OF THE TOWN OF TROPHY CLUB
ORDER NO. ZBA981102
WHEREAS, the Board of Adjustment held a public hearing on the 2nd day of
November, 1998, to consider an administrative request(the"Applicant"), which seeks a variance
to be given to all properties constructed between March 14, 1996 and October 1, 1997 (as shown
in Exhibit A attached hereto) in the subdivision known as Eagles Ridge, Phase I, that were
allowed a twenty (20) foot rear yard setback when the zoning ordinance called for a twenty-five
(25)rear yard setback.
WHEREAS, the application seeks a variance from the Comprehensive Zoning
Ordinance which requires a twenty-five (25) rear yard setback in the Eagles Ridge Planned
Development, Phase I, an addition to the Town of Trophy Club, Denton County, Texas, as more
specifically described on Exhibit A attached hereto.
WHEREAS, after due consideration and discussion it appears that the granting of such a
variance would not cause adverse effect on the surrounding properties, would not be contrary to
the public interest and, due to special conditions, a literal enforcement would result in
unnecessary hardship, and so that the spirit of the ordinance is observed and substantial justice is
done.
NOW, THEREFORE,BE IT ORDERED BY THE BOARD OF ADJUSTMENT OF
THE TOWN OF TROPHY CLUB,TEXAS:
Section 1. That all of the above premises are found and determined to be true and
correct and are incorporated into the body of this Order as if copied in their entirety.
Section 2. That the request of the Applicant for this Board to grant a variance from
the provisions of the Comprehensive Zoning Ordinance be, and the same is hereby granted.
Section 3. That this Order was passed by a vote of four (4) ayes and no (0) nays of
the Board of Adjustment and is effective as of the 2nd day of November, 1998.
DULY PASSED AND ADOPTED by the Board of Adjustment of the Town of Trophy
Club,Texas, on the 2nd day of November, 1998.
