Chief Kniffen opened the floor for nominations for Chair, Vice Chair and Secretary. Susan Edstrom was nominated for Chair. Tony Simmons was nominated for Vice Chair. Kelly Akin was nominated for Secretary. No other nominations were offered and Dr. Fusselman moved for nominations to cease. Tony Simmons seconded the motion and the vote was unanimous. The vote was held for Chair and Susan Edstrom was elected Chair of the Shelter Board. Chief Kniffen turned the meeting over to Chairperson Edstrom. Nominations for Vice Chair were called and Tony Simmons was nominated. There were no further nominations and the vote to name him Vice Chair was unanimous. 2.Discuss and take appropriate action on animal shelter inspection. Kelly Akin briefed the Board on the inspection of the shelter that is required annually, including those segments of the inspection document that do not apply to the Town facility. The Board and visitors toured the facility and Kelly Akin provided information regarding the shelter and responded to questions about the facility. Upon completion of the tour, Tony Simmons moved to have Kelly Akin arrange for an inspection of the shelter facility within the next 15 days. Dr. Fusselman seconded the motion and the vote was unanimous. 3.Discuss and take appropriate action on new business and scheduling of next board meeting. Chairperson Edstrom noted that the Council had directed the Board to take up the issue of animal registration fees and stated that she would work with the Town Attorney to draft an agenda item that would encompass all the issues related to registration of animals in Trophy Club. Chief Kniffen provided background information on the current ordinance and the efforts to expand the registration from a one-time fee to annually. Kelly Akin provided the reasoning for the discussion of the ordinance. Chairperson Edstrom provided explanation for the discussion on the ordinance and the uses of funds provided by the registration fees. Ms. Owens stated that she is actively involved with domestic pets as owner of a local pet-sitting company. She discussed her concerns regarding the Town’s lack of a volunteer program, the need to increase adoptions and a desire to create a foster program. She stated she would also like to see Trophy Club put a Trap-Neuter-Release program into place to combat the growing number of feral cats in the Town. The Board interviewed Ms. Felton for the Board’s Town resident member position. Ms. Felton stated that she is a biology major and employed by the University of North Texas. She stated she didn’t like the ‘prison look’ or atmosphere of shelters she had previously visited and would like to see the Trophy Club shelter apply a ‘spa or retreat feel’ to its holding facility instead. She would also like to see Trophy Club implement a Trap-Neuter-Release program such as the one operated at UNT. She discussed her interest in wildlife preservation and desire to develop programs to educate the public with emphasis on co-existing with native animal species. 3.Consider and take appropriate action regarding Board applicant Melissa Burns. The Board interviewed Ms. Burns for the Board’s Town resident member position. Ms. Burns stated that she is an attorney with previous experience working with her own terminally ill dogs. She stated that she is unfamiliar with the operations at the Trophy Club animal shelter, but expressed a genuine interest and willingness to learn more about the facility, its needs and the importance of the role each board member assumes in order to ensure its success. After all applicants were dismissed, the Board discussed each applicant’s interview and question and answer sessions to consider and select the applicant to be appointed to serve in the capacity of the Animal Shelter Board’s Town resident member. The motion was seconded by Vice Chair Simmons and approved unanimously. 2.Discuss and take appropriate action regarding the Animal Shelter Inspection Report and remaining action items to bring shelter into compliance. Kelly Akin discussed minor updates and improvements that were made to the shelter suggested by Dr. Fusselman following his previous inspection, including the purchase of a chain-linked gate entrance to be installed in the near future. 3.Discuss and take appropriate action regarding the new ordinance for staggered Board positions. Staff Liaison, Chief Kniffen’s update provided by Town Secretary, Tammy Ard outlining the amendment of Section 3 of Article II, entitled “Animal Shelter Advisory Board” and Chapter 2 entitled “Animal Control” of the Code of Ordinances so that members of the Trophy Club Animal Shelter Advisory Board serve three (3) year terms each, initially staggered for one, two and three year terms during implementation of staggered terms commencing October 1, 2014 and thereafter, each term for three years. 4.Discuss and take appropriate action regarding a revised Schedule of Fees for the Animal Shelter for recommendation to Council. The Board discussed the current Schedule of Fees including modifying the current registration fee, adding a fee for adoptions and implementing a microchip program to be provided to Council for their review and consideration. Chairmain Edstrom motioned to create a subcommittee comprised of herself and board member, Melissa Burns to assist ACO Akin in reviewing current registration fees in neighboring municipalities for direction in modifying the existing Town registration fees. The motion was approved unanimously. 