09.26.1989 ZBA Minutes MINUTES OF PUBLIC HEARING ZONING BOARD OF ADJUSTMENTS TROPHY CLUB, TEXAS STATE OF TEXAS ) COUNTY OF DENTON ) The Zoning Board of Adjustments for the Town of Trophy Club met for a Special Public Hearing on Tuesday, September 26th , 1989 at 7:00 P.M. The Public Hearing was held at the Municipal Utility District Building , 100 Municipal Drive, Trophy Club , Texas. The Public Hearing was held within the Town boundaries and was open to the Public . CALL TO ORDER Chairman Hill called the meeting to order at 7:08 P.M. ROLL CALL AND DECLARATION OF QUORUM Gene Hill Chairman Present John Arnott Co-Chairman Present Julia Luellen Member Present Pete Reincke Member Present Rick Gilliland Member Present Declaration of quorum with five (5) members present . Also present were members of the Town Staff: John Hill Town Attorney Bill LeGrand Building Inspector Jill Moran Planning and Zoning Administrator Mike Hamper Chairman of P & Z and Plan Review Comm. ZONING BOARD OF ADJUSTMENTS TO CONDUCT A PUBLIC HEARING TO HEAR AND TAKE ACTION ON THE APPLICATION FOR A VARIANCE TO THE COMPREHENSIVE ZONING ORDINANCE REGARDING MASONRY REQUIREMENTS FOR LOT 702 SECTION 9, 12 PIN OAK COURT. THE APPLICANT HAS REQUESTED A VARIANCE FROM THE FOLLOWING PROVISION OF THE COMPREHENSIVE ZONING ORDINANCE - SECTION 28 TO WIT: MASONRY REGULATIONS ALL PRINCIPAL AND ACCESSORY BUILDINGS AND STRUCTURES LOCATED IN EACH OF THE ZONING DISTRICTS HEREIN SHALL BE OF EXTERIOR FIRE RESISTANT CONSTRUCTION HAVING AT LEAST EIGHTY (80) PERCENT OF THE TOTAL EXTERIOR WALLS, EXCLUDING DOORS, WINDOWS AND PORCHES, CONSTRUCTED OF BRICK, STONE OR OTHER MASONRY OR MATERIAL OF EQUAL CHARACTERISTICS IN ACCORDANCE WITH THE TOWN ' S BUILDING CODE AND FIRE CODE. PAGE 2 ZBOA PH 9-26-89 THE APPLICANT HAS REQUESTED A REDUCTION IN THE AMOUNT OF MASONRY CONSTRUCTED FROM EIGHTY (80) PERCENT TO APPROXIMATELY SEVENTY (70) PERCENT. Bill LeGrand , Building Inspector , served a correction notice at the time of framing inspection prior to August 18th , 1989. OBJECTORS Ron B. Cox - 10 Pin Oak Court Mr . Cox strongly objects to the variance request . He felt that it would devaluate his home. This variance request was for a corner lot which is very visible from Trophy Wood Drive, Indian Creek Drive and Pebble Beach Drive. Ralph Grider - 212 Pebble Beach Drive Mr . Grider had no objections to the variance request and felt that the home was very attractive. FINDINGS AND CONCLUSIONS See attached document . Member Arnott made a motion to deny the variance request . Member Luellen seconded the motion. Chairman Hill called for a vote by roll call . Rick Gilliland- in favor of the motion Julia Luellen- in favor of the motion John Arnott- in Favor of the motion Pete Reincke- in favor of the motion Gene Hill- in favor of the motion Motion was approved unanimously.
