Background and Explanation:
SUVETO/VO Vets is requesting approval of a Specific Use Permit (SUP) for a “Domestic Pet Services” use
to accommodate a veterinary clinic within Suite 600 of Trophy Club Town Center (see Figure 1). Upon
recommendation from the Planning & Zoning Commission, the Town Council amended Planned
Development District No. 30 (PD 30) in January of 2021 to allow for a new use titled “Domestic Pet
Services” through a Specific Use Permit (SUP). The use as defined in the ordinance as:
“Domestic Pet Services” shall mean a business where dogs, cats, birds, fish, and similar
small animals customarily owned as household pets are groomed, trained or given
medical care, pet accessories and supplies are sold, and medical boarding for veterinarian
services is provided. All services are to be provided in an enclosed building. This use does
not include the retail sale of pets nor services for farm animals.”
VO Vets is proposing to offer the following in the approximate 4,687 square foot corner suite at the
proposed veterinary clinic location:

•In-house Pharmacy
•Pet Food sales and supplies
This land use category, Domestic Pet Services, requires approval of a Specific User Permit (SUP) by the
Planning & Zoning Commission and Town Council. In considering an SUP application respect is to be given
to the appropriateness for items such as health and safety, adequate drainage, noise, lighting, signage,
affect on surrounding area, adequate access, etc.

THE APPLICANT HAS REQUESTED THE PUBLIC HEARING BE CONTINUED AND

official newspaper and notices were mailed to the surrounding property owners.

A. Consider and take appropriate action to make a recommendation to the Town Council regarding
a request for a Final Plat for lots 1-10, Block A, The Willow Estates at Trophy Club (former well site
2H), consisting of 4.208 acres out of the Rosalinda Allen Survey, Abstract No. 17, located west of
Highlands Court, Trophy Club, Denton County, Texas.

Background and Explanation:
The subject property was formerly used as a gas well site. The property owner has applied for a Final Plat
to develop the property as nine (9) residential lots and one (1) open space lot. The Preliminary Plat was
approved by the Planning & Zoning Commission on September 14, 2021 and by Town Council on
September 27, 2021.
The proposed preliminary plat is located in the R-12 zoning district which requires a minimum lot size of
12,000 square feet, minimum 25 foot front and rear setbacks, and 10 foot side setbacks unless the
property is adjacent to a street, in which case a 20 foot side setback is required. Lots are required to be
90 feet wide (110 feet when adjacent to a side street) and 110 feet deep (100 feet for a cul-de-sac lot).
Cul-de-sac streets are limited to 600 feet in overall length as measured from the street centerline of the
intersecting street and the radius point of the cul-de-sac. The proposed cul-de-sac street exceeds 600 feet
and the variance was approved by the Town Council when the Preliminary Plat was approved in 2021.
Variance approval considered the provision of multiple fire hydrants and the number of lots.
A homeowner’s association (HOA) will be created with the filing of the final plat that will maintain any
common elements. At that time, the subdivider will also be required to dedicate fee-in-lieu of parkland.

The applicant submitted preliminary engineering plans and they are in review by the Town Engineer and
the Trophy Club Municipal Utility District No. 1.
The applicant is responsible for verifying the location of the capped wells is not within the buildable area
of any lot. The Town will not issue a building permit for a building that sits above a capped well, per Texas
Railroad Commission regulations. The capped well heads are located within the right-of-way for the
proposed Rose Drive. The Commission has previously directed well heads be illustrated and identification
numbers be included on the construction plans. The locations are identified on the grading plans and staff
has requested the well heads and identification numbers be added to all sheets in the construction set.
Additionally, the gas well sites and associated easements have been abandoned. The applicant has been
informed that the pipelines to the well sites have been removed. Prior questions on other gas well sites
regarding pipelines remaining have activated the requirement of a “pot-holing” note and execution being
added to the construction plans and notification at the preconstruction meeting. “Pot-holing” is the act
of locating subsurface utilities.
The access (Rose Drive) for the subdivision is provided through the existing Highlands Court which will
become a right-of-way. The applicant has submitted the right-of-way document, referenced as a separate
instrument, and the Town Attorney and staff are reviewing documentation. A ten (10) foot utility
easement, for franchise utilities, along both sides of Rose Drive on the Town of Trophy Club land will be
required. Staff has requested the applicant prepare and provide the separate instrument document for
the ten (10) foot utility easement that parallels both sides of Rose Drive. Staff and the Town Attorney will
review content prior to filing the separate instrument.

This item is currently under review by the Town Attorney.
Staff Recommendation:
Staff is recommending approval of The Willow Estates Final Plat.

approval, seconded by Commissioner Kesterson. Chairperson Biggs called for a vote. The motion passed
unanimously 4-0 with the following conditions:
1. Park fees in lieu of land dedication shall be paid prior to filing of the plat;
2. Convey right-of-way easement through Lot 1X, Block H of The Highlands at Trophy Club
Neighborhood 8, Phase 2B from the owner/developer to Town of Trophy Club;
3. Establish a permanent utility easement in Lot 30, Block G of The Highlands at Trophy Club
Neighborhood 8, Phase 2B; and
4. Add “Utility Easement” to the Open Space label on Lot 10.
The applicant is aware of the conditions of Final Plat approval. The Final Plan will not be filed until all
conditions and requirements of Final Plats are satisfactorily completed.
2. Take appropriate action regarding the July 7, 2022 and February 7, 2023 Planning & Zoning
Commission meeting minutes.

Chairperson Biggs asked for discussion or a motion. Commissioner Stevens moved to recommend
approval, seconded by Commissioner Branum. Chairperson Biggs called for a vote. The motion passed
unanimously 5-1 with the following conditions:
Staff recommendations: Subject with the removal of items 5 and 6 and adding item 11.
1. Final plat shall not be filed until Section 10.02.068 (I) of the Town’s Subdivision Ordinance has
been completed and an “Earth Disturbance Permit” (early grading permit) will not be issued until:
2. Final plat shall not be filed until all bonds/securities required have been approved by the Town;
3. Final plat shall not be filed until all developer agreements or subdivision agreements have been
executed and accepted by the Town;
4. Final plat shall not be filed until all fees have been paid, including Park Dedication Fee, per
Section 10.03.010 of the Town’s Subdivision Ordinance;
5. The 15-foot landscape easement on the existing plat shall be abandoned and a new easement
established, and maintenance assigned to The Trophy HOA;
6. The 15-foot rear yard setback shall be removed from the Final Plat;
7. Applicant to provide explanation on why the 6-foot privately maintained wall easement was
removed from the plat;
8. Landscape and perimeter screening plan (six-foot screening wall where lots side/back to a
primary collector or greater) shall be submitted and approved, as outlined in the PD ordinance and
Section 14.02.352 Landscape Regulations of the Town’s Zoning Ordinance, prior to a
preconstruction meeting;
9. Tree preservation and removal application/permit have been completed per Chapter 10,
Division 8. Tree Preservation and Removal of the Town’s Subdivision Ordinance;
10. HOA documents shall be submitted and approved by the Town of Trophy Club prior to a
preconstruction meeting; and
11. NEW CONDITION: The Notes section shall be updated to include the Common Area, Lot 8X
to be owned and maintained by The Trophy HOA.
