Minutes ZBA 10/10/2019 1 Trophy Wood Drive T;C--t Town of Trophy Club Trophy Club,Texas 76262 TOWN OF TROPHY Meeting Minutes CLUB Zoning Board of Adjustment (ZBA) October 10,2019 6:00 PM Council Chambers CALL TO ORDER AND ANNOUNCE A QUORUM Chairman Opipare called to order the Zoning Board of Adjustment meeting for Thursday, October 10, 2019, at 6:00 p.m. and announced a quorum. Board Members Present: Chairman Louis Opipare, Jr. Secretary John Murtaugh Board Member Jeff Sims Board Member Doug Harper Alternate Board Member Jack Ormond Board Members Absent: Board Member Sean Cannon Staff and Guests Present: Tommy Uzee Director of Community Development Lisa Payne Town Planner Sharon David Recording Secretary/Records Analyst CITIZEN PRESENTATIONS Citizens are allowed four(4) minutes to address the Board regarding an item over which the Board has policy or oversight authority as provided by Texas law, the ethics order, or other policy order. Chairman Opipare asked if there were any public requests to speak. No public requests were submitted. REGULAR SESSION 2019-490-T Nomination and Election of Vice-Chairman Board Member Ormond moved to nominate Board Member Sims as Vice Chairman, seconded by Secretary Murtaugh. Chairman Opipare called for a vote. The motion passed unanimously 5-0. 2019-491-T Nomination and Election of Secretary Vice Chairman Sims moved to nominate John Murtaugh as Secretary, seconded by Board Member Ormond. Chairman Opipare called for a vote. The motion passed unanimously 5-0. 1 2019-492-T Case ZBA-19-002 (6 Hanna Court) a. Conduct a Public Hearing regarding a request for a variance to allow a proposed building addition to exceed the maximum building coverage of a lot, and a request for a variance to allow a proposed building addition to encroach on the rear yard setback generally located north of Hanna Court and approximately 410 feet east of Trophy Wood Drive. b. Consider and take appropriate action regarding a request for a variance to allow a proposed building addition to exceed the maximum building coverage of a lot, and a request for a variance to allow a proposed building addition to encroach on the rear yard setback, generally located north of Hanna Court and approximately 410 feet east of Trophy Wood Drive. Town Planner Payne provided the staff report and was available for questions. Don Detrich resides at 6 Hanna Court and provided a detailed presentation for the proposed enclosed patio. Board Members and the applicant discussed drainage solutions, mosquito abatement, and the overall lot coverage. Terry Detrich resides at 6 Hanna Court and reported their lot is the smallest on Hanna Court and the neighbors to the right have an enclosed patio, but are on a larger lot. Board members, staff and the applicant discussed what counts toward lot coverage, building code review and what neighbors have in their yards. Board Member Harper made a motion, seconded by Secretary Murtaugh, to approve the building coverage variance. Chairman Opipare called for a vote. The motion passed 4-1, with Board Member Harper being the dissenting vote. Board Member Harper made a motion to deny the building encroachment, but it failed for lack of a second. Secretary Murtaugh made a motion, seconded by Board Member Ormond, to approve the building encroachment. Chairman Opipare called for a vote. The motion passed 4-1, with Board Member Harper being the dissenting vote. 2019-493-T Case ZBA-19-003 (102 Summit Cove) Consider and take appropriate action regarding a request for a special exception to allow a fence to encroach on the side yard setback, generally located on the northwest corner of Summit Cove and Municipal Drive. Town Planner Payne provided the staff report and was available for questions. Ron Lewis, with Buzz Custom Fence, explained that there was a waiver for the previous fence and he is requesting a special exception in order to change the fencing material and rebuild the fence in the same location. Board Members, staff and the applicant discussed how much the location of the fence affects the backyard, the conditions of the previous waiver, and the specifications of the new fence. 2 Vice Chairman Sims made a motion, seconded by Board Member Ormond, to approve the request for a special exception to allow a fence to encroach on the side yard setback. Chairman Opipare called for a vote. The motion passed unanimously 5-0. 2019-320-T Consider and take appropriate action regarding the July 11, 2019 Zoning Board of Adjustments minutes. Chairman Opipare asked if there were any additions or corrections to the minutes. There were none. Chairman Opipare asked for a motion. Vice Chairman Sims moved to approve the July 11, 2019 minutes as written, with a second by Secretary Murtaugh. Chairman Opipare called for a vote. The motion passed unanimously 5-0. ADJOURN Chairman Opipare asked for a motion. Motion made by Secretary Murtaugh to adjourn, seconded by Board Member Ormond. Motion passed unanimously.
