ZBA-12-09 REQUEST Larry and Elaine Hoover, 1118 Berkshire Ct., are requesting a varianceto build an “attached” pergola in the rear of their property. The application and explanation received from the Hoover’s are attached. PERGOLA DEFINED The Town of Trophy Club Code of Ordinances, Chapter 1-Administration, Article VIII- Schedule of Fees, Section 8.02-Building Definitions, defines an “Open Air Structure” as: Open Air Structures : An accessory structure detached from and incidental to the principal building, madeof wood or masonry construction. This structure is open on the sides and may or may not provideshading. This includes structures such as, but not necessarily limited to, cabanas, pergolas, arbors,gazebos, pavilions, etc. The Zoning Ordinance further defines a “Pergola” (Chapter 13-Zoning, Article II- Definitions, Section 2.02-General Definitions, A. 143.) as: Pergola :A shaded walk or passageway of columns that support cross beams and an open lattice, uponwhich woody vines are grown. The following page shows examples of attached and detached pergolas. Zoning Board of AdjustmentPage 10 of 29Meeting Date: September 18, 2012 Zoning Board of AdjustmentPage 11 of 29Meeting Date: September 18, 2012 STAFF REVIEW A pergola is an accessory structure that cannot exceed one story in height, the maximum height of one story not to exceed twenty feet (20’), except for storage/utility structures which shall not exceed eight feet (8’) in height” (Chapter 13-Zoning, Article V- Supplementary District Regulations, Section 5.03-Accessory Structures and Uses, A.e.ii.)A pergola is excluded from masonry requirements (F. Design Criteria): “The exterior surfaces of all accessory structures shall be consistent with the regulations as specified by the applicable zoning district. However, accessory structures that are normally constructed in such a manner that masonry exterior surfaces are neither practical nor appropriate are excluded from the masonry requirements, including but not limited to gym sets, playhouses, greenhouses, pergolas, arbors, and outdoor kitchens.” The Hoover’s property at 1118 Berkshire Ct. is zoned “R-11” which is defined as; “Single Family Residential District: A zone designed to accommodate single family development on lots that are a minimum of 11,000 square feet in area.” In a residentiallyzoned district, an accessory structure such as a pergola can be either “attached’ to the primary structureor “detached”. Different regulations apply. A detached pergola can be as close as 6-ft. from a property line, but an attached structure is considered “part of the primary structure for calculating total square feet under roof and shall comply with the setback lines established for that zoning district”. (Chapter 13-Zoning, Article V-Supplementary District Regulations, Section 5.03-Accessory Structures and Uses, D. Location.) The Hoover’s would like to attach an approximately 20-ft. wide pergola to the rear of the house. The rafters would extend out approximately 12-ft., with two 6x6 cedar posts supporting the rafters. In R-11 zoning, the rear setback is 25-ft. The 6x6 cedar posts will encroach 1.5-ft. into the 25-ft. rear setback. The Hoover’s are requesting a variance to allow the 1.5-ft. encroachment. On the following page, Picture 1 shows the rearyard at 1118 Berkshire Ct. Awalkway, which the Hoover’s wish to coverwith a pergola, is located near the lamppost on the right side of the picture. Picture 2 is taken at the lamppost and shows a small retaining wall that was built to help control drainage along the rear of the property and help control and maintain the sodded area of the yard. Picture 3 and 4 show the walkway over which the pergola would be constructed if the variance request is approved. This will place the posts on the walkway, up against the small retaining wall. The eave (projecting overhang at the edge of the pergola) will extendan additional (approximately) 2-ft. An extension of an eave past the setback line is allowed by Town ordinance. If the posts are placed at 25-ft. from the rear lot line as required by ordinance, the posts will sit 1.5-ft. away from the small retaining wall, closer to the house,in the walkway. Summary : The applicant is requesting a variance to allow encroachment into the rear setbackof 1.5-ft. to construct an attached pergola. The Zoning Board of Adjustment has the authority to consider and act upon a request for variance if: 1.The request is not contrary to public interest. 2.The spirit of the ordinance is observed. 3.Substantial justice is done. 4.Unnecessary hardship would occur. When reviewing a request for variance, the Board shall consider the following: 1.May not be financial alone. 2.May not be self-imposed. 3.May not provide a privilege that others have been denied. 4.May not deny a privilege that others have been granted. Staff review of this request found evidence of a hardship in that the slope of the rear yard at one time created a drainage problem which the applicant effectively mitigated by adding small retaining walls around the rear yard without encroaching into the 10-ft. drainage easement along the rear of the property.Keeping the pergola posts snug against the retaining wall would allow the sodded yard area and drainage of the property to remain undisturbed while creating a stable base for the posts of the pergola which would be drilled and anchored through the walkway. Keeping the posts up against the retaining wall with adults and children passing on only one side of the posts would create a clearer walkway than if the posts were 1.5-ft. closer to the house. PROPERTY OWNER NOTIFICATION/PUBLIC HEARING : As required by ordinance, notice of public hearing was published in the local newspaper to meet the requirement that publication must be made at least ten (10) days prior to this hearing. The Notice of Public Hearing was published in the September 5, 2012 Trophy Club newspaper. In addition, property owners within 200-ft. of 1118 Berkshire Ct. were notified of this request for variance. Twenty-six property owners were notified and no opposed responses were received; one responsein support was received, a copy of which is included in this packet.
