RESOLUTION NO. 2001-08
A RESOLUTION OF THE TOWN COUNCIL, OF THE TOWN OF TROPHY
CLUB, TEXAS, SUPPORTING HOUSE BILL 3400 ALLOWING CITIZENS
RESIDING IN TOWNS WITHIN THE BOUNDARIES OF MORE THAN ONE
COUNTY WITH A POPULATION GREATER THAN 4,800, BUT LESS THAN
9,000, THE RIGHT TO VOTE IN A LOCAL OPTION ELECTION; SUBMITTING
A COPY OF THIS SUPPORTING RESOLUTION TO THE HOUSE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Texas Constitution mandates that the legislature enact laws authorizing
local option elections in all towns for the purpose of allowing citizens to vote on local option
issues,
WHEREAS, current provisions of the Texas Alcoholic Beverage Commission
effectively impede this right by prohibiting citizens of a town located within more than one
county from participating in such an election, thereby prohibiting the citizens of the Town of
Trophy Club from exercising their right to vote on this issue,
WHEREAS, the Town Council previously passed Resolution 1999-31, indicating its
support of the right of the citizens of the Town to vote in a local option election in order to
determine whether the sale of alcoholic beverages will be allowed or prohibited within the Town,
WHEREAS, the Texas legislature is currently considering House Bill 3400, which
would allow citizens living in Towns located within the boundaries of more than one county with
a population greater than 4,800, but less than 9,000, the right to vote in a local option election;
and
WHEREAS, the Town Council deems it significant that the citizens of the Town be
allowed to vote on matters such as this that affect their Town.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
Section 1. That the Town of Trophy Club, Texas, supports the passage of HB 3400,
allowing citizens who live in towns located within the boundaries of more than one county with a
population greater than 4,800, but less than 9,000, the right to hold a local option election and
express their opinion through the voting process;
Section 2. That a copy of this resolution shall be transmitted to the office of House
Representative Mary Denny, encouraging the passage of this House Bill, and
Section 3. That this Resolution shall become effective from and after its date of
passage in accordance with law.
