The Animal Shelter Board for the Town of Trophy Club, Texas, met in a Regular Session on Tuesday, June 21, 2016.
The meeting was held within the boundaries of the Town and was open to the public.

CALL TO ORDER AND ANNOUNCE A QUORUM
Chairman Edstrom called the meeting to order and announced a quorum at 6:31 p.m.
CITIZEN PRESENTATIONS
Citizens are allowed three (3) minutes to address the Board regarding an item over which the Board has policy or
oversight authority as provided by Texas law, the ethics order, or other policy order.
No citizens addressed the Commission.
REGULAR SESSION
1.Review and take appropriate action regarding the approval of past meeting minutes dated:

Chairperson Edstrom entertained a motion to approve all minutes with one motion. Motion
approved by Tony Simmons, seconded by Kelly Akin and approved unanimously.

2. Review plans for the new shelter facility; discussion of same.
Chairperson Edstrom discussed the location of the new shelter facility, the area for the kennels,
washer and dryer hook-ups and a possible donation by the Friends of the Trophy Club Animal Shelter
for a washer and dryer . Chairperson Edstrom also discussed the change from iron fencing to chain
link fencing for added safety purposes. Chairperson Edstrom then introduced Philip Shoffner as the
Board’s Council Liaison and Pamela Swan as the newly appointed Town resident board member.
Council Liaison Shoffner proposed a fundraiser for artificial turf and Chair Edstrom added the need for
a canopy or tree cover to cool the turf. Board member Swan inquired about water hook-ups being
provided in the fenced in area; the chair advised Council Liaison Shoffner would take that as an active
action item.
3. Review proposed tethering options for inclusion in the Town’s Ordinances; discussion of same.
ACO Akin discussed the state’s current Anti-Tethering Law and proposed implementing additional
restrictions to the restraining of animals to be included in the Town’s ordinances. Members
discussed options regarding ACO Akins’ proposal to prohibit unattended restrained animals and to
include temporary time limits for leaving a pet tethered outside while unattended. Sample language
from local municipalities that have additional restrictions and requirements for tethering/restraint
were also discussed. The chair proposed drafting an ordinance using preferred language from the
sample ordinances to present to the Town’s attorney.
4.Receive Shelter Inspection Update; discussion of same.
Dr. Fusselman and ACO Akin agreed to set a date and time for an upcoming inspection, and to be
scheduled within two weeks.
5.Review animal bite protocol and provide recommendations to Town’s Ordinances as needed;
discussion of same.
Chairperson Edstrom discussed a recent animal bite incident occurring in Trophy Club and the
inability of the bite victim to obtain additional information, including contact information for the
animal’s owner. Sgt. Tony Simmons discussed optional ways to obtain information including Open
Records Requests; ACO Akin discussed bite report procedures including providing the victim the
biting animal’s rabies vaccination status as soon as the information is confirmed.
6. ACO and Shelter Board Updates; discussion of same.
Chairperson Edstrom discussed the Town Council’s approval of the keeping of fowl, based upon space
and proximity to neighboring residences, and limiting to a small number of residences within the
Town of Trophy Club. The chair also discussed the dog run change for the new Town Hall, the
recently approved veterinary hospital near Byron Nelson and Medlin schools and an update on an
abandoned dog found in Trophy Club and later adopted by a Trophy Club family.

approved by a vote of 6-0.

Sec. 6-1. - Definitions

control over the dog in the event it should become necessary to do so to protect the dog, a human, or
another animal from harm.

Tethering Dogs
The city also has a ban on unattended tethered dogs. Only responsible pet owners who maintain direct
physical control are allowed to tether their dogs. This means the owner must be outside with the dog
and near enough to exercise control over the animal at all times in the event it should become necessary
to protect an animal or human from harm.
Residents also are reminded that it is against the law to leave an unsupervised animal in a parked
vehicle. Unattended pets can be impounded.
GREENVILLE, TX:
Chapter 4.03.007 of the Code of Ordinances: Tethering Prohibited
It is unlawful for an owner or keeper to restrain a dog by means of a tether. A tether is defined as a
chain, rope, cable, leash, or other similar device used to attach an animal to a stationary object or trolley
system. The only time a dog may be tethered is if the owner is physically present outside with the dog,
Dogs are still required to be on a leash when not confined to the property by a fence.
ARLINGTON, TX:
Section 9.08 Tethering
A. A person commits an offense if he uses a chain, rope, tether, leash, cable, or other device to attach a
dog to a stationary object or trolley system. This section does not prohibit a person from walking a dog
with a hand-held leash.
B. It is a defense to prosecution under this section that:

