Order No. ZBA 99-02 ORDER OF THE BOARD OF ADJUSTMENT OF THE TOWN OF TROPHY CLUB, TEXAS ORDER NO. ZBA 99-02 WHEREAS, the Board of Adjustment held a public hearing on the 9th day of September, 1999, to hear a request from Jim Gilbert, Classic Unique Homes, Inc. (the "Applicant"), 206 Phoenix Drive, particularly described as Lot 520, Section 6, Trophy Club Estates, Trophy Club, Texas (the "Property") seeking a variance to build a front entry garage. WHEREAS, in accordance with State Law, the Comprehensive Zoning Ordinance, and the Rules of a Procedure of the Board of Adjustment, notice of public hearing to consider the variance request was properly-provided; and WHEREAS, the applicant seeks a variance from the Comprehensive Zoning Ordinance (#98-29), Section 16 (R-11 Single Family District Regulations); item I (Garage Requirements) to have a front entry garage. WHEREAS, after conducting the public hearing and receiving and considering the comments and evidence from all interested persons, the Board of Adjustment, after due deliberation, voted to deny the variance and makes and adopts this written Order confirming the same. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ADJUSTMENT OF THE TOWN OF TROPHY CLUB, TEXAS: Section 1. That all of the above premises are found and determined to be true and correct and are incorporated into the body of this Order as if copied in their entirety. Section 2. That no special conditions exist with respect to the Property, and there are therefore no hardships for which a variance should be granted. Section 3. That according to the Rules of Procedure of the Board of Adjustments a concurring vote of four(4) members of the Board shall be necessary to grant any variance. The vote to deny the variance was four(4)ayes and zero (0) nays. Section 4. That the request of the applicant to this Board to grant a variance from the provisions of the Comprehensive Zoning Ordinance (#98-29) is hereby DENIED. DULY PASSED AND ADOPTED by the Board of Adjustment of the Town of Trophy Club, Texas, on the 9th day of September, 1999.
