RES 2007-06TOWN OF TROPHY CLUB, TEXAS RESOLUTION NO. b7 - Db DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE COMBINATION TAX AND REVENUE CERTIFICATES OF OBLIGATION SERIES 2007; AND PROVIDING AN EFFECTIVE DATE TEIX STATE OF mXAS COUNTY OF DENTON TOWN OF TROPHY CLUB WHEREAS, the City Council deems it advisable to give notice of intention to issue Combination Tax and Revenue Certificates of Obligation, in the amount of $474,000 for paying all or a portion of the Town's contractual obligations for the purpose of constructing and improving the Town's Harmony Park and its improvements, and for paying legal, fiscd, and engineering fees in connection with such project; and WHEmAS, it is hereby officially found and determined that the meeting at which this Resolution was passed, was open to the public and public notice of the time, place, and purpose of said meeting was given, all as required by Chapter 55 1, Texas Government Code. TEEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB: Section 1. That attached hereto is a form of the Notice of Intention to issue Certificates of Obligation, the form and substance of which is hereby adopted and approved. Section 2. That the Town Secretary shall cause said notice to be published in substantially the form attached hereto, in a newspaper of general circulation in said Town, and published in said Town, on the same day in each of two consecutive weeks, the date of the fist publication thereof to be at least 14 days prior to the time set for the issuance of such certificates of obligation as shown in said notice. .Section 3. Adams, Town ~ttome~ Town of Trophy Club, Texas NOTICE OF INTENTION TO ISSUE COMBINATION TAX AND REVENUE CERTIF'ICATES OF OBLIGATION, SERIES 2007 The Town of Trophy Club does hereby give notice of intention to issue Combination Tax and Revenue Certificates of Obligation, Series 2007, in the maximum principal amount not to exceed $474,000, for paying all or a portion of the Town's contractual obligations for the purpose of constructing and improving the Town's Harmony Park and its improvements, and for paying legal, fiscal, and engineering fees in connection with such project. The Town proposes to provide for the payment of such Certificates of Obligation fiom the levy and collection of ad valorem taxes in the Town as provided by law, and from a pIedge of limited surplus revenues of the Town's Harmony Park, Splash Park Water Pool, remaining after payment of all operation and maintenance expenses thereof, and all debt service, reserve, and other requirements in connection with any of the Town's revenue bonds or other obligations (now or hereafter outstanding), which are payable from a11 or any part of theNet Revenues of the Town's Harmony Park, SpIash Park Water Pool. The Town Council intends to consider for passage an Ordinance authorizing the issuance ofTown ofTrophy Club, Texas Combination Tax and Revenue Certificates of Obligation, Series 2007, at a ReguIar Meeting to be held at 7:00 P.M. on May 7,2007 at the Town Hall, Town of Trophy Club, Texas. TOWNOF TROPHY CLUB - We, the undersigned officers of said TOMTI, hereby certify -as follows: 1. The Town Council of said Town convened in REGULAR MEETING ON THE 2ND DAY OF APW, 2007, at the Town Hall, and the roll was called of the duly constituted officers and l~lembers of said Town Council, to-wit: Carl Nick Sanders, Mayor Pamela Cates Susan Edstrom Greg Lamont Philip Sterling Roger Williams Lisa Ramsey, Town Secretary and all of said persons were present, except the foUowing absentees: thus constituting a quorum. Whereupon, among other business, the following was transacted at said Meeting: a written RESOLUTION NO. DJRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE COMBINATION TAX AND REVENUE CERTIFICATES OF OBLIGATION SERIES 2007 was duly introduced for the consideration of said Town Council and read in fhll. It was then duly moved and seconded that said Resolution be passed; and, after due discussion, said motion carrying with it the passage of said Resolution, prevailed and wried by the following vote: AYES: All members of said Town Council shown present above voted "Aye". NOES: None. 3 . That a true, full and correct copy of the aforesaid Resolution passed at the Meeting described in the above and foregoing paragraph is attached to and follows this Certificate; that said Resolution has been duly recorded in said Town Council's minutes of said Meeting; that the above and foregoing paragraph is a true, full and correct excerpt from said Town Council's minutes of said Meeting pertaining to the passage of said Resolution; that the persons named in the above and foregoing paragraph are the duly chosen, qualified and acting officers and members of said Town Council as indicated therein; that each of the officers and members of said Town Council was duly and sufFiciently notified officially and personally, in advance, of the time, place and purpose of the aforesaid Meeting, and that said Resolution would be introduced and considered for passage at said Meeting, and each of said oficers and members consented, in advance, to the holding of said Meeting for such purpose, and that said Meeting was open to the public and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 55 1, Texas Government Code. 3. That the Mayor of said Town has approved and hereby approves the aforesaid Resolution; that the Mayor and the Town Secretary of said Town have duly signed said Resolution; and that the Mayor and the Town Secretary of said Town hereby declare that their signing of this Certificate shall constitute the signing of the attached and following copy of said Resolution for all purposes.
