Chairman Biggs opened the public hearing at 6:01 p.m. Page 12 of 15 Planning & Zoning Commission Meeting Minutes August 13, 2026 Page | 2 Matt Cox, Director of Community Development, presented the proposed amendment and provided an overview of the existing minimum tree requirements by lot type. He explained that the amendment would establish a minimum of one tree per lot throughout PD-27, consistent with the Town's base zoning ordinance. Mr. Cox summarized public outreach, including the mailing of more than 1,600 public hearing notices. He reported that staff received emails and telephone calls in support and one email in opposition. He also discussed the Highlands at Trophy Club HOA survey initiated by HOA member and resident Jenny Fox, in which 62 percent of the 432 respondents supported reducing the requirement to one tree per lot. Ms. Jenny Fox, 2753 Enfield Drive; Ms. Jennifer Furnish, 2770 Chatswood Drive; Ms. Ashley Mangel, 2406 Mona Vale Road; Ms. Jennifer Falls, 2726 Broadway Drive; and Mr. John Brady, 2517 Ralston Drive, spoke in favor of the proposed ordinance amendment. Written support was received from Mr. Chris Via, Mona Vale Road, and in-person support was received from Mr. John Richard, 2802 Marrickville Drive. Written opposition was received from Ms. Annie Camp, a Highlands resident. Chairman Biggs closed the public hearing at 6:07 p.m. The Commission discussed the effect of mature trees on smaller lots, including excessive shade, loss of grass, overcrowding, root impacts to driveways and sidewalks, visibility of homes, replacement costs, and the need to select tree species appropriate for available planting areas. Staff clarified that the amendment would reduce only the minimum requirement and would not require homeowners to remove existing trees. Commissioner Poole moved to recommend approval of Case PD-AMD-26-003 - PD-27 Landscape as presented. Commissioner Holmes seconded the motion. Vote on Motion: AYES: Poole, Branum, Barbarin, Kesterson, Holmes, Biggs NAYES: None VOTE: 6-0 2. CASE RP-26-001 - Triple Crown Estates Replat Conduct a public hearing and consider a recommendation to the Town Council on a request by Moda Homes, LLC to approve a replat of Lots 1–6, 7X, and 8X, Block A, Triple Crown Estates, being a 2.992-acre tract of land situated in the Mary Medlin Survey, Abstract No. 832, Town of Trophy Club, Denton County, Texas 76262, and to approve an ordinance abandoning the public street right-of-way for Triple Crown Page 13 of 15 Planning & Zoning Commission Meeting Minutes August 13, 2026 Page | 3 Drive to establish a private street and public utility, drainage, and emergency access easement serving the subdivision. Chairman Biggs opened the public hearing at 6:29 p.m. Matt Cox, Director of Community Development, presented the revised replat and explained that the primary change from the previously approved final plat was the conversion of the public right-of-way to a private street. He stated that public hearing notice was published and mailed to property owners within 200 feet and that staff received no responses in support or opposition. Staff recommended approval. Hector Alva, co-owner of Moda Homes LLC, addressed the Commission and answered questions regarding the proposed private street, entry gate, vehicle stacking area, construction standards, and the future homeowners association. He explained that the gate would be located approximately 30 feet inside the street, providing space for two vehicles to stack before entering, and that the street would be constructed and inspected to standards comparable to a public street. Chairman Biggs closed the public hearing at 6:32 p.m. The Commission discussed the transfer of responsibility for maintenance, repairs, paving, weather-related conditions, and other costs from the Town to the homeowner’s association. Discussion included the need for appropriate HOA documents, reserves, assessments, disclosure of potential expenses to future buyers, and the Town's continued access for public utilities and emergency services through the proposed easements. Mr. Alva stated that HOA documents and restrictions would be completed before homes were sold and that buyers would receive information regarding regular expenses and potential special assessments. Staff noted that the plat identifies the street as HOA- owned and maintained and provides that costs incurred by the Town for work on the private street may be charged to the HOA. Following discussion, Vice Chair Mike Branum moved to recommend approval of Case- 26-001 - Triple Crown Estates Replat with the HOA language included. Commissioner Kesterson seconded the motion.