5.ACO’s update regarding the following; discussion and provide input regarding same. *PetFest *Animals taken into shelter and disposition. ACO Akin discussed the upcoming event and the pet-friendly educational materials and gift bag ideas for pets and small children that would be available at the animal shelter booth/tent area. Board member Danielle Stewart offered suggestions for the gift bags that her foundation has used in past events. Chairman Edstrom proposed utilizing volunteers to assemble gift bags for the upcoming event. ACO Akin presented the current intake numbers and dispositions for the shelter during the past year. Dr. Fusselman inquired about other possible locations to place the shelter including an area near the dog park. Chairman Edstrom would like the shelter in close proximity to the police department. Chief Arata would like the addition of volunteers added to Chairman Edstrom’s presentation to Council. 2.Discuss and take appropriate action regarding a proposed ordinance change for recommendation to Council. The Board briefly discussed the current Animal Ordinance as it pertains to ‘fowl’ and what recommendations in regards to amending and/or modifying the existing ordinance might be brought to Council at a future meeting. TREATMENT OF ANIMALS Sec. 821.001. DEFINITION. In this subchapter, "animal" includes every living nonhuman creature. SUBCHAPTER D. UNLAWFUL RESTRAINT OF DOG Sec. 821.076. DEFINITIONS. In this subchapter: (1) "Collar" means any collar constructed of nylon, leather, or similar material, specifically designed to be used for a dog. (2) "Owner" means a person who owns or has custody or control of a dog. (3) "Properly fitted" means, with respect to a collar, a collar that measures the circumference of a dog's neck plus at least one inch. (4) "Restraint" means a chain, rope, tether, leash, cable, or other device that attaches a dog to a stationary object or trolley system. Added by Acts 2007, 80th Leg., R.S., Ch. 674 (H.B. 1411), Sec. 1, eff. September 1, 2007. Sec. 821.077. UNLAWFUL RESTRAINT OF DOG. (a) An owner may not leave a dog outside and unattended by use of a restraint that unreasonably limits the dog's movement: (1) between the hours of 10 p.m. and 6 a.m.; (2) within 500 feet of the premises of a school; or (3) in the case of extreme weather conditions, including conditions in which: (A) the actual or effective outdoor temperature is below 32 degrees Fahrenheit; (B) a heat advisory has been issued by a local or state authority or jurisdiction; or (C) a hurricane, tropical storm, or tornado warning has been issued for the jurisdiction by the National Weather Service. (b) In this section, a restraint unreasonably limits a dog's movement if the restraint: (1) uses a collar that is pinch-type, prong-type, or choke-type or that is not properly fitted to the dog; (2) is a length shorter than the greater of: Animal Shelter BoardPage 27 of 45Meeting Date: Tuesday, June 21, 2016 (A) five times the length of the dog, as measured from the tip of the dog's nose to the base of the dog's tail; or (B) 10 feet; (3) is in an unsafe condition; or (4) causes injury to the dog. Section 821.077 does not apply to: (1) a dog restrained to a running line, pulley, or trolley system and that is not restrained to the running line, pulley, or trolley system by means of a pinch-type, prong-type, choke-type, or improperly fitted collar; (2) a dog restrained in compliance with the requirements of a camping or recreational area as defined by a federal, state, or local authority or jurisdiction; (3) a dog restrained for a reasonable period, not to exceed three hours in a 24-hour period, and no longer than is necessary for the owner to complete a temporary task that requires the dog to be restrained; (4) a dog restrained while the owner is engaged in, or actively training for, an activity that is conducted pursuant to a valid license issued by this state if the activity for which the license is issued is associated with the use or presence of a dog; (5) a dog restrained while the owner is engaged in conduct directly related to the business of shepherding or herding cattle or livestock; or (6) a dog restrained while the owner is engaged in conduct directly related to the business of cultivating agricultural products, if the restraint is reasonably necessary for the safety of the dog. (b) A peace officer or animal control officer who has probable cause to believe that an owner is violating this subchapter shall provide the owner with a written statement of that fact. The statement must be signed by the officer and plainly state the date on which and the time at which the statement is provided to the owner. (c) A person commits an offense if the person is provided a statement described by Subsection (b) and fails to comply with this subchapter within 24 hours of the time the owner is provided the statement. An offense under this subsection is a Class C misdemeanor. (f) If conduct constituting an offense under this section also constitutes an offense under any other law, the actor may