Minutes P&Z 04/20/1989 - Joint Public HearingMINUTES OF JOINT PUBLIC HEARING TOWN COUNCIL AND PLANNING AND ZONING COMMISSION TROPHY CLUB, TEXAS STATE OF TEXAS ) COUNTY OF DE:NTON ) The Town Council and Planning and Zoning Commission for the Town of Trophy Club met for a Joint Public Hearing on Thursday, April 20th, 1989 at 7:00 P.M. The meeting was held at the Municipal Utility District Building, 100 Municipal Drive, Trophy Club. The meeting was held within the. Town boundaries and was open to the Public. Also present were members of the Staff: Dan Boutwell John Hill. Donna Welsh Jill Fiasconaro CALL TO ORDER Town Planner Town Attorney Town Secretary P & Z Secretary Mayor Carter called the meeting to order at 7:00 P.M. noting a quorum present with the Town Council and Planning and Zoning Commission. INVOCATION Mayor Pro Tem Vance gave the invocation. PLEDGE OF ALLEGIANCE Council Member Martignago led in the Pledge of Allegiance. PAGE 2 - JOINT PUBLIC HEARING 4/20/89 THE TOWN COUNCIL AND PLANNING AND ZONING COMMISSION TO CONDUCT A JOINT PUBLIC HEARING ON THE REZONING OF A CERTAIN TRACT OF LAND KNOWN AS THE PLANTATIONS AT TROPHY CLUB, OWNED BY MR. HENRY SEALS (TRUSTEE), LOCATED WITHIN THE TOWN. Chairman Hamper stated the Planning and Zoning Commission held a Special Meeting on April 6th, 1989 for which a presentation was made on the rezoning request of the Plantation Apartments. Chairman Hamper asked Dan Boutwell to briefly report his findings on the proposal. A copy of Dan Boutwell's report is filed with the minutes of this meeting. Pat Atkins with Don Tipton Engineering gave a brief presentation to the Town Council and Planning and Zoning Commission. Mr. Atkins explained the property was an existing developed tract containing multi -family units which at the present time is non -conforming to the existing zoning of R-7.5 Single Family Residential. Mayor Carter and Chairman Hamper asked for public comment at this time. There was no Public input. Commissioner Hiestand made a motion to close the Public Hearing on the above referenced property. Commissioner Kardish seconded the motion. Motion carried unanimously. PLANNING AND ZONING COMMISSION TO CONSIDER ACTION AND MAKE RECOMMENDATION TO TOWN COUNCIL WITH RESPECT TO THE REZONING CASE, AS OUTLINED ABOVE. Commissioner Hiestand made a motion to recommend to the Town Council the Plantations at Trophy Club be rezoned as a Planned Develooment District with Dan Boutwells recommendations. Co -Chairman Booker seconded the motion. Motion carried unanimously. Council Member Martignago made a motion to close the Public Hearing. Council Member Hallgren seconded the motion. Motion carried unanimously. TOWN COUNCIL. TO CONSIDER ACTION WITH RESPECT TO THE REZONING CASE, AS OUTLINED ABOVE. Mayor Pro Tem Vance made a motion to approve the rezoning of the Plantations at Trophy Club as recommended by the Planning and Zoning Commission. Council Member Doran seconded the motion. Motion carried unanimously. PAGE 3 JOINT PUBLIC HEARING 4/20/89 TOWN COUNCIL AND PLANNING AND ZONING COMMISSION TO CONDUCT A PUBLIC HEARING ON THE INITIAL ZONING OF CERTAIN TRACTS OF LAND LOCATED WITHIN THE TOWN AND OWNED BY THE FOLLOWING DEVELOPER: A)INDEPENDENT AMERICAN: 10 ACRES, PROPOSED ZONING P.D. B)INDEPENDENT AMERICAN: 4.3 ACRES, PROPOSED ZONING P.D. C)INDEPENDENT AMERICAN: 2.1 ACRES, PROPOSED ZONING P.D. D)BASS LAND COMPANY: 16 ACRES, PROPOSED ZONING R-12 E)INDEPENDENT AMERICAN: 5.6 ACRES, PROPOSED ZONING R-12 F)INDEPENDENT AMERICAN: 3.3 ACRES, PROPOSED ZONING R-12 Mr. Craig Curry of the Nelson Corporation was present to represent Independent American on their properties. Mr. Curry stated the original zoning request was for straight Commercial Zoning and the Planning and Zoning Commission requested Planned Development Districts on the above referenced properties. Since then, Independent American has submitted applications for Planned Development Districts but did not have Site Plans prepared for review. Mr Curry requested Independent American be allowed to combine Trophy Club Place and Summit Place as one P.D. in order to comply with the requirements of the Comprehensive Zoning Ordinance that requires a minimum of 5 acres per Planned Development. Residents spoke against the Zoning or any development on side of Trophy Club Drive at residents are as Follows: Marty Sack Connie Moody Kathy Herigodt Kendra Boyd Fred Gomez Pete Reuss (letter) request for Commercial General the 10 acre tract on the east the front entrance. Those 116 Summit Cove Drive 1.110 Berkshire Court 1124 Sunset Drive 301 Inverness Drive 1122 Sunset Drive 4 Straight Creel: Court PAGE 4 JOINT PUBLIC HEARING 4/20/89 Chairman Hamper explained to the residents the Planned Development Zoning District would give the Town more control then straight zoning the properties in question. A Planned Development District requires site plan approval prior to platting or developing the property. Commissioner Hiestand made a motion to continue the Public Hearing on items A,B,C AND F to June 15th, 1989 at 7 P.M. Commissioner Kardish seconded the motion. Motion carried with a vote of 3 to 1. Commissioner Elliott opposed the motion. Council Member Martignago made a motion to continue the Public Hearing on items A,B,C, AND F to June 15th, 1989 at 7:00 P.M. Council Member Hallgren seconded the motion. Motion carried unanimously. Commissioner Kardish made a motion to conduct a Public Hearing on items D AND E. Commissioner Hiestand seconded the motion. Motion carried unanimously. Council Member Doran made a motion to conduct a Public Hearing on items D AND E. Mayor Pro Tem Vance seconded the motion. Motion carried unanimously. With no comments from the Public, Co -Chairman Vance made a motion to close the Public Hearing on items D AND E. Commissioner Kardish seconded the motion. Motion carried unanimously. Council Member Doran made a motion to close the Public Hearing on items D AND E. Council Member Martignago seconded the motion. Motion carried unanimously. Co -Chairman Booker made a motion to approve and recommend to the Council item D (16 Acres) be zoned R-12. Commissioner Kardish seconded the motion. Motion carried unanimously. Mayor Pro Tem Vance made a motion to accept the recommendation of the Planning and Zoning Commission to zone the 16 acre tract R-12. Council, Member Martignago seconded the motion. Motion carried unanimously. Co -Chairman Booker made a motion to approve and recommend to the Council item E (5.6 Acres) be zoned Commercial Recreational. Commissioner Kardish seconded the motion. Motion carried unanimously. PAGE 5 JOINT PUBLIC HEARING 4/20/89 Council Member Martignago made a motion to accept the recommendation of the Planning and Zoning Commission to zone item E (5.6 Acres) Commercial Recreational.
