Minutes P&Z 04/18/1995 - Joint Public HearingMINUTES OF JOINT PUBLIC HEARING/TOWN COUNCIL MEETING TROPHY CLUB, TEXAS 0 THE STATE OF TEXAS COUNTY OF DENTON The Town Council of the Town of Trophy Club, Texas met in a Joint Public Hearing with the Planning and Zoning Commission on Tuesday, April 18, 1995. The meeting was held within the boundaries of the Town and was open to the Public. Council Members Present: Jim Carter Mayor Marshall Engelbeck Council Member Doug Glaspell Council Member Gene Hill Mayor Pro Tem Cotton Moore Council Member Patti Stoltz Council Member Planning and Zoning Commission Members Present: Mike Hamper Vance Booker Don Cotton Tom Mayfield Bob Paige Chairman Co -Chairman Commissioner Commissioner Commissioner Commissioners Williams and Schaaf were unable to attend. Also present were guests and staff members: Donna Welsh Town Manager John Hill Town Attorney Pauline Shaw Planning & Zoning Administrator Bill LeGrand Director of Public Works Dan Boutwell Town Planner Town Treasurer, Jack Jacobs, was unable to attend. CALL TO ORDER Mayor Carter called the meeting to order at 7:05 p.m. noting a quorum was present. He then welcomed Council Members, Commissioners, staff and guests. INVOCATION An Invocation was given by Council Member Moore. PLEDGE OF ALLEGIANCE TO THE AMERICAN AND TEXAS FLAGS The pledge of allegiance to the American and Texas Flags was led by Council Member Glaspell. Page 2, Joint Public Hearing/Town Council Meeting, 04/18/95 Mayor Carter then announced that the United Way of Tarrant County was honoring Mike Hamper this Thursday night as Trophy Clubs Volunteer of the Year. PUBLIC HEARING TOWN COUNCIL TO CONTINUE A PUBLIC HEARING JOINTLY WITH THE PLANNING AND ZONING COMMISSION, WHICH JOINT PUBLIC HEARING WAS CONTINUED FROM MARCH 21, 1995, TO CONSIDER THE FOLLOWING: A. AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS APPROVING A SITE PLAN FOR CHURCH PURPOSES FOR THAT PROPERTY ZONED R-12 SINGLE FAMILY DISTRICT AND LOCATED GENERALLY ALONG THE WEST SIDE OF TROPHY CLUB DRIVE BETWEEN STATE HIGHWAY 114 AND INDIAN CREEK DRIVE AND AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED HERETO AND INCORPORATED HEREIN. At 7:07 p.m. Chairman Hamper opened the Planning and Zoning meeting and noted a quorum was present. He then stated the site plan was submitted some time ago and was being continued due to the lack of information and material provided by the applicant. Chairman Hamper called for a motion to open the joint public hearing. Commissioner Mayfield made a motion to open the joint public hearing as outlined on the agenda for the Planning and Zoning Commission. Commissioner Cotton seconded; motion passed unanimously. Then Mayor Pro Tem Hill made a motion to call the same meeting for the Town Council. Council Member Glaspell seconded; motion passed unanimously. Chairman Hamper requested Dan Boutwell update the meeting on the site plan. Mr. Boutwell noted all of the requirements were satisfactorily addressed. The Town's engineers comments were cosmetic in nature and have been addressed. Ms. Shaw commented the dumpster was removed. Mr. Bob Paige spoke for the church. He requested the parking lot for the church be of asphalt rather than concrete. This would be an approximate savings of $35,000 to the church. He also stated the concrete was excessive engineering. Chairman Hamper questioned Mr. Paige regarding the type of shrub to be used along the parking lot. Wax myrtle four feet high was the answer. Page 3, Joint Public Hearing/Town Council Meeting, 04/18/95 TOWN COUNCIL TO CLOSE THE JOINT PUBLIC HEARING AND/OR CONTINUE TO A DATE CERTAIN. There being no one wishing to speak at the public hearing, commissioner Booker made a motion to close the joint public hearing. commissioner Cotton seconded; motion passed unanimously. Mayor Pro Tem Hill then made a motion to close the Joint Public Hearing. Council Member Moore seconded; motion passed unanimously. TOWN COUNCIL/PLANNING AND ZONING COMMISSION TO RECONVENE INTO JOINT PUBLIC SESSION. Commissioner Mayfield made a motion to reconvene into joint session. Commissioner Cotton seconded; motion passed unanimously. Mayor Pro Tem Hill