be prosecuted under this section, the other law, or both. An animal is not considered tetheredwhen the animal is attached to a stationary object, as long as the owner or custodian is physically within reach of the animal. Any tethering device used to tether an animal must be at least ten (10) feet in length. Sec. 6-8. - Restraining animals and tetheringanimals. (a) It shall be unlawful for the owner, harborer, or person in possession of any animal to permit the animal to run at large in the city or to trespass upon the premises of any other person. (b) It shall be unlawful for the owner, harborer, or person in possession of any animal to leave the animal unattended in a public place regardless of whether or not it is restrained by a leash. (c) It shall be unlawful for the owner, harborer, or person in possession of any animal to leave the animal restrained by a leash and unattended in any manner that allows the animal to enter the private property of another without the effective consent of the owner. (d) Subsections (a) through (c) do not apply to police canines. (e) It shall be unlawful to restrain a dog by a fixed point chain or tether unless the chain or tetheris at least ten (10) feet long, has swivels at each end, and is attached to a pulley or trolley mounted cable that is mounted no more than seven (7) feet above ground level. (f) It shall be unlawful to restrain a dog with a chain or tether something is missing shall attach the chain or tether to a properly fitted collar or harness worn by the dog. A person may not wrap a chain or tether around a dog's neck. A person may not restrain a dog with a chain or tether that weighs more than one- eighth (1/8) of the dog's body weight. (g) It shall be unlawful to restrain a dog in a manner that does not allow the dog to have access to necessary shelter and water. (a) It shall be unlawful for an owner or person in control of an animal to fail to keep the animal in an adequate enclosure, which is one that complies with all of the requirements of this subsection (a). (1) Subject to the further requirements of this subsection (a), an enclosure shall be an area that is completely surrounded by a substantial fence or other structure of sufficient strength, height, construction, materials and design as to prevent any domestic animal from escaping from the area and to isolate the animal from the public and from other animals not under the control of the same owner. (2) For all dogs, an enclosure shall have an outside-perimeter barrier that is a minimum height of 48 inches when measured from the ground. For aggressive dogs, an enclosure shall have an outside-perimeter barrier that is a minimum height of 72 inches when measured from the ground. Any portion of a building that is intended to form part of an enclosure must have a continuous wall (inclusive of windows and doors) that meets the applicable height requirement. (3) All non-building portions of an enclosure, including gates, shall be constructed of chain link, welded wire, wrought iron, brick, mortared stone, concrete block, wood stockade or other similar fencing-type material approved by the director. (4)Where a building forms a part of an enclosure, there shall be minimal separation between the building and the remaining parts of the enclosure to prevent escape of the animal or animals intended to be contained. (5)An enclosure shall be designed, erected and maintained in accordance with all applicable zoning and building regulations of this code. (6) When not in use, all gates shall be closed and secured in a manner that prevents an animal from leaving the enclosure. (7) Broken or damaged portions of an enclosure shall be repaired with like material and provide a seamless barrier that reasonably inhibits or prevents escape. (8) If petitioned by an owner, the director may modify or waive the requirements of subsections (a)(2), (a)(3) and (a)(7) above, provided that the director determines that proposed alternate measures will adequately contain the animal(s) in question. In considering a petition, the director may take into account factors that include, but are not limited to, zoning requirements, deed restrictions and covenants, and the size and physical characteristics of the animal or animals to be enclosed. The decision of the director shall be final and un-appealable (b) It shall be unlawful for an owner to fail or refuse to exercise diligent care and control of his or her animal to prevent such animal from becoming a public nuisance. (c) It shall be unlawful for a person having charge, care or ownership of a cat to fail to keep the cat from roaming beyond the boundaries of the person’s premises. It shall be an affirmative defense to prosecution under this subsection (c) that the cat is a feral cat in the city’s trap, neuter and return program. tether (d) It shall be unlawful for a person to use a chain, rope, , leash, cable or other device to attach a dog to a stationary object or trolley system. tethering (e) It is an affirmative defense to a violation of subsection (d) above that the dog : Animal Shelter BoardPage 33 of 45Meeting Date: Tuesday, June 21, 2016 (1)Is during a lawful animal event, veterinary treatment, grooming, training or law enforcement activity; (2)Is required to protect the safety