Minutes TC 05/09/2017 MINUTES FROM REGULAR SESSION TOWN COUNCIL MEETING FOR THE TOWN OF TROPHY CLUB LOCATION: 100 MUNICIPAL DRIVE,TROPHY CLUB,TEXAS Tuesday, May 9,2017 at 7:00 P.M. Svore Municipal Building Boardroom The Town Council of the Town of Trophy Club, Texas, met in a Regular Session on Tuesday, May 9, 2017. The meeting was held within the boundaries of the Town and was open to the public. Nick Sanders Mayor STAFF PRESENT: Tom Class Town Manager Holly Fimbres Town Secretary/RMO Patrick Arata Police Chief Wade Carroll Fire Chief Rick Lasky Interim Fire Chief Keith Burris Police CID Sergeant Amber Karkauskas Director of Finance/CFO Sherri Lewis PIO/Communications Manager Todd Mauthe Police Patrol Sergeant Mike Pastor Information Technology Manager Lisa Reich Town Planner Tracey Shields Police Lieutenant John Zagurski Budget Manager Mayor Pro Tem Lamont announced the date of Tuesday, May 9, 2017, called the Town Council to order and announced a quorum at 7:00 p.m. The Invocation was offered by Council Member Parrow. The Pledges to the American Flag and Texas Flag were led by Council Member Kurtz. Council Member Shoffner called a Point of Order to invoke a temporary suspension of the Council Rules of Procedure per Section 1.03.032, General Rules, subsection (m). He specifically suspended the rule in Section 1.03.034, Chairman/Presiding Office to select Council Member Reed to preside over the meeting. A suspension of any rule would require a two-thirds majority vote of the Council to approve. Mayor Pro Tem Lamont called for the vote and the temporary suspension was approved 5-0-1, with Council Member Reed abstaining. CITIZEN PRESENTATIONS This is an opportunity for citizens to address the Council on any matter whether or not it is posted on the agenda. The Council is not permitted to take action on or discuss any presentations made to the Council at this time concerning an item not listed on the agenda. The Council will hear presentations on specific agenda items prior to the Council addressing those items. You may speak up to four (4) minutes or the time limit determined by the Mayor or presiding officer. To speak during this item you must complete the Speaker's form that includes the topic(s)of your statement. Topics of presentation should be limited to matters over which the Council has authority. Michelle Reed, 3 Greenhill Trail, expressed her appreciation for the invaluable service that her husband provided during the three years that he served on Council and for the accomplishments that were achieved during that timeframe. She was grateful for the sincere leadership that he demonstrated on behalf of the entire community. Steve Flynn, 417 Ramsey Trail, commented that he recently moved back to the Town of Trophy Club and that he would be interested in any opportunities to serve the Town. ANNOUNCEMENTS AND REPORTS 1. Receive Town Manager Class' update regarding the following,discussion and provide input regarding same (Staff): • Introduction of newly hired Fire Chief Wade Carroll — Provided a brief overview of Fire Chief Carroll's biography,who assumed command with the Town on May 1st. • Volunteer Appreciation Reception—Scheduled for June 2nd from 6 to 8 p.m. at the Country Club. Evites were sent to residents who volunteered during 2016. Mayor Pro Tem Lamont acknowledged Council Member Parrow for his passion during the planning process of the new Town Hall facility, his devotion to the Veterans Memorial, and for making the Town a better place with its operations. Additionally, he recognized Council Member Reed for assisting in the improvement of the Town's management and procedures, for being an integral piece to the Town's successful developments, and for his invaluable leadership skills. Council Member Shoffner provided an example of American professional baseball players Joseph Tinker, Johnny Evers, and Frank Chance, who played during 1902-1912, won four championships and two World Series, and epitomized a high caliber of teamwork. He stated that the current Council displayed the same type of exceptional teamwork. He commended Council Member Reed for his passion that he displayed, for being the backbone of their team,and for the recommendation to pursue the property that the new Town Hall facility was being built on. He acknowledged Council Member Parrow for his devotion in researching different sites for the new Town Hall facility and for his commitment that he demonstrated while serving on Council. He provided the following statistics: the current Council was the second longest serving Council; they had served 922 days together; and participated in 94 Council meetings,which totaled 351 hours and 14 minutes. Council Member Rowe thanked Council Member Parrow for his persistency, passion,and for being a great asset to the Town. He recognized Council Member Reed for representing the citizens in an honorable fashion, for his