transfer of water and wastewater assets to Trophy Club Municipal Utility District No. 1
Town Council Meeting Minutes — August 24, 2026 Page 12
(MUD) and expressed the importance of discussing the matter publicly and clarifying the
Town's position. Town Manager Brandon Wright presented an overview of the history and
status of the asset transfer and the areas of disagreement between the Town and MUD.
Town Manager Wright explained that the Town's position is that the planned
transition involved four separate actions: expansion of the MUD boundaries, consolidation
of the public water systems, conveyance of the Town -owned water and wastewater
assets, and termination of the interlocal agreement (ILA). The Town maintains that the
boundary expansion and regulatory consolidation have occurred, but the asset
conveyance and termination of the ILA have not been completed.
The presentation addressed the parties' differing positions regarding ownership of
the water and wastewater assets, including the Town -owned water tower; the effect of
the TCEQ public water system consolidation; interpretation and termination of the ILA;
and the documents necessary to complete the asset transfer. Town Manager Wright also
discussed the Town's proposed conveyance documents and the ongoing disagreement
regarding preservation of the Town's existing wireless communication leases and
easement rights associated with the water tower.
Council discussed the history of the proposed transfer, ownership, and operation
of the assets; the distinction between regulatory consolidation and the conveyance of
physical property; the Town's existing cellular lease rights and revenues; and the parties'
respective interpretations of the ILA. Council also discussed using the Town's MUD
subcommittee to help resolve outstanding issues once ownership of the existing assets
is acknowledged.
Council affirmed its direction that MUD acknowledge the Town's ownership of the
water and wastewater assets formerly associated with the PID public water system and
the Town's existing communication equipment easements on the water tower and
proceed with the Town -provided water tower warranty deed and ILA amendment to
complete the asset transfer and terminate the ILA.
No formal action was taken on this item.
