Background and Explanation:
Section 3.09.010 of the Town’s Code of Ordinances allows an interested party to make a request for a
Meritorious Exception to the Planning & Zoning Commission and Town Council to consider a proposal that
does not conform to the sign regulations but may have merit and make a positive contribution to the
visual environment. A request for a Meritorious Exception is necessary for the proposed sign at Cooks
Children’s Hospital because it exceeds the sign height prescribed in the Planned Development No. 30 (PD-
30). The PD states that sign shall fit within:
HEIGHT 2 feet, 6 inches (30 inches)
WIDTH 40 feet

Consider and possibly act on a recommendation to the Town Council on a Meritorious Exception for
special purpose signs for the Mother’s Day Art and Garden Festival to be located at Trophy Club Town
Center (PD-30).

Background and Explanation:
The 3rd Annual Trophy Club Women’s Club Mother’s Day Art and Garden Festival is scheduled for May 12-
14, 2023. Mrs. Teryl Flynn submitted a meritorious exception application requesting additional banners
for the event. Section 3.09.065 of the Town’s Code of Ordinances allows only one (1) banner sign, not to
exceed fifty (50) square feet, on the special event site. Applicant is requesting banners at multiple
locations near the festival and throughout town. Section 3.09.101(b) allows an “interested party to
request from town council, upon recommendation by the planning and zoning commission, to hear and
fairly consider a meritorious exception”. A site plan was submitted with the application showing the
locations of potential banners.

Staff would like to discuss the current ordinance 3.09.065 and receive input and direction from the
Commission as to future Special Events regarding signage. Specifically, the number, placement, size, and
duration of signs/banners for future special events.

§3.09.065.Special purpose signs.
Special purpose signs complying with the provisions of this section shall be allowed in
conjunction with special events provided that a special event permit issued pursuant to
article 1.09. of this code has been obtained for the event. Special purpose signs may be
posted for events that are expressly exempt from the requirements of article 1.09 of this
code provided however that all such signs shall comply with the requirements of this
section and other applicable provisions of this article.

(1)Number, size and placement.
(A)Banner signs.One (1) banner, not to exceed fifty (50) square feet, shall be
allowed on the special event site. Placement of the banner shall be subject to
the requirements of the special event permit or the approval of the community
development director when a special event permit is not required. A banner
shall not be strung between trees, but shall be securely attached to a building,
or securely strung between two (2) temporary poles.
(B)Informational and directional signs.Special purpose signs, including without
limitation, directional signs and directional real estate signs, shall only be
allowed for special events pursuant to a special event permit. Except as
specifically allowed for in this section, directional signs shall not be allowed
within the town. In addition to the requirement to obtain a special event
permit, prior to the placement of a special purpose sign, any person or entity
placing such a sign shall also have received authorization or approval for
such placement from the owner of the property upon which such sign is
placed, and shall comply with applicable notification requirements set forth in
this article.
(2)Duration.Special purpose signs authorized by this section in accordance with a
valid special event permit shall be allowed up to fourteen (14) days prior to the
date of the event. All signage shall be removed within twenty-four (24) hours
following the conclusion of the event.

Chairperson Biggs called the January 5, 2023 Planning & Zoning Commission to order at 7:01 PM and announced
a quorum.

Citizens are allowed four (4) minutes to address the Board regarding an item over which the Board has policy or
oversight authority as provided by Texas law, the ethics order, or other policy order.
Chairperson Rowe asked if there were any public requests to speak. No public requests to speak were submitted.
REGULAR SESSION
1. Case SUP-23-001 (Rosati’s Pizza Alcohol On-Premises)
a. Conduct a Public Hearing regarding a request by Rosati’s Pizza Restaurant for a Specific Use
Permit for alcohol beverage sales on-premises consumption in conjunction with a restaurant use,
located at 2210 E. Highway 114 #250.

Chairperson Biggs opened the public hearing at 7:02 PM.
Director Matt Cox presented the staff report and was available for questions. Staff recommends approval. Mr.
Cox advised the Commissioners the applicant was present for questions.
Chairperson Biggs closed the public hearing at 7:05 PM.
Chairperson Biggs asked for discussion or a motion. Commissioner Rowe noticed the TABC application was
check for wine & malt beverage instead of mix beverage. Applicant stated only wine & malt beverage.
Commissioner Branum inquired about the intent of late hours of 12am to 2am. Mr. Cox advised this applicant

intents to match all the other businesses on the premises. Chairperson Biggs asked for future discussion or a
motion. Commissioner Rowe moved to recommend approval, with a second by Commissioner Branum.
Chairperson Biggs called for a vote. The motion passed unanimously 7-0.
2. Take appropriate action regarding the November 16, 2022 Planning and Zoning Commission Meeting
Minutes.
Chairperson Biggs asked for discussion or a motion. Commissioner Rowe moved to recommend approval, with
a second by Commissioner Poole. Chairperson Biggs called for a vote. The motion passed unanimously 7-0 with
the following:
Approved the minutes subject to the amendment discussed to include the four conditions on both the Falcon
Estates and Aspen Estates.
Commissioner Branum decided to abstain his vote since he was absent for that meeting.
3. Receive Town Planner updates on previous cases heard by Commission and active development in
Town.
Director Matt Cox reported Hutchins has approved plans and have started with the project. Advised the
Commissioners staff cannot CO the Cooks project before the shell building is complete.

Chairperson Biggs called for a motion. Commissioner Rowe moved to adjourn the meeting, seconded by
Commissioner Kesterson. Chairperson Biggs called for a vote. The motion was approved unanimously 7-0.
