06.01.1999 ZBA Minutes MINUTES OF REGULAR SESSION/PUBLIC HEARING TOWN OF TROPHY CLUB ZONING BOARD OF ADJUSTMENTS June 1, 1999 The Zoning Board of Adjustments of the Town of Trophy Club,Texas met in a Regular Session/Public Hearing on June 1, 1999 at 4:00 P.M. in the Board Room,Trophy Club Administration Building, 100 Municipal Drive,Trophy Club,Texas 76262. BOARD MEMBERS PRESENT: Pearl Ford Chairperson Bettye Dayton Board Member Roger Unger Board Member Stuart Herigodt Board Member John Ward Board Member BOARD MEMBERS ABSENT: Player"Bud" Cook Alternate Board Member David Henry Alternate Board Member STAFF AND GUESTS PRESENT: Kristie McPherson Acting Recording Secretary Richard Rose 208 Inverness Dr. Cynthia Rose 208 Inverness Dr. CALL TO ORDER,ROLL CALL AND ANNOUNCE A QUORUM: Chairperson Ford called the meeting to order at 4:03 p.m.took roll call and announced a quorum. CALL NEW CASE LIST TO BE HEARD: 1. To hear a request from the resident residing at 208 Inverness Drive requesting a variance to encroach over rear yard building line for a third garage and to change the interior required size of the current two-car garage. Case No.ZBA 99-01 was read by Chairman Ford. RECESS FROM REGULAR SESSION/OPEN PUBLIC HEARING: Board Member Unger moved to recess the regular session and open the public hearing at 4:04 p.m. Board Member Dayton seconded; motion passed unanimously. 1 ZBA Regular Session/Public Hearing June 1, 1999 ZONING BOARD OF ADJUSTMENT TO HOLD A PUBLIC HEARING RELATIVE TO THE FOLLOWING: 1. To hear a request from the resident residing at 208 Inverness Drive requesting a variance to encroach over rear yard building line for a third garage and to change the interior required size of the current two-car garage. Chairman Ford swore in applicant Richard Rose. Mr.Rose presented his case to the Board. The Board questioned Mr.Rose. Chairman Ford stated the valid conditions necessary to be met to be able to grant a variance. ZONING BOARD OF ADJUSTMENTS TO CLOSE PUBLIC HEARING AND RECONVENE INTO REGULAR SESSION: Board Member Ward moved to close the public hearing and reconvene into regular session at 4:25 p.m. Board Member Dayton seconded; motion passed unanimously. THE ZONING BOARD OF ADJUSTMENTS WILL CONSIDER AND TAKE APPROPRIATE ACTION REGARDING A REQUEST FROM THE RESIDENT RESIDING AT 208 INVERNESS DRIVE REQUESTING A VARIANCE TO ENCROACH OVER THE REAR YARD BUILDING LINE FOR A THIRD GARAGE AND TO CHANGE THE INTERIOR REQUIRED SIZE OF THE CURRENT TWO-CAR GARAGE: Chairman Ford asked the Board for a decision; specifically, did any special condition exist. Board Member Ward moved that a special condition existed. Board Member Herigodt seconded;motion failed.Voting for were Board Members Ford,Ward and Herigodt and voting against was Board Members Unger and Dayton.That was not enough to satisfy the requirements of the Rules of Procedure for the Zoning Board of Adjustment requirement of four(4)votes to uphold the motion. No variance will be granted and an Order stating the Boards decision will be issued within ten (10) days. REVIEW AND APPROVE MINUTES: Board Member Unger moved to approve the minutes of the May 20, 1999 meeting. Board Member Ward seconded;motion passed unanimously. OTHER MATTERS THAT MAY COME BEFORE THE BOARD: Chairman Ford informed the Board that the regularly scheduled meetings would be held quarterly on the first Thursday at 4:00 p.m. She also explained that she would have to speak to the attorney regarding the "Rules" and"vested rights". Removal would be in contradiction to the Comprehensive Zoning Ordinance. 2 ZBA Regular Session/Public Hearing June 1, 1999 ADJOURN: There being no further business, Board Member Ward moved to adjourn at 4:45 p.m. Board Member Dayton seconded; motion passed unanimously.
