Strategic Link: Infrastructure & Development – Foster a business-friendly environment. Background and Explanation: Aloft Hotel is requesting approval of a Specific Use Permit (SUP) for alcoholic beverage sales for on-premises consumption in conjunction with a restaurant use according to Section 14.02.252 of the Town’s Code of Ordinances. The property’s zoning of Planned Development No. 30 (PD-30) does not restrict the sales of alcoholic beverages beyond the regulations of Town Code and State Law. As shown in Exhibit B, Aloft is applying to the Texas Alcoholic Beverage Commission (TABC) to obtain a Mixed Beverage Restaurant Permit (RM) and a Mixed Beverage Late Hours Permit (LB) which will allow for the sale and consumption of wine, beer, and liquor on the premises and during late hours (12 midnight – 2 AM). Town Code does not restrict hours of operation beyond TABC’s regulations. Section 14.02.252(b) of the Code of Ordinances states that no alcoholic beverages may be sold within 300 feet of a church, public school or private school, or public hospital. Subsection (g) Page 2 of 2 describes the methods of measurement as front door to front door and along street front property lines when measuring to churches and public hospitals, and in a direct line from nearest property line to property line when measuring to public schools and private schools. Aloft complies with Town and State requirements, as the closest church (Fellowship United Methodist Church) is approximately 1,280 feet away, the closest public school (Lakeview Elementary School) is approximately 1.33 miles away, the closest private school (Primrose School of Westlake at Entrada) is approximately 3,065 feet away, and the closest public hospital (Methodist Southlake Hospital) is approximately 4.25 miles away. The nearby Baylor Scott & White Medical Center – Trophy Club is a private hospital so there are no separation requirements. Parking needs have been addressed by the required on-site parking spaces. The Chief of Police has reviewed this application, as required by Code, and does not have any objections. Notice of a public hearing was distributed as required by State Law. To date, staff has not received any inquiries. Financial Considerations: Not applicable. Legal Review: The Town Attorney has reviewed this item and has no objection. Background and Explanation: Aloft Hotel is requesting approval of a Specific Use Permit (SUP) for alcoholic beverage sales for off-premises consumption so that they may be able to sell wine and beer in the Aloft market, alongside snacks and toiletries, located inside the hotel. As shown in Exhibit B, Aloft is applying to the Texas Alcoholic Beverage Commission (TABC) to obtain a Wine and Beer Retailer’s Off-Premise Permit (BQ) which will allow for the sale of unopened wine and beer to be consumed off-premises. If the Aloft market, specifically, is the only area in the hotel permitted under TABC’s BQ permit, which forbids on-premises consumption where alcohol is sold, then consumption remains legal throughout the rest of the hotel so guests can continue to bring alcoholic beverages of any kind into their hotel rooms, whether the alcohol is bought at the Aloft market or elsewhere. Background and Explanation: Section 3.09.010 of the Town’s Code of Ordinances allows an interested party to make a request for a Meritorious Exception to the Planning & Zoning Commission and Town Council to consider a proposal that is nonconforming to the sign regulations, but may have obvious merit and may make a positive contribution to the visual environment. A request for a Meritorious Exception is necessary for the proposed porte cochere sign at Aloft Hotel because it does not fit into any of the sign categories within the Planned Development No. 30 (PD-30) Development Standards (Section II.H.1), such as freestanding development sign, sloped roof sign, hanging sign, or wall sign. As shown on Exhibits B & C, the 8 foot tall “aloft” channel letters will be welded to steel tubing at the end of the 18.5 foot tall porte cochere with 14 inch tall “HOTELS” channel letters mounted to the base. Exhibit A has a yellow rectangle shown inside the hotel property lines to illustrate that the porte cochere faces northwest toward the Bevan Apartment Homes, and Exhibit D includes photos of the proposed silver metal sign as it stands at other Aloft locations. Strategic Link: Nature & Beautification – Maintain Town assets, services, and codes of ordinances that preserve the natural beauty of the Town. Background and Explanation: The subject property was formerly used as a gas well site (#8-H), but the wells were plugged several years ago. The property owner would now like to develop the property as a single family subdivision consisting of 7 residential lots and 2 HOA lots with a cul-de-sac street dedicated as right-of-way (ROW). The proposed preliminary plat is located in the R-12 Single Family zoning district which requires minimum 12,000 sf lots. It also calls for 25 foot front setbacks, 25 foot rear setbacks, and 10 foot side setbacks (20 feet adjacent to a side street), as well as 90 foot wide lots when measured at the front building line (110 feet adjacent to a side street) and 110 foot deep lots (100 feet for a cul-de-sac or corner lot). The applicant has complied with all of the R-12 requirements. The Aspen Estates HOA will be created and responsible for a masonry screening wall, signage, and landscaping along Trophy Club Drive and the entrance into the subdivision, which will be outlined in the Subdivider’s Agreement. Also included will be language referencing the Parkland Dedication ordinance that requires money paid to the Town in lieu of land due to the small size of the development. Page 2 of 2 The plugged gas well heads are located under the proposed street’s ROW and there is no distance requirement between a plugged (nonproducing) well head and a residence. The applicant has provided documentation from the Railroad Commission of Texas indicating the plugging of the wells in March of 2015. The applicant provided staff with a preliminary drainage plan with lots graded to drain towards the street. The preliminary utility plan proposes an 8 inch water line and an 8 inch sanitary sewer line extending the length of the proposed street and connecting to the existing water and sanitary sewer lines in Trophy Club Drive’s ROW. These preliminary plans have been approved by the Town’s 3rd party engineer, but full civil plans will be required before a final plat is approved. In addition, it still needs to be determined through what entity the utilities will be provided before a final plat can be submitted. Financial Considerations: Not applicable. Legal Review: The Town Attorney has reviewed this item and has no objection. Staff Recommendation: Staff recommends approval of the preliminary plat. Strategic Link: Nature & Beautification – Maintain Town assets, services, and codes or ordinances that preserve the natural beauty of the Town Background and Explanation: Political signs have been a hot topic for the last few years due to state and federal elections. There is cause to update the Town’s Sign Ordinance to keep up with new trends so the proposed amendments include revising the political sign definition to include flags, increasing the duration of time political signs can be displayed, and updating the signage table to reflect the amended duration and add language in the “Maximum Number” column to match the language in subsection 3.09.062(e) of the political signs ordinance. All political signs meeting the requirements of this article, shall only be erected or maintained in a location allowed under this article for a maximum period of ninety (90) sixty (60) days before the signs must be replaced or removed as required by this article. Political signs shall be kept in good repair and proper state of preservation during the entire time that they are erected. Political signs advertising an event, election, function or activity shall be removed within ten (10) three (3) days following the date of such event, election, function or activity.
