Minutes P&Z 11/21/1996MINUTES OF REGULAR MEETING PLANNING AND ZONING COMMISSION TOWN OF TROPHY CLUB STATE OF TEXAS § COUNTY OF DENTON § The Planning and Zoning Commission for the Town of Trophy Club met in Regular Session on Thursday, November 21, 1996 at 7:00 P.M. The meeting was held at the Municipal Utility District Building, 100 Municipal Drive, Trophy Club, Texas. The meeting was held within the Town boundaries and was open to the Public. Chairman Hamper called the meeting to order at 7:00 P.M. noting a quorum was present. He then welcomed Staff and Guests. MR. STEVE FISCHER OF 14 STRAIGHT CREEK COURT TO MAKE A PRESENTATION TO THE PLANNING AND ZONING COMMISSION CONCERNING THE TEXAS NATIONAL BANK BUILDING SITE. Mr. Fischer did not attend the meeting. Ms. Shaw explained Mr. Fischer's concern with the shrubbery on the front of the berm at the bank building. He is also concerned with the height of the berm. Mr. Boutwell stated that the landscape shrubbery was not considered a sign. Chairman Hamper stated the landscape was checked and presented to the Commissioners and built to the landscape plan. PLANNING AND ZONING COMMISSION TO REVIEW DRAFT OF THE COMPREHENSIVE MASTER PLAN TEXT. Page 2, P&Z Mtg. 11/21/96 Mr. Dan Boutwell apologized that the draft was not ready for this meeting and he will provide the text in January. He did mention that the Park Plan had been received and approved by the Park Committee. PLANNING AND ZONING COMMISSION TO DISCUSS AMENDING ORDINANCE 92-09 CONCERNING SECTION 7A SCREENING OF RECREATIONAL VEHICLES AND TAKE APPROPRIATE ACTION. Chairman Hamper began by mentioning the ordinance needs amending in many ways. He then noted that Town cannot enforce deed restrictions and covenants. When the ordinance originated, we attempted to put into an ordinance as much of the deed restrictions as possible. I The Commissioners would like to see the following changes to the recreational vehicle ordinance: No truck, recreational vehicles, boats, or trailers may be placed or kept upon any property unless it is enclosed in a garage. Do not allow any permanent parking of recreational vehicles, boats or trailers within the Town for more than two (2) days per month. Commissioner Williams made a motion recommending the above changes to Ordinance 92-09. Commissioner Cotton seconded the motion; motion passed unanimously. The Commissioners believe there is no grandfather clause for non permanent items such as vehicles, trailers, motor homes, etc. If there is a conflict between an ordinance and deed restrictions, the more restrictive prevails. Chairman Hamper directed Ms. Shaw to meet with the Town's Attorney to rewrite this portion of the ordinance. PLANNING AND ZONING COMMISSION TO DISCUSS AMENDING ORDINANCE 95-24 BY ADDING SECTION TO STATE THAT ALL EXPOSED CONCRETE WILL BE 3000 PSI AND AIR ENTRAINED AND TAKE APPROPRIATE ACTION. Commissioner Hill moved to table this agenda item until further research from the engineers can be obtained. Commissioner Williams seconded; motion passed unanimously. PLANNING AND ZONING COMMISSION TO DISCUSS GATED COMMUNITIES Mr. Dan Boutwell summarized the information presented on gated communities. Gated Communities limit access to neighborhoods; increase safety - a selling factor (fortifying effect); socioeconomically - separates the haves from the have nots; they fragment the community - especially multiple gated communities; there is a public rights issue - roadway system - if it is Page 3, P&Z Mtg. 11/21/96 public you may not gate; retro fitting of gated communities - put a wall around area; criteria limited in size - not pertinent to every development to be a gated community; the Knoll and Fairway Village are good examples. The Villas are a limited access created in a Planned Development Ordinance. Commissioner Williams felt that we regulate Gated Communities through our PD process and do not need another ordinance for gated communities. Chairman Hamper stated that we want to recommend a policy approach to the Council. Commissioner Schaaf wanted to know if we have the ability to limit gated communities? Mr. Boutwell reported that gated communities can be addressed in the Planning Principles in the Comprehensive Plan and make them site specific, so gated communities will not fragment the community. ANY OTHER BUSINESS A. BRIAN ROSS REQUESTING APPROVAL TO USE VINYL FENCE FOR YARD AT 19 FAIR GREEN DRIVE AND TAKE APPROPRIATE ACTION. Chairman Hamper informed the Commissioners that the Town Council had agreed with the Commissioner's recommendation and appointed Rick Gilliland to the Commission. He also shared with the Commissioners that the Council appointed Gene Hill as Vice Chairman of the Commission. Chairman Hamper congratulated both Commissioners. Ms. Shaw reported the next meeting will be December 5 to approve the final plat for the Lakes. There was a consensus of the Commissioners not to regulate landscaping as signage. A. Ms. Debbie Grigsby provided the Commissioners with samples of the vinyl fencing. After Ms. Grigsby's presentation, the Commissioners requested further information. Several Commissioners were concerned with stark white fencing because the fence ordinance does not allow painted or color fencing. Several of the Commissioners feel this product is an improvement over the current wood fencing. Commissioner Hill made a motion to table this item until the December 5th meeting. Commissioner Reed seconded; motion passed unanimously. Page 4, P&Z Mtg. 11/21/96 ADJOURN There being no further business to discuss, Commissioner Cotton made a motion to closed the P&Z meeting at 9:15 p.m. Commissioner Williams seconded, motion passed unanimously.
