Svore Municipal Building Boardroom The Town Council of the Town of Trophy Club, Texas, met in a Regular Session on Tuesday,January 10, 2017. The meeting was held within the boundaries of the Town and was open to the public. STATE OF TEXAS § COUNTY OF DENTON § TOWN COUNCIL MEMBERS PRESENT: C. Nick Sanders Mayor Greg Lamont Mayor Pro Tern, Place 5 Jim Parrow Council Member, Place 1 Rhylan Rowe Council Member, Place 3 Tim Kurtz Council Member, Place 4 Philip Shoffner Council Member, Place 6 TOWN COUNCIL MEMBERS PRESENT: Garrett Reed Council Member, Place 2 STAFF AND GUEST(S) PRESENT: Patrick Arata Acting Town Manager Steven Glickman Assistant Town Manager/CFO David Dodd Town Attorney Shannon Montgomery Acting Town Secretary Rick Lasky Interim Fire Chief Mayor Sanders announced the date of Tuesday,January 10, 2017,called the Town Council to order and announced a quorum at 7:00 p.m. Mayor Sanders stated that Council Member Reed would not be in attendance. The Invocation was offered by Mayor Sanders. The Pledges to the American Flag and Texas Flag were led by Council Member Shoffner. CITIZEN PRESENTATIONS This is an opportunity for citizens to address the Council on any matter whether or not it is posted on the agenda. The Council is not permitted to take action on or discuss any presentations made to the Council at this time concerning an item not listed on the agenda. The Council will hear presentations on specific agenda items prior to the Council addressing those items. You may speak up to four (4) minutes or the time limit determined by the Mayor or presiding officer. To speak during this item you must complete the Speaker's form that includes the topic(s)of your statement. Topics of presentation should be limited to matters over which the Council has authority. Thomas Sorge, 133 Creek Courts Drive, spoke to the Council regarding his Annual Parking Permit, he understood that he was grandfathered into the system and tried to renew his parking permit on December 16, 2016; but the offices were closed. He then had family emergencies and could not come back to renew his parking permit until January 3, 2017 and was told that his permit could not renewed because it had expired. Mr. Sorge asked the Council to reinstate his permit. Mayor Sanders thanked Mr. Sorge for his presentation and advised that Council and the Acting Town Manger/Police Chief Arata would take his comments into consideration. Robert Hock, 245 Oak Hill Drive, spoke to the Council regarding Standard Pacific, the Developer of the Isle of Turnberry Development, removing a substantial number of trees in order to develop the property. On November 6, 2014, he attended the Planning and Zoning Commission meeting where that approval was requested. After the meeting, he and his neighbor met with Mr. Chip Boyd, the Vice President of Land Development for Standard Pacific, and were assured that the trees would be planted. The development was nearing completion and only a few trees have been planted. He believed immediate action should be taken to ensure that the tree remediation was carried out before the project was complete. The issue was discussed with Matt Beroth, Manager of the Country Club, and he was willing to discuss with the Developer the use of Country Club property abutting the development as a place to plant the trees. That area by the 10th green and the 11th tee of Hogan Course would be a prime location for a dense grove of evergreen trees, live oaks, or native cedars. This would screen the homes but would not affect the occupant's views since they have chosen to site their garage doors and windows facing the golf course. He advised that he would email his remarks to the P&Z Commission and the Tree Board. Mr. Hock will email these remarks to the P&Z Board and the Tree Board. Mayor Sanders thanked Mr. Hock for coming and stated that his presentation would be forwarded to administration. ANNOUNCEMENTS AND REPORTS 1. Receive Acting Town Manager Arata's update regarding the following; discussion and provide input regarding same(Staff). • May 6,2017 General Election Dates Acting Town Manager Arata updated the Council and addressed questions;no action was taken. Council member Parrow made the following statement: "Mr. Mayor, Distinguished Council members and Neighbors, As we were just advised, beginning on January 18,just 8 days from now, through February 17, residents will have an opportunity to file for this May's election, which is why lam making this statement tonight. I have had the Honor and Privilege of representing the residents of Trophy Club for the past three years and am so Grateful that my neighbors felt I was worthy and granted me the opportunity to represent them. In addition to numerous programs, and projects that I had a part in passing to benefit our beautiful Town, including building our 1st Town Hall, getting PD30 redesigned and moving forward to be something better than originally approved, and spearheading the removal of more than 40 unnecessary signs from the roundabout, making it safer for drivers and pedestrians alike. In addition, as a Veteran, Patriot and New Yorker, the three accomplishments that I will remember most was Establishing our First Trophy Club Memorial Day Ceremony, Expanding the Multi Branch and POW/MIA Veterans Day Ceremony, along with helping to finalize the redesign of the Veterans Memorial, and successfully bringing together a Team of Patriots to construct,a Permanent Memorial to the Victims and Heroes of 9/11 that respectfully displays an Artifact from the Twin Towers. I am so pleased and grateful to announce that 2017 is the year my wife and I have been Blessed by Almighty God to celebrate our 50th Wedding Anniversary, which we have chosen to dedicate to one another, and accomplish things we have put off for a number of years. Since we will be giving our full attention to one another, and not following any other schedules, after May, I am announcing that 1 will not be seeking reelection to the Council, and want to encourage any resident who seeks to and can dedicate the necessary time, to file for my seat on the Council. I must Thank my fellow Council Members, most especially,for their support on the Three Special Accomplishments outlined above, and ask that the new Council insures that the Memorial Day and Veterans Day Ceremonies supported in 2016, remain Permanent Town Events to insure that the Heroic men and women who have served and Town Council Minutes January 10, 2017 Page 2 of 5 died that we can all live Free, are never forgotten. As a resident and Co-Founder of the METROPORT Veterans Association, I can assure the Council there will always be a Veteran ready and willing to step up, Organize and MC these two events in consort with the appropriate Town Staff and departments. I look forward to hearing, which one of my talented and dedicated public servant focused neighbors steps up and Files to fill the seat I will vacate in May, and wish that individual the very best." CONSENT AGENDA All matters listed as Consent Agenda are considered to be routine by the Town Council and will be enacted by one motion. There will not be a separate discussion of these items. If discussion is desired, that item will be removed from the consent agenda and will be considered separately. 