Minutes P&Z 07/07/1994 - Joint Public HearingMINUTES OF TOWN COUNCIL MEETING/PUBLIC HEARING TOWN OF TROPHY CLUB TROPHY CLUB, TEXAS THE STATE OF TEXAS COUNTY OF DENTON The Town Council of the Town of Trophy Club, Texas met in a Public Hearing with the Planning and zoning Commission, followed by a Town Council Meeting on Thursday, July 7, 1994. The meeting was held within the boundaries of the Town and was open to the Public. Jim Carter Doug Glaspell Gene Hill Patti Stoltz Mayor Council Member Mayor Pro Tem Council Member Council member Marshall Engelbeck and Cotton Moore were unable to attend the meeting. Planning and zoning Commission Mike Hamper Don Cotton Tom Mayfield Bob Paige David Schaaf Roger Williams Chairman Commissioner Commissioner Commissioner Commissioner Commissioner Commissioner Vance Booker was unable to attend the meeting. Also present were guests and staff members: John Hill Town Attorney Dan Boutwell Town Planner Pauline Shaw Director of Public Works Karen Sadri Town Secretary CALL TO ORDER Mayor Carter called the meeting to order at 7:00 p.m. noting a quorum was present. He then welcomed council Members, Planning and Zoning Commissioners, guests and staff. INVOCATION An Invocation was given by Dan Boutwell, Town Planner. PLEDGE OF ALLEGIANCE TO THE AMERICAN AND TEXAS FLAGS The pledge of allegiance to the American and Texas Flags was led by Council Member Patti Stoltz. Mayor Pro Tem Hill moved to adopt an Ordinance to instruct and direct the Town staff to take all necessary legal steps to call a joint public hearing of the Town Planning and Zoning Commission and Town Council for the purposes of (I) consider certain amendments to the Town's Comprehensive Zoning Ordinance, Ordinance No. 91-01, as amended, and (II) consider the adoption of an ordinance combining the Comprehensive Zoning Ordinance and all amendments thereto into one ordinance for purposes of ease of use and without substantive change; providing an effective date. Council Member Glaspell seconded, motion passed unanimously. Mayor Carter then turned Chairman Hamper for the Planning and Zoning Commission to open their meeting. PLANNING AND ZONING COMMISSION TO CONDUCT A PUBLIC HEARING JOINTLY WITH THE TOWN COUNCIL, TO CONSIDER THE FOLLOWING: A. AMENDING ORDINANCE NO. 91-01 OF THE TOWN, THE SAME BEING THE COMPREHENSIVE ZONING ORDINANCE, BY AMENDING THE TEXT OF THE COMPREHENSIVE ZONING ORDINANCE, ORDINANCE NO. 91-01, AS SET FORTH AND DESCRIBED IN THE PUBLIC NOTICE OF THE PUBLIC HEARING ATTACHED HERETO. B. COMBINING INTO ONE ORDINANCE, WITHOUT SUBSTANTIVE CHANGE, ORDINANCE NO. 91-01 OF THE TOWN AND ALL AMENDMENTS THERETO (BEING ORDINANCE NOS. 91-01A, 91- 01B, 91-01C, 91-01D, 91-01E, 91-01F, 91 -OIG AND 91- 01H), THE SAME BEING THE COMPREHENSIVE ZONING ORDINANCE. Chairman Hamper opened the meeting noting a quorum and explained the issues before the meeting. He noted on June 2, a workshop was held with several builders and homeowners. Commissioner Schaaf made a motion to open the Public Hearing for the Planning and Zoning Commission. Commissioner Mayfield seconded; motion passed unanimously. AMENDING ORDINANCE NO. 91-01 OF THE TOWN, THE SAME BEING THE COMPREHENSIVE ZONING ORDINANCE, BY AMENDING THE TEXT OF THE COMPREHENSIVE ZONING ORDINANCE, ORDINANCE NO. 91-01, AS SET FORTH AND DESCRIBED IN THE PUBLIC NOTICE OF THE PUBLIC HEARING ATTACHED HERETO. B. COMBINING INTO ONE ORDINANCE, WITHOUT SUBSTANTIVE CHANGE, ORDINANCE NO. 91-01 OF THE TOWN AND ALL AMENDMENTS THERETO (BEING ORDINANCE NOS. 91-01A, 91- 018, 91-01C, 91-01D, 91-01E, 91-01F, 91-01G AND 91- 01H), THE SAME BEING THE COMPREHENSIVE ZONING ORDINANCE. Mayor Pro Tem Hill made a motion to open the Public Hearing for the Town Council. Council Member Stoltz seconded; motion passed unanimously. Chairman Hamper asked if anyone wished to speak to the amendments. Mr. Matt Speight with Sandlin Homes, stated the changes to the ordinance were exceptionally fair and much needed. He had met with the Planning and Zoning Commission and discussed the concerns of the builders. Mr. Speight complemented the Planning and Zoning Commission. Mr. Lance White of White Castle Homes also agreed with Mr. Speight and was delighted with the changes which kept the Town's objectives and added flexibility to the Ordinance. He also thanked everyone. PLANNING AND ZONING COMMISSION TO CLOSE THE PUBLIC HEARING OR CONTINUE THE SAME TO A DATE CERTAIN. There being no one else signed up to speak, Commissioner Cotton made a motion to close the Public Hearing. Commissioner Williams seconded; motion passed unanimously. TOWN COUNCIL TO CLOSE THE PUBLIC HEARING OR CONTINUE THE SAME TO A DATE CERTAIN. Council Member Glaspell