authenticity,and for basing his decisions on high principles. Additionally, he presented Council Member Reed with a framed picture. Council Member Kurtz commended Council Members Parrow and Reed for the passion they brought forth in their work and commitment. He thanked Council Member Parrow for his efforts with the Veterans Memorial and Council Member Reed for his negotiation skills. He pointed out the successful accomplishments that the current Council assisted with,which included Bread Winners and the new Town Hall facility. Town Council Minutes May 9,2017 Page 2 of 6 Council Member Reed complimented Council Member Parrow for his persistency when putting his mind to something and seeing it through until it was accomplished. He commended Council Member Rowe for his high degree of intellect, Mayor Pro Tem Lamont for having a vision and executing it, Council Member Kurtz for his managing and interviewing skills, and Council Member Shoffner for his ability to locate and provide detailed information. Additionally, he thanked his wife and children for their sacrifices and support while he served on Council. Council Member Parrow stated that it had been an honor and privilege to serve the residents for the past three years. He commented that the Council was always able to come up with a solution and he was grateful that the Council implemented annual Memorial Day and Veterans Day ceremonies. Mayor Pro Tem Lamont presented Council Member Parrow and Council Member Reed with an inscribed clock and a framed Resolution of Gratitude for their invaluable service. CONSENT AGENDA All matters listed as Consent Agenda are considered to be routine by the Town Council and will be enacted by one motion. There will not be a separate discussion of these items. If discussion is desired, that item will be removed from the consent agenda and will be considered separately. 2. Consider and take appropriate action regarding the Town Council Regular Session Minutes dated April 11, 2017(Staff). (Town Secretary Note:Approved as presented in the Town Council agenda packet) 3. Consider and take appropriate action regarding a Requisition Request for procurement of cabling of the DIRTT wall system for the new Trophy Club Town Hall facility between the Town of Trophy Club and G.L Seaman & Company for operations in Information Services; and authorizing the Mayor or his designee to execute all necessary documents(Staff). 4. Consider and take appropriate action regarding a Requisition Request for procurement of LifePak 15 between the Town of Trophy Club and Physio Control for operations in Fire Department; and authorizing the Mayor or his designee to execute all necessary documents(Staff). 5. Consider and take appropriate action regarding a Resolution of the Town Council repealing Resolution No. 2016-31 and adopting a revised Investment Policy for the Town of Trophy Club; and providing an effective date(Staff). Motion made by Council Member Rowe, seconded by Council Member Parrow, to approve the Consent Agenda Items 2 through 5. Motion passed unanimously. REGULAR SESSION 6. Consider and take appropriate action regarding a Proclamation of the Town Council declaring May 14-20, 2017 as National Police Week in Trophy Club in conjunction with National Police Week and May 15,2017,as National Peace Officers Memorial Day in Trophy Club;and providing an effective date(Staff). Council Member Parrow read the proclamation into the record. Motion: Motion made by Council Member Parrow, seconded by Mayor Pro Tem Lamont, to approve Proclamation No. 2017-04, declaring May 14-20, 2017 as National Police Week in Trophy Club in conjunction with National Police Week and May 15, 2017, as National Peace Officers Memorial Day in Trophy Club; and providing an effective date of May 9, 2017. Consider and take appropriate action regarding a Proclamation of the Town Council recognizing Byron Nelson student Jarrod Clark for earning a Congressional Award Gold Medal;and providing an effective date (Mayor Sanders). Council Member Parrow read the proclamation into the record. Motion: Motion made by Council Member Parrow, seconded by Mayor Pro Tern Lamont, to approve Proclamation No. 2017-05, recognizing Byron Nelson student Jarrod Clark for earning a Congressional Award Gold Medal; and providing an effective date of May 9,2017. Motion passed unanimously. 