then made the motion for the Town Council to reconvene into joint session. Council Member Glaspell seconded; motion passed unanimously. TOWN COUNCIL TO CONSIDER AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS APPROVING A SITE PLAN FOR CHURCH PURPOSES FOR THAT PROPERTY ZONED R-12 SINGLE FAMILY DISTRICT AND LOCATED GENERALLY ALONG THE WEST SIDE OF TROPHY CLUB DRIVE BETWEEN STATE HIGHWAY 114 AND INDIAN CREEK DRIVE AND AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "All ATTACHED HERETO AND INCORPORATED HEREIN. Chairman Hamper responded to the question of asphalt vs concrete by stating the elementary school, day care, baptist church, municipal building, and sales office all have concrete parking lots. Trinity Learning center requested asphalt and was turned down. He felt concrete is best. Commissioner Mayfield made a motion to recommend the Town Council consider an ordinance to approve the site plan including concrete parking lot and signage for the United Fellowship Methodist Church. Commissioner Booker seconded; motion passed unanimously. After a discussion on asphalt vs concrete relative to the parking lot for the church, Mayor Pro Tem Hill made a motion to adopt the site plan and ordinance as recommended by the Planning and Zoning Commissioners. Council Member Glaspell seconded; motion passed unanimously. ADJOURN JOINT PUBLIC SESSION WITH PLANNING AND ZONING COMMISSION. There being no further business to discuss, Commissioner Cotton made a motion to adjourn the joint session at 7:45 p.m. Commissioner Booker seconded; motion passed Page 4, Joint Public Hearing/Town Council Meeting, 04/18/95 unanimously. Chairman Hamper said he has heard comments from people that the Planning and Zoning Commission does not make public its meetings. He implored the meeting participants and audience to take back to their friends and neighbors that all Planning and Zoning meetings are public and he invites everyone to attend those meetings. Representing the Town Council, Mayor Pro Tem Hill then made a motion to adjourn the joint meeting. Council Member Moore seconded; motion passed unanimously. END OF JOINT SESSION WITH THE PLANNING AND ZONING COMMISSION TWO MINUTE RECESS TOWN COUNCIL MEETING CONSENT AGENDA Mayor Carter asked if any member of the Town Council wished to remove any item from the Consent Agenda for full discussion. No one responded. Council Member Glaspell then made a motion to approve the consent agenda. Mayor Pro Tem Hill seconded; motion passed unanimously with Council Member Stoltz abstaining from item A. The approved items are as follows: A. Minutes of the March 21, 1995 Joint Public Hearing with Town Council/Planning and Zoning Commission. B. Financial Reports Ending 03/31/95 PRESENTATIONS BY CITIZENS No presentations were given. STAFF AND COMMITTEE REPORTS Town Manager, Donna Welsh reported that the 10th Anniversary party is April 30th from 1-4 p.m. at Harmony Park. She then noted that on May 2nd the Chamber of Commerce will sponsor Meet The Candidates Night at the Marriott Solana at 6 p.m. for dinner. Planning and Zoning Administrator, Pauline Shaw reported on 72 new housing starts for fiscal year 1995-96. Forty eight of those were begun since January 1. Page 5, Joint Public Hearing/Town Council Meeting, 04/18/95 PRESENTATIONS BY COUNCIL Mayor Carter introduced all candidates. Council Member Stoltz reminded everyone of the 10th anniversary party. Council Member Engelbeck remarked on a possible new ordinance regarding weeds and changing height to six inches. He also requested each council member read "Death of Common Sense." CLOSED -DOOR SESSION: TOWN COUNCIL TO CONDUCT A CLOSED -DOOR SESSION TO RECEIVE ADVICE FROM TOWN ATTORNEY REGARDING PENDING LITIGATION (CONDEMNATION SUIT), TOWN OF TROPHY CLUB VERSUS TROPHY JOINT VENTURE, CASE CV -95-00155-C. Town Council convened a closed -door session at 7:57 p.m. RECONVENE INTO OPEN SESSION: Town Council reconvened into open session at 8:21 p.m. No action was taken. ADJOURN Mayor Pro Tem Hill made a motion to adjourn the meeting at 8:25 p.m. and to reconvene on Tuesday, May 9th, 1995. Council Member Engelbeck seconded; motion passed unanimously.