made a motion to close the Public Hearing for the Town Council. Chairman Hamper walked the Council and Planning and Zoning Commission through the amendments presented. A discussion was held regarding side yard setbacks and a few various areas. Chairman Hamper requested the Town Attorney, John Hill include the changes in Section 37 and Section 38 into the Ordinance showing those changes. Commissioner Schaaf made a motion recommending to the Town Council that the Council adopt the Ordinances as presented and amended. Commissioner Paige seconded; motion passed unanimously. TOWN COUNCIL TO CONSIDER ADOPTING AN ORDINANCE COMBINING INTO ONE ORDINANCE, WITHOUT SUBSTANTIVE CHANGE, ORDINANCE NO. 91- 01 OF THE TOWN AND ALL AMENDMENTS THERETO (BEING ORDINANCE NOS. 91-01A, 91-01B, 91-01C, 91-01D, 91-01E, 91-01F, 91-01G AND 91-01H), THE SAME BEING THE COMPREHENSIVE ZONING ORDINANCE. Mayor Pro Tem Hill commended the Planning and Zoning Commission on a fine job once again. He then made a motion to accept the recommendations of the Planning and Zoning Commission and adopt both ordinances as presented with amendments. This letter is being sent to you because the regulations relating to garage requirements in the zoning district in which your property is located are being amended to require that each residence have a garage with a minimum interior measurement of 21 by 22 feet, and that all detached garages have the same minimum interior measurement. Residences and garages in existence on the day of the amendment, if adopted, will not be affected by the new regulation. The Joint Public Hearing will be conducted on July 7, 1994, at the Trophy Club Municipal Utility District Building, 100 Municipal Drive, Trophy Club, Texas, and will begin at 7:00 P.M. There is hereby authorized the renumbering and/or rearrangement of the articles, sections, paragraphs, sentences, phrases and words of the Comprehensive Zoning Ordinance for the purpose of effecting the amendments to the said Ordinance set forth herein; provided, however, that no such renumbering and/or rearrangement shall change the meaning or effect of any such part of the Comprehensive Zoning Ordinance. Such a renumbering and/or rearrangement is hereby deemed and found to be a non - substantive change to the Comprehensive Zoning Ordinance. Section 4. Saying . This Ordinance shall be cumulative of all other ordinances of the Town and shall not repeal any of the provisions of those ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this Ordinance; provided, however, that Ordinance Nos. 91-01, 91-01A, 91-01B, 91-01C, 91- 01D, 91-01E, 91-01F, 91-01G and 91-01H are hereby repealed in their entirety, such repeal to take effect as of the effective date of this Ordinance, but provided however that any complaint, action, cause of action or claim which prior to the effective date of this Ordinance has been initiated or has arisen under or pursuant to the said repealed Ordinances shall continue to be governed by the provisions of those Ordinances and for that purpose Ordinance Nos. 91-01, 91- 01A, 91-01B, 91-01C, 91-01D, 91-01E, 91-01F, 91-01G and 91-01H shall be deemed to remain and continue in full force and effect. It is further the intent hereof that, in the event the adoption of this Ordinance shall be found by a court of competent jurisdiction to be unlawful or 10 JUN -28-1994 16:28 COWLES & THOMPSON 214 670 1100 P.15i18 invalid for any reason, the said repealed ordinances shall not be repealed but shall thereafter continue in full force and be valid in their entirety. Section 4. Penally. It shall be unlawful for any person to violate any provision of this Ordinance, and any person violating or failing to comply with any provision of this Ordinance shall be fined, upon conviction, not less than One Dollar ($1.00) nor more than Two Thousand Dollars ($2,000.00), and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 5. Severability. If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance or application thereof to any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance, and the Town Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 6. Effective Date. This Ordinance shall become effective from and after its date of adoption and publication as required by law. Section 2. The Town Staff is directed to advertise for and give notice of the joint public hearing in as expeditious a manner as is legally possible, and to select a time and location for the public meeting at a public place that is the most reasonable to accommodate the citizens, and any and all actions taken by the Town Staff to give such notice of or prepare for the joint public hearing are hereby ratified.
