02.07.1990 ZBA Minutes MINUTES OF PUBLIC HEARING ZONING BOARD OF ADJUSTMENTS TROPHY CLUB, TEXAS STATE OF TEXAS ) COUNTY OF DENTON ) The Zoning Board of Adjustments for the Town of Trophy Club met for a Public Hearing on Wednesday, February 7th, 1990 at 7 : 00 P.M. The Public Hearing was held at the Municipal Utility District Building, 100 Municipal Drive, Trophy Club, Texas . The Public Hearing was held within the Town boundaries and was open to the Public . CALL TO ORDER Chairman Luellen called the meeting to order at 7 : 00 P.M. ROLL CALL AND DECLARATION OF QUORUM Julia Luellen Chairman Present John Arnott Co-Chairman Present Pete Reincke Member Present Rick Gilliland Member Present Woody Miller Member Present George Knowles Alternate Present George Danforth Alternate Absent Declaration of quorum with five regular members present. Also present were members of the Town Staff: John Hill Town Attorney Mike Hamper Chairman of P & Z and Plan Review Jill Moran Planning and Zoning Administrator ZONING BOARD OF ADJUSTMENTS TO CONDUCT A PUBLIC HEARING TO HEAR AND TAKE ACTION ON THE APPLICATION FOR A VARIANCE TO THE COMPREHENSIVE ZONING ORDINANCE REGARDING REAR SETBACK LINES OF LOT 134 SECTION 2, 123 CARNOUSTIE DRIVE. THE APPLICANT HAS REQUESTED A VARIANCE TO THE FOLLOWING PROVISION OF THE COMPREHENSIVE ZONING ORDINANCE-SECTION 15A, TO WIT: R-SECTIONS 1 AND 2 SINGLE FAMILY DISTRICT REGULATIONS: F. AREA REGULATIONS- DEPTH OF REAR YARD, FEET (GOLF COURSE LOT) 25 THE APPLICANT HAS REQUESTED A REDUCTION OF THE DEPTH OF THE REAR YARD TO EIGHT FEET (8 ' ) . PAGE 2 ZBOA PUBLIC HEARING 2-7-90 Jill Moran, Planning and Zoning Administrator, reported the following: Mr. Schneider applied for a building permit on or about November 27th, 1989 and was told at that time a survey or plot plan would be required in order to receive approval. Plan Review Committee met on December 4th, 1989 and approved Mr. Schneiders ' application with a contingency of him submitting a survey or plot plan and meeting the twenty-five ( 25 ' ) foot rear setback requirement. On January 8th, 1990 Mr. Schneider was again placed on the Plan Review Committee agenda. Mr. Schneiders ' request was to build within eight (8 ' ) feet six (6" ) inches of the rear property line. There is a twenty (20 ' ) utility and drainage easement in his rear yard and being a golf course lot a twenty-five ( 25 ' ) foot setback requirement. The Plan Review Committee denied his application for building permit. Mike Hamper, Chairman of Planning and Zoning Commission and Plan Review Committee, told the ZBOA the reasons stated above were indeed the reasons for denial . Mr. Hamper also stated the Zoning Board of Adjustments is the only group that can grant variances to the Comprehensive Zoning Ordinance therefore the application had to be denied. OBJECTORS None FINDINGS AND CONCLUSIONS See attached document. Member Reincke made a motion to amend the original request to allow for the deck only to cover the existing patio only with a setback of eleven ( 11) feet from the rear property line and allow the spa to be the same height of the deck. Motion died for lack of second. Member Miller made a motion to amend the original request to disallow the Gazebo but allow the wood deck to cover the existing patio only setback eleven ( 11) feet from the rear property line and allow the portable spa set down into the deck if the top of the spa is six (6) to twelve ( 12) inches above the deck. Member Reincke seconded the motion. PAGE 3 ZBOA PUBLIC HEARING 2-7-90 Chairman Luellen called for a vote by roll call . Rick Gilliland in favor of the motion Woody Miller in favor of the motion John Arnott opposed to the motion Pete Reincke in favor of the motion Julia Luellen in favor of the motion Motion carried 4 to 1, with Co-Chairman Arnott opposed. NEW BUSINESS The Board discussed and decided to hold a meeting on March 1st, 1990 at 7 : 00 P.M. to consider approving the Findings and Conclusions and Minutes of this meeting.
