Public Services Conference Room CALL TO ORDER, ROLL CALL, AND ANNOUNCE A QUORUM Chairman Robert Radder called to order the Zoning Board of Adjustment meeting for Tuesday, March 17, 2015, at 4:00 p.m. and announced that a quorum (7 members) were present. He explained the order of the meeting to those present. Present: 5 - Chairman Robert Radder, Board Member Biggs, Board Member Boomsma, Board Member Opipare, Board Member Hennig, Alternate Board Member Beach, Alternate Board Member Vogt Absent: 2 - Alternate Board Member Arnott, Alternate Board Member Barber STAFF AND GUEST(S) PRESENT: Ron Ruthven Interim Town Planner Robbie Killingsworth Ryan Dealey, Applicant Kevin McCollough Greg Lamont Philip Shoffner Dennis Sheridan REGULAR SESSION Recording Secretary Ashton Woods Homes Applicant, 344 Dover Lane, Trophy Club, TX. Mayor Pro Tem, Place 5 Town Council Member, Place 6 Planning and Zoning Chairman 2015-0189-T Consider and take appropriate action regarding a request for a Special Exception to Chapter 13 -Comprehensive Zoning Ordinance, Article 7, Section 7.01(C)3, regarding the construction of a parallel fence, being located at 651 Indian Creek Drive, Trophy Club, TX. Motion made by Board Member Boomsma, seconded by Board Member Henning, to approve a request for a Special Exception subject to the following conditions: [1] Maintenance of all nuisances, including vegetation, within the gap area shall be the responsibility of the subject property owner. [2] A gate shall be built into the fence allowing access for maintenance purposes to the gap area. The owner of the masonry fence shall have access to said gate for any needed fence maintenance. [3] Rock material shall be added to the gap area such that growth from grass and weeds within the gap area is kept to a minimum. The vote carried by the following vote: Aye: 4 Chairman Radder, Board Member Biggs, Board Member Boomsma, Board Member Hennig Against: 1 Board Member Opipare Special Exception GRANTED Action is final. 2015-0190-T Consider and take appropriate action regarding a request for a Special Exception to, Chapter 13 -Comprehensive Zoning Ordinance, Article 7, Section 7.01(C)1 — regarding the construction of a fence and gate along the front elevation of the primary structure, being located at 344 Dover Lane, Trophy Club, TX. Motion made by Board Member Opipare, seconded by Board Member Henning, to approve a request for a Special Exception as presented. Motion passed unanimously. Special Exception GRANTED Action is final. ADJOURN Motion made by Board Member Opipare, seconded by Board Member Biggs, to adjourn. Motion carried unanimously.
