21, 1992 Council Meeting from the consent agenda for full discussion. There was no request to remove any item from the consent agenda. Council Member Glaspell made a motion to approve the Minutes of the July 21, 1992 Council Meeting. Mayor Pro Tem Hill seconded, motion passed unanimously. Approved items are as follows: A. Minutes of the July 21, 1992 Council Meeting. PRESENTATIONS BY CITIZENS There were no presentations by citizens. Page 4, Public Hearing/Town Council Mtg., 8/06/92 STAFF AND COMMITTEE REPORTS Town Manager, Donna Welsh, discussed future meeting dates with the Council. The Finance Committee will meet on Thursday, August 13 and there will be a joint workshop with the Council and the Finance Committee on Tuesday, August 18, 1992. Planning and Zoning Commission meeting will be held on August 20, 1992. Mrs. Shaw reported she had talked with Linda Garza, of Gibraltar Savings, FSB, with regard to the Town obtaining or leasing the monument on the east side of Trophy Club Drive. The monument on the west side of Trophy Club Drive belongs to Tom Gaubert. Mrs. Shaw had not spoken with him at this time. PRESENTATIONS BY COUNCIL Mayor Carter commented on the unblemished softball record of the Town Officials at the fourth of July festivities. The Council was informed by the Mayor that the Roanoke Council had turned down the EMS Contract with Trophy Club. Mayor Pro Tem Hill thanked the Town for sponsoring him to the North Central Texas Council of Governments workshop on Municipal Budgets. Council Member Moore mentioned an article in the Grapevine Sun on proposed flood elevation determinations for the Town of Westlake. REPRESENTATIVE FROM SENTRY ENVIRONMENTAL TO ADDRESS COUNCIL REGARDING THE PROPOSED LANDFILL Mayor Carter updated the Council on the proposed landfill to be located in the Town of Northlake, Texas. He then introduced Mr. Warren Huddleston, of Sentry Environmental. Mr. Huddleston addressed the Council regarding his application for a permit to build a landfill in southern Denton County. He then introduced Mr. Ellis Harrington, Engineer for Sentry Environmental and they proceeded to field questions from the Council. TOWN COUNCIL TO CONSIDER A RESOLUTION SUPPORTING THE APPLICATION OF SENTRY ENVIRONMENTAL FOR A TYPE 1 SANITARY LANDFILL FACILITY AND TAKE APPROPRIATE ACTION No action was taken. Page 5, Public Hearing/Town Council Mtg., 8/06/92 MS CATHIE WALSH, PRESIDENT OF C.O.N.T.R.O.L., TO ADDRESS THE COUNCIL CONCERNING THE PROPOSED LANDFILL Ms. Cathie Walsh, President of C.O.N.T.R.O.L., discussed C.O.N.T.R.O.L.'s position with regard to the proposed landfill. She then requested the Town Council to support C.O.N.T.R.O.L.'s position and the. Town to seek party status opposing the application. Mayor Carter requested an explanation of party status. Ms. Walsh explained party status meant becoming a party in the hearing, cross examining witnesses and making a case against the application. TOWN COUNCIL TO CONSIDER ACTION REGARDING PROPOSED LANDFILL Mayor Carter outlined the four possible positions the Council could take: 1. Council can take "no action" which would continue to support C.O.N.T.R.O.L. in the previously approved resolution 2. The Council can rescind the previous resolution supporting C.O.N.T.R.O.L. 3. Send a representative to the hearing in support of C.O.N.T.R.O.L. 4. Request Party Status in opposition at the public hearing After a lengthy discussion, question and answer period, Council Member Glaspell made a motion to have Town staff participate in the public hearing and seek party status if no volunteer from the Town was available and no funds would be expended except for travel cost pending Council approval. Mayor Pro Tem Hill seconded the motion. Motion passed unanimously. TOWN COUNCIL TO CONSIDER RESOLUTION 92-06 APPROVING THE ANNUAL BUDGET AND FINANCIAL PLAN OF THE DENCO AREA 911 DISTRICT AND TAKE APPROPRIATE ACTION The Council reviewed the material provided in their packets regarding the annual budget for Denco Area 911. Mayor Pro Tem Hill made a motion to approve the Denco Area 911 annual budget and financial plan. Council Member Glaspell seconded; motion passed unanimously.
