02.17.1989 ZBA Minutes MINUTES OF PUBLIC HEARING ZONING BOARD OF ADJUSTMENTS TROPHY CLUB, TEXAS STATE OF TEXAS ) COUNTY OF DENTON ) The Zoning Board of Adjustments for the Town of Trophy Club met for a Special Public Hearing on Friday, February 17th , 1989 at 7:00 P.M. The Public Hearing was held at the Municipal Utility District Building , 100 Municipal Drive, Trophy Club , Texas. The Public Hearing was held within the Town boundaries and was open to the Public . CALL TO ORDER Chairman Hill called the meeting to order at 7:00 P.M. ROLL CALL AND DECLARATION OF QUORUM Gene Hill Chairman Present John Arnott Co-Chairman Present Julia Luellen Member Present Rick Gilliland Member Present Diane Prator Alternate Member Present Declaration of quorum with five (5) members present . BOARD TO REVIEW AND CONSIDER SPECIAL MEETING MINUTES OF MAY 12TH, 1988 AND OCTOBER 12TH, 1988. Member Luellen moved to waive reading of Minutes. Member Arnott seconded the motion. Motion carried unanimously. Chairman Hill made a motion to approve both sets of Minutes as written. Member Arnott seconded the motion. Motion carried unanimously. ZONING BOARD OF ADJUSTMENTS TO CONDUCT A PUBLIC HEARING TO HEAR AND TAKE ACTION ON THE APPLICATION FOR A VARIANCE TO THE COMPREHENSIVE ZONING ORDINANCE REGARDING REAR SETBACK REQUIREMENTS FOR LOT 1420 SECTION 11 , 558 INDIAN CREEK DRIVE. THE APPLICANT HAS REQUESTED A VARIANCE FROM THE FOLLOWING PROVISION OF THE COMPREHENSIVE ZONING ORDINANCE - SECTION 15I TO WIT: R-SECTION 10 AND 11 SINGLE FAMILY DISTRICT REGULATIONS: AREA REGULATION E. DEPTH OF REAR YARD, FEET 25 THE APPLICANT HAS REQUESTED A REDUCTION OF THE DEPTH OF THE REAR YARD TO FOURTEEN FEET ( 14 ' ) . PAGE 2 MINUTES 2-17-89 FINDINGS AND CONCLUSIONS 1 . Planning and Zoning Chairman, Mike Hamper , stated that an error had been made in adopting the Comprehensive Zoning Ordinance. On all pre-existing occupied lots the deed restrictions should apply. 2. Planning and Zoning Chairman, Mike Hamper , also stated the Comprehensive Zoning Ordinance is to be amended to have the same setback requirements as the Deed Restrictions. 3. Adjacent and near vacinity property owners have no objections to the building addition. Member Luellen made a motion to approve the application for variance to build a garage within twenty-five (25) feet from the rear property line. Member Gilliland seconded the motion. Member Arnott made a motion to amend the original motion to include approval of surrounding property owners and the Planning and Zoning Commission will be changing the Zoning Ordinance. Member Luellen and Gilliland excepted the amendment . Chairman Hill called for a vote by roll call on the motion as amended . Diane Prator - in favor of the motion Julia Luellen - in favor of the motion Rick Gilliland - in favor of the motion John Arnott - in favor of the motion Gene Hill - in favor of the motion Motion was approved unanimously.
