CALL TO ORDER AND ANNOUNCE A QUORUM. Chairman Hill called the meeting to order at 6:30 pm, and announced a quorum was present. PUBLIC HEARING 2. PLANNING & ZONING COMMISSION TO OPEN PUBLIC HEARING. A motion was made to open the public hearing. PLANNING & ZONING COMMISSION TO CONDUCT A PUBLIC HEARING RELATIVE TO THE FOLLOWING: A. AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS AMENDING ORDINANCE NO. 95-20 OF THE TOWN, THE SAME BEING PD PLANNED DEVELOPMENT #13, EXHIBIT C DEVELOPMENT STANDARDS, BY AMENDING THE OFFICIAL ZONING MAP OF THE TOWN BY CHANGING PD PLANNED DEVELOPMENT #13 FOR RETAIL (INCLUDING A GASOLINE SERVICE STATION) AND COMMERCIAL OFFICE USES IN ORDER TO ALLOW ONLY THE GASOLINE SERVICE STATION TO BE OPEN TO THE PUBLIC AND OPERATED FOR ITS INTENDED PURPOSES AS ALLOWED BY THE TERMS OF PLANNED DEVELOPMENT #13 ON A 24-HOUR, SEVEN DAY PER WEEK BASIS; PROHIBITING THE OPERATION OF THE CAR WASH LOCATED UPON THE TRACT BETWEEN THE HOURS OF 10:00 P.M. AND 7:00 A.M.; PROVIDING THAT SUCH TRACT OF LAND SHALL BE USED IN ACCORDANCE WITH THE REQUIREMENTS OF THE COMPREHENSIVE ZONING ORDINANCE AND ALL OTHER APPLICABLE ORDINANCES OF THE TOWN; PROVIDING GENERAL PROVISIONS; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. (APPLICANT: CARLOS SALINAS, THE DIMENSION GROUP). B. STAFF REPORT Mr. Boutwell stated that he did not have any new comments about the request. The recommendations from the meeting held 1 February 2001 have been completed. C. PRESENTATION BY APPLICANT Mr. Stinson addressed the Commission. He reiterated that 7 -Eleven was asking for this change in order to provide a better service to their customers. Chairman Hill asked if the proposed operating hours for the car wash and external lighting modifications were acceptable to the applicant. Mr. Stinson said that both items were acceptable. Mr. Boutwell suggested that modifications to the external lights be handled through the Department of Public Works. This item will not be part of a contingency in the final motion. 2 Planning & Zoning Public Hearing & Regular Session 15 February 2001 Chairman Hill asked about hours of delivery involving trucks on the site. Mr. Stinson agreed to work with the Commission to reach acceptable times for truck deliveries. No public input was requested. 4. PLANNING & ZONING COMMISSION TO CLOSE PUBLIC HEARING AND/OR CONTINUE TO A DATE CERTAIN. A motion was made to close the public hearing. Motion: Reed Second: Gilliland Ayes: Hill, Ashby, Sheridan, Rodgers, Shegon Nays: None Action: 7-0 Motion carried. 5. PLANNING & ZONING COMMISSION TO CONVENE INTO A REGULAR SESSION. REGULAR SESSION 6. PLANNING & ZONING COMMISSION TO TAKE APPROPRIATE ACTION AND MAKE A RECOMMENDATION TO THE TOWN COUNCIL REGARDING: A. (APPLICANT: CARLOS SALINAS, THE DIMENSION GROUP). B. COMMISSIONER'S DISCUSSION Vice Chairman Gilliland said that he felt a distinction should be made between the smaller and larger delivery trucks. Also, changes made to reduce the intensity of external lights should be included. Commissioner Rodgers said that all of her questions had been answered. She felt it was interesting that the Police Department felt this would benefit them by being able to fuel the squad cars in town, rather than leaving the city limits for Roanoke. She suggested the Commission require the same times for deliveries as is currently outlined in the PD. Commissioner Sheridan said he also found the Police Departments comments interesting. He went on to say that he is positively inclined with all the adjustments made. Commissioner Shegon had no comments or questions. Commissioner Ashby said that he felt it was a good idea to include different hours for truck deliveries. Commissioner Reed said he did not have anything to add. Chairman Hill read an email for the record, sent to Ms. Fleck from Donna Welsh, Town Manager: / wanted to make the P & Z aware of comments I have received regarding businesses in Trophy Club. Over the post couple of years / have had several comments on the gas station at the front entrance. The most common question / receive is why isn't the gas station open 24 hours a day? The 8 to 5 work day is not the normal day anymore. People lead busy life styles and want the convenience of 24 hour a day shopping. A motion was made to recommend approval of the request to amend the ordinance with the following limitations: a. Car wash to operate between the hours of 6:00 am and 11:00 pm 121 Planning & Zoning Public Hearing & Regular Session 15 February 2001 b. Tractor trailer deliveries would be prohibited between the hours of 5:00 pm and 8:00 am b. The lighting on the canopy would be reduced to a level acceptable to the Town staff Motion: Gilliland Second: Rodgers Ayes: Hill, Ashby, Reed, Sheridan, Shegon Nays: None Action: 7-0 Motion carried. This item will be recommended for approval at the 19 March 2001 Town Council meeting. 7. PRESENTATION AND DISCUSSION REGARDING THE PROPOSED CHANGES TO THE COMPREHENSIVE ZONING ORDINANCE NO. 2000-06 P&Z, SECTION 42 - TRANSMITTING AND RECEIVING ANTENNAS AND OTHER ANTENNA FACILITIES (APPLICANT: TOWN OF TROPHY CLUB, PRESENTATION BY DAN BOUTWELL, PLANNING CONSULTANT). A. PRESENTATION Mr. Boutwell gave the Commissioner's an excerpt from the City of Mansfield's wireless facilities plan and ordinance and briefly summarized the information. B. INPUT FROM PUBLIC No public input was requested. C. COMMISSIONER'S DISCUSSION The Commission discussed the proposed changes to the ordinance. 8. Commissioner Shegon asked about the status of the curbs at The Plaza. 10. REPORTS FROM STAFF. Staff had no comments Chairman Hill adjourned the meeting at 8:25 pm.
