TOWN COUNCIL SPECIAL SESSION MINUTES
MONDAY,JANUARY 28,2019,9:00 A.M.
LOCATION: 1 TROPHY WOOD DRIVE,TROPHY CLUB,TEXAS
COUNCIL CHAMBERS
The Town Council of the Town of Trophy Club,Texas, met in a Special Session on Monday,January 28, 2019. The
meeting was held within the boundaries of the Town and was open to the public.
TOWN COUNCIL MEMBERS PRESENT:

Eric Jensen Council Member, Place 2
Tim Kurtz Council Member, Place 4

TOWN COUNCIL MEMBERS ABSENT:

Mayor Sanders announced the date of Monday,January 28,2019,called the Town Council to order and announced
a quorum at 9:00 a.m.
CITIZEN PRESENTATIONS
This is an opportunity for citizens to address the Council on any matter whether or not it is posted on the agenda.
The Council is not permitted to take action on or discuss any presentations made to the Council at this time
concerning an item not listed on the agenda. The Council will hear presentations on specific agenda items prior to
the Council addressing those items. You may speak up to four (4) minutes or the time limit determined by the
Mayor or presiding officer. To speak during this item you must complete the Speaker's form that includes the
topic(s)of your statement. Topics of presentation should be limited to matters over which the Council has authority.
There were no citizen presentations.
SPECIAL SESSION
1. Consider and take appropriate action regarding accepting the resignation of Rhylan Rowe,Council Member
Place No.3(Mayor Sanders and Mayor Pro Tern Shoffner).
Motion:
Motion made by Mayor Sanders, seconded by Council Member Jensen, to accept the resignation of Rhylan Rowe,
Council Member Place No.3.
Motion carried unanimously 5-0-0.
2. Consider and take appropriate action regarding an Ordinance of the Town of Trophy Club ordering and
calling a Special Election to be held on May 4, 2019 for the purpose of electing one (1) Councilmember to
Place No. 3 on the Trophy Club Town Council for the remainder of an unexpired term (expiring in May
2021); providing for canvassing of returns; providing for a runoff election as necessary;adopting provisions
relative to publication and other matters necessary to conduct the election;and providing an effective date
(Mayor Sanders and Mayor Pro Tem Shoffner).
Main Motion:
Main Motion made by Mayor Sanders, seconded by Council Member Jensen, to approve Ordinance No. 2019-03,
ordering and calling a Special Election to be held on May 4, 2019 for the purpose of electing one (1)
Councilmember to Place No. 3 on the Trophy Club Town Council for the remainder of an unexpired term (expiring
in May 2021); providing for canvassing of returns; providing for a runoff election as necessary;adopting provisions
relative to publication and other matters necessary to conduct the election; and providing an effective date of
January 28,2019.
Mayor Pro Tern Shoffner inquired what the cost estimate would be to hold the Special Election. Town Secretary
Fimbres responded that the Special Election would cost approximately $2,000, since the Town would already be
holding a General Election.
Motion to Amend:
Motion to Amend made by Mayor Pro Tem Shoffner, seconded by Council Member Jensen, to direct the Council
Finance Subcommittee to locate the funds in the Fiscal Year 2018 Budget to pay for any associated cost for the
Special Election.
Mayor Sanders did not believe that the Motion to Amend was in order for this particular item because it was
merely for the calling of the Special Election.
Town Attorney Dodd commented that he believed the cost would be addressed when the contract with Denton
and Tarrant County Elections was considered.
Mayor Pro Tern Shoffner challenged the Chair's ruling.
Mayor Sanders relinquished the Chair to Council Member Kurtz.
Council Member Kurtz called for the vote on the challenge of the Chair's ruling that the Motion to Amend was not
in order for this particular item because it was merely for the calling of the Special Election.
Challenge of the Chair's ruling failed for lack of majority 2-3-0 with Mayor Pro Tem Shoffner and Council
Member Jensen voting in favor,and with Mayor Sanders and Council Members Kurtz and Lamont voting against.
The vote for the Main Motion was taken, to approve Ordinance No. 2019-03, ordering and calling a Special
Election to be held on May 4,2019 for the purpose of electing one(1)Councilmember to Place No.3 on the Trophy
Club Town Council for the remainder of an unexpired term (expiring in May 2021); providing for canvassing of
returns; providing for a runoff election as necessary; adopting provisions relative to publication and other matters
necessary to conduct the election;and providing an effective date of January 28,2019.
Main Motion carried unanimously 5-0-0.
ADJOURN
Mayor Sanders adjourned the meeting at 9:03 a.m.
