Minutes P&Z 10/16/1997MINUTES OF REGULAR SESSION TOWN OF TROPHY CLUB PLANNING AND ZONING COMMISSION October 16, 1997 The Planning and Zoning Commission of the Town of Trophy Club, Texas met in a regular session on October 16, 1997 at 7:00 P.M. in the Board Room, Trophy Club Administration Building, 100 Municipal Drive, Trophy Club, Texas 76262. COMMISSIONERS PRESENT: Mike Hamper Chairperson Donald Cotton Member Gene Hill Member Clayton Reed Member David Schaaf Member Roger Williams Member Rick Gilliland Member STAFF AND GUESTS PRESENT: Cathy Morgas P&Z Administrator Dan Boutwell Town Planner, MPRG DeAnne McKensie Planner, MPRG Gary Tomlin Reporter, 208 Fresh Meadow Dr. Chairperson Mike Hamper called the meeting to order at 7:00 p.m. announcing a quorum was present. DISCUSSION AND APPROPRIATE ACTION REGARDING DENTON COUNTY'S COMMUNICATION TOWER, TO BE LOCATED ON T.W. KING ROAD IN SOUTHLAKE: No action taken. Requestor for agenda item was not present for discussion with the Commissioners. Chairperson Mike Hamper spoke to the Commissioners as to the concern regarding the communications tower. Dan Boutwell, Town Planner, indicated that there is a Federal law that could pre-empt a city ordinance that shows support against the location of any communications tower. Page 2 Regular Session P&Z meeting October 16, 1997 DISCUSSION AND APPROPRIATE ACTION REGARDING WORDING CHANGES TO ZONING ORDINANCE #94-09, SECTION 35 (DELETION OF RESTRICTIONS ON PLAYHOUSES AND ALL PLAY EQUIPMENT): All playhouses, play equipment and play structure references are to be removed from Section 35 of Ordinance #94-09. A structure covered which is on top of any play equipment will not be considered a play house. A playhouse is restricted to 100 square feet or less. Change Town Planning and Zoning Administrator to Building Official and then an appeal is to go to the P&Z Administrator. Commissioner Hill moved to approve the above recommended changes and the revisions to the Ordinance as outline by the Planner. Commissioner Williams seconded; motion carried unanimously. DISCUSSION AND APPROPRIATE ACTION REGARDING WORDING CHANGES TO ORDINANCE #95-16 (FENCE ORDINANCE): Bill Pollick, Code Enforcer, asked for clarification on some issues he had with enforcing the fence ordinance. Following discussion with the Commission, the following items were clarified: 0 1 or 2 panels being replaced does not fall under definition of major repair o smooth side out for fence replacement will stand—permittee is the determining factor on smooth side out. Commissioner Hill moved to amend the fence ordinance #95-16 as recommended by Attorney John Hill, but keeping with the idea of smooth side must always be out and no parallel fence closer than 20 feet from another fence. Commissioner Reed seconded; motion carried unanimously. DISCUSSION AND APPROPRIATE ACTION REGARDING THE DEFINITION TO ABOVE GROUND SWIMMING POOL ORDINANCE #95-12: Bill Pollick asked the Commissioners for clarification on the definition of an above ground pool. As described in Ordinance #95-12, Section 2-C, "Above Ground Swimming Pool" shall mean any structure, basin, chamber or tank containing an artificial body of water needing external buttresses for use or intended use........ The intent of this ordinance relating to above ground swimming pools is difficult to enforce since a number of above ground pools are being made without the use of buttresses, yet would normally be classified as an above ground swimming pool. The Commissioners stated that the original intent of the ordinance was to eliminate above ground pools and will recommend to the Council that the ordinance be changed to allow for any above ground pools under 1000 cubic feet in size. Page 3 Regular Session P&Z meeting October 16, 1997 DISCUSSION AND APPROPRIATE ACTION REGARDING WORDING CHANGES TO ORDINANCE #95-11, SECTION 5 - POLITICAL SIGNS: Following discussion with Dan Boutwell, Town Planner, Commissioner Williams moved to recommend to the Town Council the changes to Ordinance #95-11, Section 5 - Political Signs as indicated by Dan Boutwell in his memorandum dated October 16, 1997. Commissioner Gilliland seconded; motion carried unanimously. REVIEW AND APPROVE MINUTES FROM AUGUST 5,1997: Following discussion, Commissioner Cotton moved to approve the minutes for August 5, 1997. Commissioner Reed seconded; motion carried unanimously. OTHER MATTERS: Next meeting will be a joint public hearing with the Town Council on Tuesday, October 21, 1997. An annual review will be made of the Zoning Ordinance, Comprehensive Land Use Plan and the Subdivision Regulations by the Commission. Dan Boutwell, Town Planner, is to complete an annual review of the Zoning Ordinance, Comprehensive Land Use Plan and Subdivision Regulations and bring to the Commission any recommendations for changes.