or welfare of a person or the dog, and the dog’s owner maintains direct physical control of the dog; (3) Occurs in the direct physical control of the owner in a designated city dog park; or (4) Occurs on the owner’s premises and: a. While the dog is within the owner’s direct physical control; and b. Prevents the dog from advancing to within 15 feet of the edge of any public street. (f) The affirmative defenses provided in subsection (e) above are only available if the following specifications are met: tether (1) The chain, rope, , leash, cable or other device is attached to a properly fitted collar or harness worn by the dog; tether (2) The chain, rope, , leash, cable or other device is not placed directly around the dog’s neck; tether (3) The chain, rope, , leash, cable or other device does not exceed one-twentieth of the dog’s body weight; tether (4) The chain, rope, , leash, cable or other device, by design and placement allows the dog a reasonable and unobstructed range of motion without entanglement; and (5)The dog has access to adequate shelter and clean and wholesome water. (g)It shall be unlawful for an owner or person in control of an animal to carry or transport the animal on any public roadway in an unenclosed vehicle (such as a pick-up or flatbed truck, jeep or similar vehicle) unless the animal is: (1) Contained in a closed, vented animal carrier that is secured in such a manner as to prevent the carrier from being thrown from the vehicle in the event of a collision; or (2) Secured by a leash or other device that is cross-connected to prevent the animal from falling, jumping or being thrown from the motor vehicle and from strangling on a single lead. (h) A person commits an offense if the person fails to comply with this section. (1) An offense under this section is a Class C misdemeanor. If a person fails to comply with this section with respect to more than one dog, the person’s conduct with respect to each dog constitutes a separate offense. (2) An offense under this section is punishable by a fine not to exceed $2,000. (i) This section does not prohibit a person from walking a dog with a hand-held leash. The new ordinance, which becomes effective this week, makes it illegal to use a chain, rope, tether, leash, cable or other device to attach an unattended dog to a stationary object or trolley system. A dog still must be confined within a secure enclosure at all times. This new ordinance is partly due to a new state law passed in 2007, which allows tethering during certain time frames, under certain circumstances and using certain types of restraints. “There is evidence that tethering dogs makes them more dangerous,” said Assistant Public Health Director Scott Hanlan. “Unfortunately, our animal control officers encounter on a daily basis tethered dogs that are neglected and left without food, water or shelter.” One study conducted by the U.S. Centers for Disease Control and Prevention found that animals that are kept roped or chained are 2.8 times more likely to bite people than dogs not kept roped or chained. In addition, the American Veterinary Medical Association recommends never tethering or chaining a dog, because it can contribute to aggressive behavior. Anti-tethering campaigns are also endorsed by the American Society for the Prevention of Cruelty to Animals and Humane Society of the United States. Under the new ordinance, the tethering of dogs will still be allowed under limited circumstances when the owner is present. The exceptions include a lawful animal event, city dog park, veterinary treatment, grooming, training or law enforcement activity. Those who violate the new ordinance could face a fine as high as $2,000. However, Animal Care and Control staff emphasize that they will work with residents to educate them on this new law. Staff members also will provide residents with information on low-cost, more humane ways to restrain dogs before issuing citations for violations that don’t pose immediate threats to people or animals. The issue of chained-up dogs is one element in the larger problem of irresponsible pet ownership faced not only by Fort Worth but by communities across the United States. Fort Worth animal control officers impounded 25,500 animals last year. Unfortunately, about 70 percent of those animals never made it out of the shelter alive. It shall be unlawful for any person to tether, chain or fasten any animal in such a manner so that they are accessible to the general public. All unattended tethered animals must be inside a fenced enclosure. It shall be unlawful to tether, chain or fasten an animal in such a manner as to cause it injury or pain or not permit it to reach shelter, food and water. Additionally, all animals riding in the back of pick-ups must be secured in pet carriers. Sec. 4-41. - Animal in heat. Any person who owns, harbors, or keeps any female dog or cat shall, during the period that such animal is in heat or in estrus, keep such dog or cat in a secured area that prevents a male dog or cat from having access to such female except for controlled breeding permitted by the owner of the female. Additionally, the female dog or cat shall not be chained or tetheredin a manner that prevents her from defending herself or from avoiding a male. Animal