REGULAR SESSION 2020-384-T Nomination and Election of Vice-Chairman Chairman Rowe asked for nominations for the Vice-Chairman position on the Planning & Zoning Commission. Commissioner Branum nominated Commissioner Biggs, second by Chairman Rowe. Chairman Rowe called for a showing of hands vote. Chairman Rowe called for a showing of hands vote. The motion passed 7-0 (unanimous). 2020-393-T Case PD-AMD-20-003 (PD-30 Domestic Pet Services) a. Conduct a Public Hearing regarding a request to amend PD Planned Development District No. 30 (PD-30) to add a definition for “Domestic Pet Services” to Section I.D. of the Development Standards and add “Domestic Pet Services (SUP Required)” to Section II.A.6 of the Development Standards, located at the Trophy Club Town Center located on the northeast corner of Trophy Club Drive and SH 114. b. The applicant, Grant Gold with Beck Ventures, 13101 Preston Rd., Dallas, TX gave an explanation of proposed businesses (Dog Groomer and Veterinary Clinic) and the need for inclusion in the Development Standards of PD-30 including PowerPoint slides and examples of similar developments and services. He was available for questions via ZOOM. Public comments heard in favor of the request came from Steve Harvey with PetBar, 6805 Strauss, Colleyville, TX, Thomas Glendenning with Shop Companies, 4809 Cole Ave., Dallas, TX, Mike Pacillio with North American Properties, 4956 N. O’Connor Rd., Irving, TX, and Zack Zaccari with Paragon, 2805 N. Dallas Pkwy., Plano, TX. There were no public comments. Chairman Rowe closed the public hearing at 7:51 p.m. Page 3 of 4 After discussion and clarification about franchise vs. corporate ownership, Chairman Rowe asked Dennis Sheridan, 1 Hillcrest Court, Trophy Club (prior P&Z Chairman) for historical P&Z information about other veterinary services in Trophy Club. Chairman Rowe called for a motion. Commissioner Branum moved to recommend approval of the request to amend the PD Planned Development District No. 30 (PD-30) as written. Commissioner Stevens seconded. Chairman Rowe called for a showing of hands vote. Motion failed 2-5. Vote was as follows: Yea – Commissioners Branum and Stevens. Nay – Chairman Rowe, Vice Chairman Biggs, Commissioners Blake, Gibson, Barbarin. Chairman Rowe said he’s not in favor of medical services so he moved to recommend approval of the proposal with the condition that the definition is revised to not include “medical care” and “medical boarding for veterinary services” as allowed uses. Motion seconded by Vice Chair Biggs. Further discussion focused on the lack of a yard which the applicant argued they do not want, but most of the Commission was still concerned. Chairman Rowe called for a showing of hands vote. The motion passed 6-1. Vote was as follows: Yea – Chairman Rowe, Vice Chairman Biggs, Commissioners Gibson, Blake, Barbarin, and Stevens. Strategic Link: Infrastructure & Development: Foster a business-friendly environment. Background and Explanation: Wingstop is requesting approval of a Specific Use Permit (SUP) for alcoholic beverage sales for on-premises consumption in conjunction with a restaurant use according to Section 14.02.252 of the Town’s Code of Ordinances. The property’s zoning of Planned Development No. 30 (PD-30) does not restrict the sales of alcoholic beverages beyond the regulations of Town Code and State Law. As shown in Exhibit B, Wingstop is applying to the Texas Alcoholic Beverage Commission (TABC) to obtain a Wine and Beer Retailer’s Permit (BG) which will allow for the sale and consumption of wine and beer on the premises. Section 14.02.252(b) of the Code of Ordinances states that no alcoholic beverages may be sold within 300 feet of a church, public school or private school, or public hospital. Subsection (g) describes the methods of measurement as front door to front door and along street front property lines when measuring to churches and public hospitals, and in a direct line from nearest property line to property line when measuring to public schools and private schools. Wingstop complies with Town and State requirements, as the closest church (Fellowship United Methodist Church) is approximately 825 feet away, the closest public school (Lakeview Elementary School) is approximately 1.25 miles away, the closest private school (Primrose School of Westlake at Entrada) is approximately 3,400 feet away, and the closest public hospital (Methodist Southlake Hospital) is approximately 4.25 miles away. The nearby Baylor Scott & White Medical Center – Trophy Club is a private hospital so there are no separation requirements. Parking needs have been addressed by the required on-site parking spaces.
