Training/EOC Room The Crime Control and Prevention District Board of the Town of Trophy Club, Texas, met in a Regular Session on Thursday, November 30, 2017. The meeting was held within the boundaries of the Town and was open to the public. STATE OF TEXAS § COUNTY OF DENTON § CCPD BOARD MEMBERS PRESENT: Paul Glowacki, Chairman Lou Opipare, Board Member Joe Tellez, Board Member Richard Savage, Board Member Sarah Lapacka, Board Member MEMBERS ABSENT: J.J. Isherwood, Vice Chair STAFF AND GUEST(S) PRESENT: Patrick Arata, Chief of Police Julie Swartz, Administrative Assistant CALL TO ORDER AND ANNOUNCE A QUORUM Board Member Paul Glowacki called the meeting to order and announced a quorum at 6:00 p.m. CITIZEN PRESENTATIONS Citizens are allowed three (3) minutes to address the Board regarding an item over which the Board has policy or oversight authority as provided by Texas law, the ethics order, or other policy order. No citizens addressed the Board. CCPDPage 4 of 14Meeting Date: January 8, 2018 REGULAR SESSION 1.Discuss and take appropriate action regarding the Trophy Club Crime Control and Prevention District Board Minutes for July 13, 2017. Board Member Paul Glowacki called for a review of the minutes of the July 13, 2017 Meeting of the Crime Control and Prevention District. The minutes were reviewed and a motion was made by Richard Savage to accept \[or table\] the July 13, 2017 minutes as presented. Motion seconded by Board Member Sarah Lapacka. Motion approved by a vote of 5-0. 2.Discussion of and take appropriate action regarding the Crime Control and Prevention District Budget for Fiscal Year 2017/2018. Board Member Paul Glowacki called on Chief Arata to give a briefing on the item before action was taken. Chief explained that in the last year CCPD approved $18,000 for an Evidence Custodian with the understanding that if the Town fully funded the position that the money would be reallocated to other uses. The position was funded by Town; therefore the money can be repurposed. Some suggested uses are for a secure WiFi by the IT Department ($8,000- 9,000), for some needed furniture upgrades on the Police side of the building ($8,000-9,000) and possibly small equipment. Lou Opipare made a motion to accept. Joe Tellez seconded the motion. Motion approved by a vote of 5-0. 3. Receive an update from Town Staff regarding the upcoming May 2018 Election Specifically for the planning and calling a Continuation Referendum for the Trophy Club Crime Control and Prevention District. Chief Arata explained that the CCPD Board was initially approved for five years and the five years are coming to an end. The Town Council has decided to continue with the Board and set it for election at the next Council meeting. There will be a decision if the CCPD Board should be for five, ten or fifteen years and that will be discussed at a later meeting in January, 2018; May is the upcoming election. No action taken. 4.Police Department update. Chief Arata gave update on Police Department stating that we have obviously moved into the new building and we are 98% operational. We are still working on adding officers to staff. We are also in process of buying two new cars: one is provided by CCPD , the other is provided by the general fund from the Town. This will make our fleet fairly up to date. LiveScan and other IT equipment is up and running at office and in cars. Volunteers are being utilized in a much greater way since we have moved – this includes helping at office and driving around town. Keith Burris, Juvenile Detective, resigned after thirteen years to pursue a position with his church. CCPDPage 5 of 14Meeting Date: January 8, 2018 Paul Glowacki inquired about Officer Sullivan and K-9 Indy; Chief explained both are doing well although Barry was injured at a training event when another dog bit him. WHEREAS, Section 41.001(a) of the Texas Election Code establishes the first Saturday inMay as a Uniform Election Date for the purposes of conducting a Joint Special Election; and WHEREAS, the Town Council took action on November 14, 2012 to propose the creation of a Crime Control and Prevent District within the boundaries of the Town of Trophy Club, Texas, and WHEREAS, on December 10, 2012, pursuant to Resolution No. 2012-34, the Town Council created a Temporary Board of Directors for the proposed Trophy Club Crime Control and Prevention District and appointed seven (7) members to serve as the Temporary Directors for the District; and WHEREAS, at the May 11, 2013Special Election, a majority of the votes were cast in favor for the creation of the Trophy Club Crime Control and Prevention District dedicated to crime reduction programs and the adoption of a proposed local sales and use tax at a rate of one-fourth of one percent; and WHEREAS, the Trophy Club Crime Control and Prevention District would be dissolved on September 30, 2018, unless the district holds a continuation referendum prior to the end date; and CCPDPage 8 of 14Meeting Date: January 8, 2018 WHEREAS, Section 363.251 of the Texas Local Government Code authorizes the Board to order a referendum on its own motion by a majority vote of its members; and WHEREAS, after adoption of this Order, the Boardrequestthat the Trophy Club Town Council include the Continuation Proposition set forth in the Town’s ordinance ordering and calling the May 5, 2018 Special Election; and WHEREAS, because the Town of Trophy Club is located in both Denton County and Tarrant County, the Town will enter into an Election Services Contract with Denton County and an Election Services Contract with Tarrant County so that those entities will provide election services for Denton County and Tarrant County residents of Trophy Club; and WHEREAS, the Election shall be conducted in accordance with the Code under the jurisdiction of the Denton County Elections Administration pursuant to an Election Services Contract by and among Denton County Elections Administration, and other participating entities, if any, described in theContract between the Town and Denton CountyElections; and WHEREAS, the Election shall be conducted in accordance with the Code under the jurisdiction of the Tarrant County Elections Administration pursuant to an Election Services Contract by and among Tarrant County ElectionsAdministration, and other participating entities, if any, described in the Contract between the Town and Tarrant County Elections; and WHEREAS, Section85.004 of the Texas Election Code provides that the election order and the election notice must state the location of the mainearly voting polling place. Section 6 .The Denton County Elections Administrator, Frank Phillips, is hereby appointed as Denton County Early Voting Clerk for the Election. Deputy early voting judges/clerks will be appointed as needed to process early voting mail and to conduct early voting. Early voting by mail shall be conducted in conformance with the requirements of the Code. Ballot applications and ballots voted by mail shall be sent to: Early Voting Clerk, P.O. Box 1720, Denton, Texas 76202. The Elections Administrator and/or the Early Voting Clerk are hereby authorized to appoint the members of the Early Voting Ballot Board and the presiding judge and alternate judge in accordance with the requirements of the Code. Early voting by personal appearance shall be conducted at Exhibit “A” the times on the dates and at the locations designated on hereto. The Town Secretary of the Town, in consultation with the Town Attorney, ishereby authorized and directed to take any and all actions necessary to comply with the provisions of the Code and the Federal Voting Rights Act in carrying out and conducting the Election, whether or not expressly authorized herein. Section 9. It is hereby declared to be the intent of the Board of Directors of the Trophy Club Crime Control and Prevention District that the phrases, clauses, sentences, paragraphs, and sections of this Orderare severable, and if any phrase, clause, sentence, paragraph, or section of this Ordershall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this Order, since the same would have been enacted by the Board of Directorswithout incorporation of any such unconstitutional phrase, clause, sentence, paragraph, or section.