Shelter BoardPage 36 of 45Meeting Date: Tuesday, June 21, 2016 CITY OF IRVING Sec. 6-2.1. - Restraint requirements for dogs. (a) General prohibition on tethering. It is unlawful for a person to restrain a dog with a chain or tether unless the person is holding the chain or tether. (b) Affirmative defenses.It is an affirmative defense to a violation of subsection (a) that the restraint: (1) Is required to protect the safety or welfare of a person or the dog, if the dog's owner remains with the dog throughout the period of restraint; or (2) Occurs on the owner's premises and: a. While the dog is within the owner's direct physical control; and b. While the dog is prevented from being within fifteen (15) feet from the edge of any public street or sidewalk. (c) Exceptions. The prohibition of subsection (a) does not apply to a temporary restraint: (1) During a lawful animal event, veterinary treatment, grooming, training, or law enforcement activity; or (2) While in the presence of the owner in a designated city dog park. (d) Restraint specifications. The affirmative defenses provided in subsection (b) and exceptions in subsection (c) do not apply unless the restraint meets the following specifications: (1) The chain, leash, cord, or tether is not placed directly around the dog's neck and is attached to a properly fitting collar or harness worn by the dog; (2) The chain, leash, cord, or tether does not exceed more than one-tenth of the dog's body weight; (3) The chain, leash, cord, or tether, by design and placement, is unlikely to become entangled; and (4) The dog is restrained in a manner that permits access to necessary shelter and water. (e) Violation.A person commits an offense that violates this section. (1) Animal Shelter BoardPage 37 of 45Meeting Date: Tuesday, June 21, 2016 Offense. An offense under this section is a Class C misdemeanor. If a person fails to comply with this section with respect to more than one (1) dog, the person's conduct with respect to each dog constitutes a separate offense. (2) Penalty.The penalty for violation of this section shall be undersection 6-54of the Code of Civil and Criminal Ordinances of the City of Irving, Texas, and shall be between one dollar ($1.00) and two thousand dollars ($2,000.00) for each offense, for each violation, for each separate day, for each dog. (f) Hand-held leashes.This section does not prohibit a person from walking a dog with a hand-held leash. (g) Dogs running at large strictly prohibited. Nothing in this section authorizes an owner to allow a dog to run at large or to fail to provide appropriate restraint or enclosure as required bysection 6-2of this chapter. (Ord. No. 8882, § 2, 11-1-07) Sec. 6-4. - Animal safety. (a) Animals in vehicles. It shall be unlawful to leave an animal in a standing or parked vehicle without providing the animal with adequate air and protection from heat or cold. An animal left under such conditions may be impounded. (b) Tethered dogs. It shall be unlawful for an owner or harborer to allow a dog or other animal to be tethered to a stationary object or in a location so as to create an unhealthy situation for the animal or a potentially dangerous situation for a pedestrian as determined by the animal services manager. The term "unhealthy situation" shall include, but not be limited to, the following: (1) To tether any animal in such a manner as to cause the animal injury; (2) To tether any animal in such a manner as to not permit the animal access to shelter, food, or water. It shall be an affirmative defense to this subsection that the owner or harborer was in the same location as the dog or other animal while the animal was tethered; (3) To tether any animal in such a manner as to permit the animal to leave the premises owned, leased, or occupied by the dog's owner or harborer or to permit the animal access on any public right-of- way; (4) To tether any animal in such a manner as to permit the animal to leave the owner or harborer's property; (5) To allow any tethered animal to become entangled; or (6) To use choke type collars to tether any animal. Only responsible pet owners who maintain direct physical control are allowed to tether their dogs. This means the owner must be outside with the dog and near enough to exercise control over the animal at all times in the event it should become necessary to protect an animal or human from harm. Animal Shelter BoardPage 43 of 45Meeting Date: Tuesday, June 21, 2016 Sec. 2.01.016 Confinement of animal involved in attack When an animal has bitten, scratched, or otherwise attacked a person or animal, anyone having knowledge of such incident shall immediately notify the local rabies control authority. Such animal shall then be confined in a veterinary hospital or approved animal shelter designated by the local rabies control authority for a period of ten (10) days. The cost of such confinement shall be paid by the owner of the animal. Such animal shall, during such period of confinement, be subject to inspection by the local rabies control authority, other town personnel or a licensed veterinarian. If, after the ten (10) day period, the owner fails to pick up the animal, the local rabies control authority may follow the procedure for adoption or disposal of an impounded animal.
