Minutes P&Z 05/18/1995MINUTES OF REGULAR MEETING PLANNING AND ZONING COMMISSION TOWN OF TROPHY CLUB STATE OF TEXAS § COUNTY OF DENTON § The Planning and Zoning Commission for the Town of Trophy Club met in Regular Session on Thursday, May 18, 1995 at 7:00 P.M. The meeting was held at the Municipal Utility District Building, 100 Municipal Drive, Trophy Club, Texas. The meeting was held within the Town boundaries and was open to the Public. He then welcomed the Commissioners, staff and guests. CONSIDERATION OF MINUTES FORM THE MARCH 16, 1995 REGULAR MEETING, MAY 04, 1995 MEETING AND TAKE APPROPRIATE ACTION The Commissioners reviewed the minutes from the March 16, 1995 Regular Meeting. Commissioner Cotton made a motion to approve the minutes as presented and reviewed by the Commissioner for the March 16, 1995 Regular Meeting. Commissioner Mayfield seconded; motion passed unanimously. Commissioner Mayfield then made a motion to approve the minutes of the May 4, 1995 meeting as presented and reviewed by the Commissioners. Commissioner Schaaf seconded; motion passed unanimously. Page 2, P&Z Minutes from 5/18/95 KATHY & JOHN SEXTON OF 2 CREEKMERE DRIVE REQUEST THE USE OF MEEKER CEDAR SHINGLES FOR THEIR ROOF. TAKE APPROPRIATE ACTION. JIM & JODY PATNOE OF 215 OAKMONT DRIVE REQUEST THE USE OF WOOD SHINGLES ON THEIR ROOF. TAKE APPROPRIATE ACTION. Mr. Sexton addressed the Commissioners and explained that his roof was 11 years old and had recently been damaged by hail. He would like to re -roof his home with the Meeker Shingles. Mr, Randy Tallent with Guardian Roofing explained to the Commissioners the Meeker Shingle Product. He stated it was pressure impregnated with fire retardant chemicals and a grade one class C shingle. This shingle has passed fire test and weather test. Chairman Hamper stated that the Town was trying to eliminate all wood shingle roofs. He indicated that the present ordinance provides that a 30yr. Warranty is required before P&Z can approve these shingles. After a lengthy discussion the Commissioners agreed upon allowing Cedar Plus and FTX wood shingles due to the process used to pressure impregnate the shingles with fire retardant chemicals, and to comply with the present ordinance. Commissioner Williams made a motion to approve the use of FTX or Cedar Plus fire retardant class C grade 1 wood shingles, plus a signed copy of the warranty issued by the shingle company, for 2 Creekmere and 215 Oakmont Drive. Commissioner Paige seconded; motion passed with Commissioner Schaaf voting against. MR. PAUL COATES RESPECTFULLY REQUESTED PERMISSION TO ERECT A FENCE PARALLEL TO ANOTHER FENCE AT 15 CREEKMERE DRIVE. TAKE APPROPRIATE ACTION (FENCE ORDINANCE 92-06) Mr. Coates explained how the area behind his house has a bad drainage. This has been created over the years by the difference homes and landscaping of yards. He hopes he can prevent the parallel fence with cooperation of his neighbor. Ms. Shaw stated she had visited this area and there is indeed a drainage problem and most of the yards have parallel fences with a 3 to 5 foot wide drainage area between fences. This is a natural drainage area that runs into Timberline Creek. After the Commissioners discussed the situation Commissioner Cotton made a motion to approve the parallel fence on the west side of Mr. Coates property. Commissioner Williams seconded; motion passed unanimously. Page 3, P&Z Minutes from 5/18/95 REVIEW PRELIMINARY PLAT "LAKESIDE AT TROPHY CLUB" APPROXIMATELY 31.7 ACRES AND 111 LOTS OUT OF THE PD NORTH AND WEST OF LAKEVIEW ELEMENTARY Chairman Hamper requested Dan Boutwell to review his comments regarding the preliminary plat for Lakeside at Trophy Club. Mr. Boutwell covered the eleven items attached to and made a partof these minutes. After Mr. Boutwell's comments, the Commissioners covered the perimeter fence and their concern for it not being shown on the preliminary plat. They also requested a note regarding front entry garages (no more than two contiguous lots may have front entry attached garages on all lots less than 9,000 sq. ft.) on the preliminary plat. A general consensus of the Commissioners was to approve a final plat with stipulations that the engineers concerns were addressed; lake up -grade requirements were met; Trophy Club Drive would go north of new golf course instead of east; and Village Trail would continue to the east with a minimum radius curve into what is now shown as Durango Drive and additional land area be included in this platting to permit the curving of Village Trail. Commissioner Cotton made a motion to approve the preliminary plat with conditions and with exceptions of comment 1 1 of Mr. Boutwell comments and having Teague Nall engineering notes added to the preliminary plat. Commissioner Williams seconded; motion passed unaimously. OTHER BUSINESS There will be a public June 6, 1995 on Subdivision Regulations, Zoning Ordinance and replat of lot 108 Lake Forest Three. Boutwell, AICP - Planning Resources Group RE: Preliminary Plat of Lakeside at Trophy Club urban planning _ consultants = The above referenced plat consist of a preliminary plat of a 31.7 acre residential subdivision. The site was previously approved, as generally shown, as a residential planned unit development. Compliance with regulations and requirements adopted with the PD zoning action will be considered as the standard for review of the parcel. We have reviewed the above referenced project and offer the following comments and recommendations: Commemis_and--P evommead_a-OQats 1. Applicant must indicate the existing lots adjacent to the plat. In addition, the correct number of lots should be provided. 2. The alignment of existing Silver bock Drive is not accurately indicated. 3. The applicant must provide the first draft of the "deed restrictions" with the preliminary plat. 4. According to the conditions of the approved Planned Development, Trophy Club Drive was to be dedicated at the time the first phase of development were to occur. Prior to issuance of any building permit the right-of-way for Trophy Club Drive to the northern limit of the PD must be dedicated to the the Town. However, alignment for Trophy Club Drive is in the process of being revised. The new alignment must be honored. This will require dedication of full right-of-way for a portion of the distance and partial right-of-way for the remainder of the distance. The approximate total land area to be dedicated is generally the same. Zoning requirements of the Planned Development indicates that lots exceeding 9,000 sq.ft. must have rear or side entry garages. In order to enforce this requirement, the applicant must indicate the square footage of either all lots less than or greater than 9,000 sq.ft. 6. The "Lot Summary" table indicates a "typical lot size" of 8,400 sq.ft. The plan should also indicate that the minimum lot size is 8,400 sq.ft. 7. The PD, as approved, indicated that a perimeter fence running the entire length of the common border between Roanoke and Trophy Club will be constructed at the time of development of this area. The location and detail of this screening fence must be indicated on the preliminary plat. 8. According to agreements made at the time of approval of the final plat, the applicant agreed to effect repairs to the existing pond and dedicate the approximately 27 acres for public park at the time of platting of the first phase of the PD. Indication of this action must be provided on the plat. 9. The location of all proposed easements should be shown on the preliminary plat. Including the storm sewer easement that runs diagonally through lot 5 of block D. 10. All preliminary engineering plans must be approved by the City Engineer prior to submission of the final plat. 11. Although the PD was approved with the current alignment of Village Trail, compliance with the comprehensive plan would require Village Trail to continue to the east with a minimum radius curve into what is now shown as Durango Drive. This would also require that additional land area be included in this platting to permit the curving of Village Trail.
