Minutes P&Z 02/03/2000 - WorkshopMINUTES OF WORKSHOP SESSION FOR THE PLANNING AND ZONING COMMISSION TOWN OF TROPHY CLUB 3 February 2000 The Planning and Zoning Commission of the Town of Trophy Club, Texas met in a Workshop Session on 3 February 2000, at 6:00 P.M. in the Boardroom of the Trophy Club Administration Building, 100 Municipal Drive, Trophy Club, Texas 76262. DISCUSSION REGARDING REQUIREMENTS FOR THE LANDSCAPE PLAN FOR THE LAKES OF TROPHY CLUB, PD -15 (APPLICANT, BRISCOE CLARK, DEVELOPER.) Chairman Hamper informed the Commission that this item would not be discussed at this meeting, in order to further clarify what the current status is. 3. DISCUSSION AND REVIEW ON AMENDMENTS TO ZONING ORDINANCE 98-29 TO REZONE A 74.956 ACRE PARCEL OF LAND FROM R-12 AND R-15 TO pd -22, ALSO KNOWN AS WATERS EDGE AT HOGAN'S GLEN (APPLICANT, JOHN HARBIN, VICE PRESIDENT, BECK PROPERTIES.) Mr. Harbin addressed the Commission and responded to comments from Mr. Boutwell, from a letter dated 27 January 2000. The applicant should provide a section on "Density", which provides the overall density of the PD. The Comprehensive Plan has recommended that all developments must maintain an overall density of three (3) dwelling units per acre. [This has been added on page 4, F. AREA REGULATIONS: SITE:] 2. Exhibit "B" is difficult to read. Either a cleaner copy or a large copy of the exhibit should be submitted. We are unable to discern the location of the "zero" lot side of each lot. We need to have a detailed landscape plan for all proposed landscaping located in public right-of-way or listed as an amenity to the PO. [The landscape plan was handed out 8tthe meeting and has been incorporated into the development standards] 12 The construction material of the pathway should be either concrete or asphalt located on an appropriate sand base instead of"seeded oQgr8gate" [This has been addressed onpage 7N. PATHWAY PLAN: Pathways shall be five (f)feet wide ofseeded aggregate concrete. See Exhibit 'IJ"for location. 2 Planning & Zoning Workshop Session 3 February 2000 Seeded Aggregate Concrete shall consist of a minimum four (4) inch thick section with the surface to be floated with seeding of rocks of %"— 318" in diameter to cover the entire plan surface (less any accent trim). Minimum concrete strength shall be of 2,500 psi with steel reinforcement of #3 rebar @ 24" o.c. and dummy joints shall be installed every ten linear feet.] Mr. Harbin addressed the comments from Gary Teague dated 25 January 2000, regarding the Concept Plan. For gated entries, provide traffic analysis to confirm adequate stacking space at entries. [This has been addressed on page 9, R. TRAFFIC STUDY. Shall be submitted at time of platting for Phase 7 to determine necessity for left turn lane on Indian Creek Drive.] 2. The median openings shown on Indian Creek, in the area of Street J and Street I, are acceptable for emergency access, but not for regular points of ingress/egress. [Mr. Harbin said he agreed with this and that they are not meant for regular points of ingress and egress] 3. Provide a left turn lane from Indian Creek Drive to Hogan's Drive. [That has been added] 4. Provide a traffic analysis regarding the need, or lack thereof, for a left turn lane to serve the entry at Street J. [A turn lane has been added] 5. Indian Creek Drive needs to conform to the previously identified alignment for the Loop Road. [It does currently. The alignment was taken to Teague Nall & Perkins and tied in] Mr. Harbin addressed comments from Tiffany Haertling dated 20 January 2000. Reference to developer providing a bond for improvements. [Chairman Hamper stated that this may apply in a different type of PD, but it does not apply in this PD. Mr. Boutwell said that he was not aware of any time when the Town has required a performance bond to be part of the zoning process.] 2. Reference to inclusion of landscape plan in the actual PD document. [This has been done and is part of the document as Exhibit 'E'J 3. Reference to maintenance of all open spaces and private streets. [The language referring to the exercising of governmental functions or purpose on page 8, has been elaborated on to include... but not limited to fire and police protection, emergency vehicles, public and private utility maintenance and service personnel, solid waste collection services, the U.S. Postal Service and governmental employees in pursuit of their official duties, including but not limited to inspection and code enforcement.] 