Order No. ZBA 99-01 ORDER OF THE BOARD OF ADJUSTMENT
OF THE TOWN OF TROPHY CLUB
ORDER NO. ZBA-99-01
WHEREAS, the Board of Adjustment held a public hearing on the 1st day of June, 1999,
to hear a request, from Richard and Cynthia Rose, (the "Applicants") 208 Inverness Drive, more
particularly described as Lot 194, Trophy Club Section 3, Trophy Club, Texas, (the "Property")
seeking a variance to encroach over the rear yard building line for a third garage and to change
the interior required size of a current two-car garage.
WHEREAS, the application seeks a variance from the Comprehensive Zoning
Ordinance (#98-29), Section 16 (R-11 Single Family District Regulations); item F (Area
Regulations) which requires a minimum rear yard depth of 25 feet, and Section 35 (Accessory
Structures); item G (Garage Requirements)to have an interior dimension of 21 feet by 22 feet.
WHEREAS, after conducting the public hearing and receiving and considering the
comments and evidence from all interested persons, the Board of Adjustment, after due
deliberation, voted to deny the variance and now makes and adopts this written Order
confirming the same.
NOW, THEREFORE, BE IT ORDERED BY THE BOARD OF ADJUSTMENT OF THE TOWN
OF TROPHY CLUB, TEXAS:
Section 1. That all of the above premises are found and determined to be true and
correct and are incorporated into the body of this Order as if copied in their entirety.
Section 2. That no special conditions exist with respect to the Property, and there
are therefore no hardships for which a variance should be granted.
Section 3. That according to the Rules of Procedure of the Board of Adjustments a
concurring vote of four(4) members of the Board shall be necessary to grant any variance. The
vote to grant the requested variance was three (3) ayes and two (2) nays.
Section 4. That the request of the Applicants to this Board to grant a variance from
the provisions of the Comprehensive Zoning Ordinance (#98-29) is hereby DENIED.
DULY PASSED AND ADOPTED by the Board of Adjustment of the Town of Trophy
Club, Texas, on the 1st day of June, 1999.
