ZONING BOARD OF ADJUSTMENTS
November 2, 1998
The Zoning Board of Adjustments of the Town of Trophy Club,Texas met in a Public Hearing/Regular
Session on November 2, 1998 at 4:00 P.M. in the Board Room, Trophy Club Administration Building,
100 Municipal Drive,Trophy Club,Texas 76262.
BOARD MEMBERS PRESENT:

BOARD MEMBERS ABSENT:

CALL TO ORDER,ROLL CALL AND ANNOUNCE A QUORUM: •
Acting Chairperson Ford called the meeting to order at 4:18 p.m. and announced a quorum.
ORIENTATION REGARDING THE RULES AND REGULATIONS OF ZBA AND THE
RESPONSIBILI HIES OF THE BOARD MEMBERS (Pam Liston):
An orientation was given by Town Attorney,Pam Liston,that addressed the standards in granting a
variance and the requirements of demonstrating and showing a hardship and she explained that the Board
could give a special exception. 75%of total membership must concur to approve a variance.
The Board discussed the Rules of Procedure with Attorney Liston.
DISCUSSION AND APPROPRIATE ACTION REGARDING THE ELECTION OF'OFFICERS:
Chairman: Board Member Unger nominated Pearl Ford for the Chairman position. Board
Member Dayton seconded; following discussion;motion passed unanimously.
Acting Chairman: Board Member Dayton nominated Roger Unger for the Acting Chairman
position. Board Member Ward seconded; following discussion; motion passed unanimously.
Secretary: Board Member Unger nominated Bettye Dayton for the Secretary position.
Board Member Ward seconded; following discussion; motion passed unanimously.
Secretary Designee: Board Member Unger nominated Cathy Morgas for the Secretary Designee
position. Board Member Ward seconded; following discussion; motion passed unanimously.

CALL NEW CASE LIST TO BE HEARD:
1. TO HEAR AN ADMINISTRATIVE REQUEST FOR A VARIANCE TO
BE GIVEN TO ALL PROPERTIES CONSTRUCTED BETWEEN THE
YEARS OF 1996 AND 1997(AS SHOWN IN EXHIBIT A)IN THE
SUBDIVISION KNOWN AS EAGLES RIDGE,PHASE I,THAT WERE
ALLOWED A 20 FOOT REAR YARD SETBACK WHEN THE ZONING
ORDINANCE CALLS FOR A 25 FOOT REAR YARD SETBACK.
The Board's consensus is that there is no need to go from regular session into a public hearing and back
into regular session to take care of this matter.
The administrative request is not intended to be an open-ended decision.
CITIZENS PRESENTATIONS:
No citizens present.
THE ZONING BOARD OF ADJUSTMENTS WILL CONSIDER AND TAKE APPROPRIATE
ACTION REGARDING AN ADMINISTRATIVE REQUEST FOR A VARIANCE TO BE GIVEN
TO ALL PROPERTIES CONSTRUCTED BETWEEN THE YEARS OF 1996 AN 1997(AS
SHOWN IN EDIT A)IN THE SUBDIVISION KNOWN AS EAGLES RIDGE,PHASE I,
THAT WERE ALLOWED FOR A 20 FOOT REAR YARD SETBACK WHEN THE ZONING
ORDINANCE CALLS FOR A 25 FOOT REAR YARD SETBACK:
Board Member Ward moved to grant the administrative variance to be given to all properties constructed
between the years of 1996 and 1997 (as shown in exhibit A)in the subdivision known as Eagles Ridge,
Phase I,that were allowed a 20 foot rear yard setback when the zoning ordinance calls for a 25 foot rear
yard setback. Board Member Unger seconded;motion passed unanimously.
OTHER MATTERS THAT MAY COME BEFORE THE BOARD:
The Board Members discussed possible changes to the"Rules of Procedure."
DISCUSSION AND APPROPRIATE ACTION REGARDING A RECOMMENDATION TO THE
TOWN COUNCIL FOR ALTERNATE BOARD MEMBERS:
Following discussion,no action taken.
REVIEW AND APPROVE MINUTES:
Board Member Unger moved to approve the minutes of December 18, 1997 and June 1, 1998 as
presented. Board Member Dayton seconded;motion passed unanimously.