8. Recognition of Interim Fire Chief Rick Lasky for his service that he provided to the Town of Trophy Club (Staff). Council Member Reed thanked Interim Fire Chief Lasky for being instrumental in the improvement of the Town's organization,specifically the Fire Department. Police Chief Arata and Fire Chief Carroll recognized Interim Fire Chief Lasky for his service that he provided to the Town and presented him with a Certificate of Appreciation. Council Member Parrow stated that Interim Fire Chief Lasky played an instrumental role in the design and installation of the 9/11 Twin Tower Artifact that resides outside of the Fire Station, which was unveiled on September 11,2016. Additionally, he thanked him for his service and dedication. Council Member Shoffner read an email that the Council had received on April 12, 2016, regarding the security of obtaining Fire Chief Lasky on an interim basis. He commended him for his devotion to the Town and for his positive leadership skills. Council Member Rowe thanked Interim Fire Chief Lasky for his commitment and leadership that he displayed until the Town was able to secure a new Fire Chief. Council Member Kurtz was drawn to Interim Fire Chief Lasky because he was a player-coach and represented the firefighters to ensure a positive culture. Mayor Pro Tem Lamont stated that Interim Fire Chief Lasky came at a tense time when decision making was occurring as to whom would run the Fire Department and that he provided valuable guidance for the Town to pursue managing the Fire Department. Interim Fire Chief Lasky commented that it had been an honor to serve the Town and he was grateful for the Council encouraging and promoting teamwork. No action was taken on this item. 9. Consider and take appropriate action regarding proposed Town Council meeting dates in July 2017; discussion of same(Staff). Motion: Motion made by Council Member Reed, seconded by Council Member Parrow, to table this item until the new Council Members were sworn in. Motion passed unanimously. Case O-AMD-17-002(Community Development Fee Schedule) Consider and take appropriate action regarding an Ordinance of the Town amending Section A1.003, "Community Development Department", Section A1.004, "Planning and Zoning Department", and Section A1.005, "Zoning Board of Adjustment" of Article A1.000, "General Provisions" of Appendix A, "Fee Schedule"of the Town of Trophy Club Code of Ordinances and providing an effective date(Staff). Town Planner Reich advised that she was proposing changes to the Town's Fee Schedule to ensure consistency and to account for staff time and resources. She researched surrounding town fee schedules to ensure compliance with regional standards, which included the City of Argyle, City of Fort Worth, City of Southlake, and the Town of Westlake. Council Member Shoffner was concerned that the Town was possibly imposing a fee intense schedule for residents that owned older homes and desired to remodel them. He was in favor of staff reviewing the process and to possibly offer lower fees for residential remodels or to possibly offer incentives since this improved the Town esthetically. Council Member Reed commented that residential remodel fees typically include the review of the plans to ensure compliance with codes and the performance of inspections to ensure safety. He was in favor of promoting a simplified process for residential remodels. Motion: Motion made by Council Member Shoffner, seconded by Council Member Rowe, to approve Ordinance No. 2017- 11, amending Section A1.003, "Community Development Department", Section A1.004, "Planning and Zoning Department", and Section A1.005, "Zoning Board of Adjustment" of Article A1.000, "General Provisions" of Appendix A,"Fee Schedule"of the Town of Trophy Club Code of Ordinances and providing an effective date of May 9,2017. Motion passed unanimously. Discussion took place that multiple inspections for retaining walls depended on the size of the wall, which could include inspections on piers, engineering,grading,and drainage. 11. Discussion of and provide direction to Town Staff regarding the impact on the Town from the Trophy Club Municipal Utility District (TCMUD) No. 1 Bond Election -Town Council Future Agenda Item No. 5 by Council Member Shoffner(Town Council). Council Member Shoffner was initially concerned about the TCMUD No. 1 Bond Election failing and the possible impact that would have on the Town's current fiscal year budget. It was brought to his attention that the budget implications would not take effect until the next fiscal year,which would allow time to budget appropriately. No action was taken on this item. 12. Discussion of items for Future Agendas to include agenda items for consideration on the May 17, 2017 and May 23,2017 Council agendas and items from the Town Council Future Agenda Items list(Staff). This item allows Council to request the placement of items on upcoming agendas when the topic of discussion requires research and review that cannot be accomplished in the time frame between regular Council meetings. However, a Council Member may request that an item be placed on the next regularly scheduled meeting without first placing that item on the Future Agenda Items list. All requests for agenda items must comply with Charter requirements. Mayor Pro Tem Lamont requested to proceed with the badge pinning ceremony for the newly hired Police Offices and Firefighters at the June 13,2017 Council meeting.
