Minutes P&Z 04/16/1998MINUTES OF REGULAR SESSION TOWN OF TROPHY CLUB PUNNING AND ZONING COMMISSION April 16, 1998 The Planning and Zoning Commission of the Town of Trophy Club, Texas met in a Special Session/Workshop Session on April 16, 1998 at 7:00 P.M. in the Board Room, Trophy Club Administration Building, 100 Municipal Drive, Trophy Club, Texas 76262. COMMISSIONERS PRESENT: Mike Hamper Chairperson Gene Hill Member Rick Gilliland Member David Schaaf Member COMMISSIONERS ABSENT: Clayton Reed Member Donald Cotton Member STAFF AND GUESTS PRESENT: Cathy Morgas P&Z Administrator Dan Boutwell Town Planner, MPRG Bill LeGrand Director of Public Works, Town of Trophy Club 1. CALL TO ORDER AND ANNOUNCE A QUORUM: Chairperson Mike Hamper called the meeting to order at 7:09 p.m. announcing a quorum was present. 2. DISCUSSION AND APPROPRIATE ACTION REGARDING A REQUEST FOR A SIDE YARD VARIANCE FOR 548 TIMBER RIDGE DR.: A discussion was held with Mr. Champagne, the property owner. Dan Boutwell will do a letter to support the Commissions position. 3. DISCUSSION AND APPROPRIATE ACTION REGARDING THE 1997 UNIFORM BUILDING CODE: Following discussion, Commissioner Hill moved to recommend for adoption the 1997 Uniform Building Code to the Town of Trophy Club's ordinances. Commissioner Gilliland seconded; motion passed unanimously. 4. DISCUSSION AND APPROPRIATE ACTION REGARDING THE IMPLEMENTATION OF A GRID SYSTEM IN THE TOWN OF TROPHY CLUB: Director of Public Works, Bill LeGrand gave a brief overview of how the grid system works. Following discussion, no action taken. 5. DISCUSSION AND APPROPRIATE ACTION REGARDING THE PLANNING FOR SIDEWALKS IN THE NEW SUBDIVISIONS INCLUDING THE AREAS AROUND THE NEW SCHOOLS: Page 2 P&Z Regular Session April 16, 1998 Following discussion, Commissioner Hill moved to take no action regarding the planning of new sidewalks in the new subdivisions or in the school area. Commissioner Schaaf seconded; motion passed unanimously. 6. DISCUSSION AND APPROPRIATE ACTION REGARDING THE CONTINUED REVIEW OF THE COMPREHENSIVE ZONING ORDINANCE 94-09 AND AMENDMENT 96-16: Chairman Hamper addressed the TCWC members in the audience, by stating " We have never as a Commission had an issue with the Trophy Club Women's Club. Our issue was never with the Women's Club. We feel and have said it before that the work that is done and the charitable work that you do is certainly should be commended and we commend you for all that. We have had no issue with the conducting of the rummage sale or flea markets, whatever you want to call them, which was done on a community basis and was not at all in violation of any kind of ordinance. What our issue was, and still is, hasn't changed a bit. The Council does not and did not and will not have any authority to grant any kind of a variance on an ordinance that is pre-existing. The Comprehensive Zoning Ordinance prohibits the conduct of a garage sale in any residential area. Now, it not only prohibits it in our statement of each one of the districts, and this is individually, but it also says you cannot have it in any kind of residential area within 250' of some and by special privilege within 60'. So under no circumstances could there have been granted, legally at least, the authority to have a garage sale at a residence. That really is the issue that is involved. I am going to tell you very frankly, if you had come to the Planning and Zoning Commission back the first time that this was a glimmer in your eye and you had an idea to do it, it could have all been done in the legal coniines of the ordinance." Commissioner Schaaf left the meeting at 9:30 p.m. The Commission continued to review the ordinance. No action taken. 7. OTHER MATTERS: The Commission had a discussion with Council Member Kevin Carr regarding the hike/bike lane issue. John Harbin, Beck Properties, Inc., stated he would be making a presentation to the P&Z within 30 days regarding "Hogan's Glen."