4. Reference to controlled access mechanism to gate; specific wording on the face of the plat. [This has been addressed by the addition on page 8, 4. Access Gates: The type of gate or controlled access mechanism is subject to the approval of the 3 Planning & Zoning Workshop Session 3 February 2000 Town of Trophy Club's Fire Marshall. The Town of Trophy Club shall bear no responsibility or liability in connection with the removal or destruction of any gate or other controlled access while engaged in emergency action. and "the streets have not been dedicated to the public for the public's access nor have they been accepted by the Town of Trophy Club as public improvements, and the streets and roadways shall be maintained by the property owners association within the subdivision, except that the streets and roadways shall always be open to emergency vehicles, public and private utility maintenance and service personnel, solid waste collection services, the U.S. Postal Service, and governmental employees in the pursuit of their official duties. " has been added to the final plat on page 2 of 2.] 5. Reference to the Town's assumption of maintenance. [Mr. Harbin stated that he would modify the wording to what the Commission wanted, however, the language currently in the document is what the Commission asked for with Mr. Harbin's previous ordinance. Chairman Hamper said the attorney wants the Commission to remove from PD's the Town's option to go in and repair at some point, private streets when the homeowners association has not met their responsibility. Chairman Hamper worked with the attorney to develop this verbiage. Commission Reed said he felt the wording should be left as it currently is and the rest of the Commission agreed.] Commissioner Reed asked the word "minimum" be added to F AREA REGULATIONS: LOTS: 7. Width of Side Yard: Estate Lots, and add "a ten foot minimum must be maintained between houses for Villa Lots (Block 3 & 4). The Commission asked Mr. Harbin to readdress the screening of utilities to include a more extensive material than ornamental iron. Chairman Hamper asked Mr. Harbin to include a revision date and revision number so that it will be easier for all parties involved to work with the correct copy. Commissioner Gilliland asked if the staff had a procedure in place when an ordinance is approved, to stamp it as the approved, final copy. Ms. Fleck stated that when the document is approved, all members of the Commission would receive a dated and stamped approved, official, copy of the ordinance. 4. DISCUSSION AND REVIEW REGARDING THE PRELIMINARY PLAT FOR THE 7.677 ACRE TRACT KNOWN AS WATERS EDGE @ HOGAN'S GLEN, PHASE 1, PD -22 (APPLICANT, JOHN HARBIN, VICE PRESIDENT, BECK PROPERTIES) Mr. Harbin addressed the Commission: The first item that has changed on the preliminary plat is the note the attorney added about the private streets, (referenced above). Mr. Harbin addressed the comments from Mr. Boutwell, in a letter dated 27 January 2000. The applicant must be aware that action on the preliminary plat cannot take place until appropriate zoning has been approved. This means that the P&Z cannot act on the plat until the Town Council has approved the PD zoning. [Mr. Harbin understands this stipulation] M Planning & Zoning Workshop Session 3 February 2000 2. The streets should be named at the time of platting. [The street has been named Katie Lane] 3. The temporary turn -around at the end of street "A" is located outside the limits of this plat. Therefore, a separate easement instrument must be excited and provided to the Town at the time of final platting. [Mr. Harbin stated that he would file a temporary easement and note it on the plat. When this is platted, it will become void. Mr. Boutwell stated that the staff needs to know there is an easement so that we can emergency vehicles around.] 4. The minimum distance for a cul-de-sac, according to the Sub-Regs, is 600 feet. The temporary cul-de-sac on street "A" exceeds this distance. Therefore, we recommend that the applicant shorten the cul-de-sac length or provide formal approval of emergency medical authorities to the Town prior to the approval of the final plat. [Mr. Harbin stated that he would contact the Fire Chief for that approval.] 5. We would recommend that the side building lines of lots 5 and 10, at the intersection of Hogan's Drive and street "A" be increased to 25'. This would insure that the house on lots 10 and 5 do not set 10 feet in front of the houses on lots 11 and 4. [Mr. Harbin said he would add a set back line to the preliminary plat and the final plat as well as language in the PD.] Commission discussed with Mr. Harbin a timeline for the zone -change at the Joint Public Hearing, and meeting dates for preliminary plat and final plat. 5. REPORTS FROM COMMISSIONERS, OTHER MATTERS. Commission discussed closure of Kirkwood Blvd. Mr. Harbin drew a sketch of proposed alternate road. Chairman Hamper asked the Commissioners to call Ms. Fleck when they know in advance that they will be unable to attend a meeting. 6. REPORTS FROM STAFF. Ms. Fleck asked the Commission if the requirement in the Comprehensive Zoning Ordinance, to place a sign on land that has been applied for a zone -change, might be removed from the ordinance. Currently, and in the past, this stipulation has not been adhered to. The Commission agreed that would be fine.
