RESOLUTION NO. 2001-28
A RESOLUTION OF THE TOWN OF TROPHY CLUB, TEXAS, AUTHORIZING
THE TOWN MANAGER TO ENTER INTO NEGOTIATIONS WITH TROPHY
CLUB MUNICIPAL UTILITY DISTRICT NO. 1, TROPHY CLUB MUNICIPAL
UTILITY DISTRICT NO. 2, AND THE TOWN OF WESTLAKE FOR THE
PURPOSE OF ENTERING INTO A NEW INTERLOCAL AGREEMENT TO
JOINTLY PROVIDE GOVERNMENTAL FUNCTIONS AND SERVICES
RELATING TO POLICE PROTECTION, MUNICIPAL COURT SERVICES, FIRE
PROTECTION, AND EMERGENCY MEDICAL SERVICES IN A TROPHY
CLUB/WESTLAKE DEPARTMENT OF PUBLIC SAFETY; PROVIDING THAT
THE GOAL IS FOR THE PARTIES TO TIMELY COMPLETE NEGOTIATIONS
AND RECEIVE APPROVAL OF THE AGREEMENT BY THE GOVERNING
BODIES OF EACH OF THE OTHER RESPECTIVE PARTIES SO THAT THE
AGREEMENT MAY TAKE EFFECT ON JANUARY 1, 2002; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, Chapter 791 of the Texas Government Code authorizes municipalities to
contract with other governmental entities for the performance of governmental functions and
services; and
WHEREAS, Effective October 1, 1999, the Town of Trophy Club, Texas ("Town"),
Trophy Club Municipal Utility District No. 1 ("TCMUDI"), Trophy Club Municipal Utility
District No. 2 ("TCMUD2"), and the Town of Westlake ("Westlake"), entered into an Interlocal
Agreement to provide governmental functions and services relating to police protection,
municipal court services, fire protection, and emergency medical services in a Trophy
Club/Westlake Department of Public Safety ("Agreement");
WHEREAS, per the terms of the Agreement, the costs associated with the services
provided by the Department of Public Safety ("DPS") were to be allocated in accordance with the
methodology outlined in Exhibit "C" to the Agreement and the initial term of the Agreement was
for a period of five (5) years;
WHEREAS, during the first two (2) years of the contract term, the parties agreed that the
methodology for distributing costs between them was an acceptable mamier of distributing such
costs; however, based upon the current fiscal impact of that methodology, the parties now agree
that the terms of the Agreement should be reviewed and amended to identify a new methodology
for allocating costs between the parties; and
WHEREAS, the parties agree that their best interests would be served by negotiating a
new Interlocal Agreement for DPS services that would become effective on January 1, 2002,
subject to approval by the governing body for each of the respective parties.
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
Section !. That the Town Manager is hereby directed to enter negotiations with
authorized representatives from each of the other parties to the existing Interlocal Cooperation
Agreement for the Trophy Club/Westlake Department of Public Safety.
Section 2. That the Town agrees to use best reasonable efforts to timely complete such
negotiations so that a new agreement for DPS services is submitted for the approval of the
governing bodies for each of the parties to the existing Agreement within a time frame to allow
the new agreement to take effect on January 1, 2002.
Sec/ion 3. The Town is committed to completing negotiations so that a new agreement for
DPS services takes effect on January 1, 2002. However, in the event that a new agreement is not
approved by the respective governing bodies of each of the parties to the existing Agreement in a
time frame to allow the new agreement to take effect on January 1, 2002, the existing Agreement
shall remain in full force and effect until such time as a newly negotiated agreement is approved
by the respective governing bodies for each of those parties.
Section 3. That this resolution shall become effective from and after its date of passage in
accordance with law.
PASSED AND APPROVED by the Town Council of the Town of Trophy Club, Texas,
on this the 5°i day of November, 2001.
