Minutes P&Z 06/17/1999MINUTES OF REGULAR SESSION FOR THE PLANNING AND ZONING COMMISSION TOWN OF TROPHY CLUB June 17, 1999 The Planning and Zoning Commission of the Town of Trophy Club, Texas met in a regular session on June 17, 1999 at 6:00 P.M. in the Boardroom of the Trophy Club Administration Building, 100 Municipal Drive, Trophy Club, Texas 76262. DISCUSSION AND APPROPRIATE ACTION REGARDING THE REQUEST FOR WAIVER TO FENCE ORDINANCE 99-01 FOR FENCES AT: 1. 115 Lakeshore Dr. 2. 217 Durango Dr. 3. 202 Parkview Dr. 4. 1 Lakeview Dr. 5. 8 Lakeview Dr. 6. 301 Madeline Cove (Highland Homes) (Highland Homes) (Highland Homes) (Highland Homes) (Highland Homes) (Plantation Homes) John Slates, Attorney for Highland Homes addressed the Commission. Mr. Slates explained why Highland was requesting a waiver to the fence ordinance #99-01, specifically referring to section 14.A. Waivers and Appeals, "A waiver may be authorized as will not be contrary to the public interest, where, owing to special conditions, the literal enforcement of the provisions of this Ordinance will result in unnecessary hardship, so that the spirit of this Ordinance shall be observed and substantial justice done." Mr. Slates explained how the fences got to be wrongly positioned, what hardships (to both residents and builder) would be incurred and how his clients feel a waiver would be in keeping with the spirit of the ordinance. P& Z Regular Session June 17, 1999 Following questions and comments by the Commissioners, Vice Chairman Hill expressed his concerns regarding the actions of the builder and fence contractor and warned the builder that any further incidences of fence construction without permits or violation of the fence ordinance by improperly locating fences, may result in penalties as provided in the ordinance for such conditions. Commissioner Cotton moved to make a recommendation to the Council to waive the requirements of the fence ordinance for the 5 properties represented by Highland Homes. Commissioner Reed seconded; motion passed unanimously. Due to the nature of the request for 301 Madeline Cove, Commissioner Reed moved to table this request to the next regular meeting. Commissioner Gilliland seconded; motion passed unanimously. PRESENTATION, DISCUSSION AND APPROPRIATE ACTION REGARDING THE BEAUTIFICATION COMMITTEE PROJECTS: John Harbin gave a presentation to the Commissioners regarding the clock tower. Mr. Harbin requested the Commission to recommend to Council to accept the new position of the clock tower and the easement for the tower location. Following discussion, Commissioner Gilliland moved to recommend to Council to accept the easement for the clock tower at the location proposed by the property owner. Commissioner Williams seconded; motion passed unanimously. DISCUSSION AND APPROPRIATE ACTION REGARDING THE SITE PLAN AND PD #21 FOR THE TROPHY CLUB PLAZA, LOCATED AT SH114 AND TROPHY LAKE DRIVE: John Roark, Regency Realty, updated the Commission regarding the following issues brought up at the previous meeting: Visibility of rooftop/dumpster at Walgreen's. Colored patterned concrete in crosswalks and entryways. r Donation of flashing "school crossing" signals. Site lighting study. v Landscaping on the west side of Trophy Lake Dr. r Number of delivery trucks at the Tom Thumb and the delivery hours. Treatment to the north and west face of the Tom Thumb building. Exterior finishes on buildings a&b, including reveals and extra colors. Decorative wall details. A wall along the parking lot of buildings a&b. Will be Austin stone and rubbed concrete.