2. Consider and take appropriate action regarding the Town Council Regular Session Minutes dated December 13,2016(Staff). 3. Consider and take appropriate action regarding the First Quarter Investment Report for Fiscal Year 2017 (Staff). 4. Consider and take appropriate action regarding an Ordinance of the Town, appointing a presiding judge and an alternate judges for the Trophy Club Municipal Court of Record No. 1 and providing an effective date (Staff). 5. Consider and take appropriate action regarding an Ordinance of the Town repealing Section A1.011, "Police Department" of Article A1.000, "General Provisions" of Appendix A, "Fee Schedule" of the Town of Trophy Club Code of Ordinances and adopting a new Section A1.011, "Police Department" of Article A1.000, "General Provisions" of Appendix A, "Fee Schedule" to update the Police Department's Fee Schedule including the removal of outdated fees, updating existing fees, and adding fees for obtaining a copy of body worn camera recordings and providing an effective date(Staff). Council Member Shoffner asked to remove Item 5 from the Consent Agenda. Motion: Motion made by Mayor Pro Tern Lamont, seconded by Council Member Rowe, to approve Consent Agenda Items 2 through 4 as presented. Motion carried unanimously. REGULAR SESSION 5. Consider and take appropriate action regarding an Ordinance of the Town repealing Section A1.011, "Police Department" of Article A1.000, "General Provisions" of Appendix A, "Fee Schedule" of the Town of Trophy Club Code of Ordinances and adopting a new Section A1.011, "Police Department" of Article A1.000, "General Provisions" of Appendix A, "Fee Schedule" to update the Police Department's Fee Schedule including the removal of outdated fees, updating existing fees,and adding fees for obtaining a copy of body worn camera recordings and providing an effective date(Staff). Council Member Shoffner requested the following fees be added to the proposed Ordinance: (f)-Soliciting fees: (1)Application-$15.00 (2) Permit-$50.00(for first person/vendor)/$25.00(for each additional person) (3) Renewal Permit-$25.00(per person) (4) Background Checks-$65.00 Town Council Minutes January 10, 2017 Page 3 of 5 Motion: Motion made by Council Member Shoffner, seconded by Council Member Rowe, to approve Ordinance 2017-02 repealing Section A1.011, "Police Department" of Article A1.000, "General Provisions" of Appendix A, "Fee Schedule" of the Town of Trophy Club Code of Ordinances and adopting a new Section A1.011, "Police Department" of Article A1.000, "General Provisions" of Appendix A, "Fee Schedule" to update the Police Department's Fee Schedule including the removal of outdated fees, updating existing fees, and adding fees for obtaining a copy of body worn camera recordings and providing an effective date as amended at the dais. Motion carried unanimously. 6. Consider and take appropriate action regarding Town Council's participation in the "It's Time Texas — Community Challenge" (Mayor Sanders). Parks and Recreation Board Chair Tiffany Nimphius and Vice Chair Mindi Bone explained the "It's Time Texas — Community Challenge"and asked Council to participate. The entire Town Council signed the Pledge. Nimphius asked the Council to help and encourage residents to register. 7. Consider and take appropriate action regarding the Processing and Holding Area of the new Police Department Facility(Staff). Motion: Motion made by Council Member Parrow, seconded by Council Member Rowe,to approve the modification to the Processing and Holding Area of the new Police Department facility at a cost to not exceed$6,000. Motion carried unanimously. Council Member Rowe thanked Chief Arata for his diligence in finding a workable solution with the modification. 8. Discuss and provide direction to Staff regarding the possible location and uses of a Storage Facility on Town Property Storage Facility on Town property(Mayor Pro Tem Lamont). Council Member Kurtz asked how much square feet of storage Staff currently used through the Town and what cost was. Assistant Town Manager/CFO Glickman stated that the Town currently has approximately 5,500 square feet, including the maintenance barn,which houses a breakroom, bathroom,and an area for computers. Mayor Sanders asked Staff to provide size and location needs,along with aesthetics and landscaping to the Council Retreat for Council to review. Mayor Sanders also asked that Staff bring long-term uses for the space,other than storage and funding options. Direction only, no action taken. 9. Discuss and provide direction to Staff regarding the relocation of the dog run on the Town property(Mayor Pro Tem Lamont.) After a short discussion,the consensus of the Council was not to move the dog run. No action was taken. 10. Items for Future Agendas to include discussion of Agenda Items for consideration on the upcoming Regular Session Council Agenda for January 24,2017 meeting and discussion of Future Agenda Items, to include discussion of the below items from the Future Agenda list(Staff): Town Council Minutes January 10,2017 Page 4 of 5 • Item No. 3 - Detail review of the nuisance ordinance. (Rowe 4/12/2016) (1 July 12, 2016) (2 October 11,2016) (3 January 10,2017) • Item No. 4 - Consider repealing Section 14.02.253(3)(A) related to tree houses. (Shoffner 7/12/2016) (1 October 11,2016) (2 January 10,2017) There were no objections to leaving agenda items 3 and 4 on the future agenda items list.