1. the dog is being tethered during a lawful animal event, veterinary treatment, grooming, training, or
law enforcement activity; or
2. the dog tethering is required to protect the safety or welfare of a person or the dog, and the dog's
owner maintains direct physical control of the dog; or
3. the dog tethering is due to force majeure and the dog is tethered for less than one hour within a
twenty-four period; or
4. the dog tethering:
a. occurs while the dog is within the owner's direct physical control; and
b. prevents the dog from advancing to the edge of any public right-of way.
C. The defenses under this section are only available if the following specifications are met:
1. The chain, rope, tether, leash, cable, or other device is attached to a properly fitted collar or harness
worn by the dog;
2. The chain, rope, tether, leash, cable, or other device is not placed directly around the dog's neck;
3. The chain, rope, tether, leash, cable, or other device does not exceed 1/20th of the dog's body
weight;
4. The chain, rope, tether, leash, cable, or other device, by design and placement allows the dog a
reasonable and unobstructed range of motion without entanglement; and
5. The dog has access to adequate shelter and clean and wholesome water. (Amend Ord 12-032, 5/1/12)

Tethering
The City of Fort Worth bans the use of chains, ropes, tethers, leashes, cables or other devices to attach
an unattended dog to a stationary object or trolley system. Dogs may be tethered to objects in limited
circumstances when the owner is present, such as at lawful animal events or city dog parks, as well as
during veterinary treatment, grooming, training or law enforcement activity.
Fort Worth Animal Care & Control strongly enforces this ordinance. Those who violate the ordinance
face significant legal penalties.

Trophy Club Code of Ordinances Chapter 2: Animal Control
Sec. 2.01.001 Definitions:
LƒƦƚǒƓķ͵ To seize and hold in the custody of the local rabies control authority or other authority
such as a veterinarian.
ARTICLE 2.02 IMPOUNDMENT*
Sec. 2.02.001 Generally
(a) Impoundment of animals at large. The local rabies control authority shall take into custody
any animal found at large in the town and shall impound the animal into the custody of the police
as defined by section 2.01.001 of this chapter.
(b) Holding period. Such impounded animal shall be held for a period of not more than three
(3) days if not claimed or surrendered before the three (3) day period.
(c) Disposition of unclaimed animals. At the end of such period, if the animal has not been
claimed and the fees associated with the impoundment have not been paid to the town, the animal
is deemed the property of the town and may be placed up for adoption by the town or euthanized
as determined by the local rabies control authority.
(d) Notification of owner. Prior to adoption or euthanasia, reasonable attempts in accordance
with the written town animal control policy shall be made to contact the owner of the registered
animals. Unregistered animals will automatically become the property of the town after the three
(3) day impound period.
(e) Protective custody impounds.
(1) If an animal is impounded as the result of a fire, medical emergency, hospitalization,
custody arrest, or other natural or man-made situation that leaves the owner, harborer
or person otherwise in possession of the animal temporarily incapable of maintaining

control of, or caring for, the animal, an animal control officer may impound the
animal and house it at the animal shelter.
(2) The owner, harborer or the person that was in possession of the animal will be
notified of the location of the animal, the conditions under which the animal may be
released, and that the animal will be held for a period of seven (7) days. If the owner,
or his designee, has not claimed the animal within seven (7) days, the animal
becomes the property of the town to be disposed of by the animal control center
through adoption, transfer to an animal rights organization, or euthanasia.
(3) Owners, or their designees, shall fulfill all the requirements for redemption as
prescribed by this chapter.

CHAPTER 826. RABIES
SUBCHAPTER A. GENERAL PROVISIONS
Sec. 826.033. RESTRAINT, IMPOUNDMENT, AND DISPOSITION OF DOGS AND CATS. (a) The governing
body of a municipality and the commissioners court of a county may adopt ordinances or rules under
Section 826.014 or 826.015 to require that:
(1) each dog or cat be restrained by its owner;
(2) each stray dog or cat be declared a public nuisance;
(3) each unrestrained dog or cat be detained or impounded by the local rabies control authority or that
officer's designee;
(4) each stray dog or cat be impounded for a period set by ordinance or rule; and
(5) a humane disposition be made of each unclaimed stray dog or cat on the expiration of the required
impoundment period.
(b) A jurisdiction may not be subject to dual restraint ordinances or rules.
(c) The enforcing agency may adopt an ordinance setting a fee for the impoundment and board of a dog
or cat during the impoundment period. The animal's owner must pay the fee before the animal may be
released.
(d) The enforcing agency shall deposit the fees collected in the treasury of the enforcing agency. The
fees may be used only to help defray the cost of administering this chapter or the ordinances or rules of
the enforcing agency within its jurisdiction.
