ENGROSSMENT ANDENROLLMENT, PROVIDING DATE. Chairman Hill asked Mr. Boutwell to share his comments with the Commission. Mr. Boutwell addressed the Commission and gave his review of the application. The application currently before the Commission is unique and unlike other applications received in the past. In the past, the Commission reviews a zoning request for a planned development. This agenda item is a straight zoning request, which means the applicant must meet the requirements of the straight zoning district. The Commission cannot alter requirements dictated in the Comprehensive Zoning Ordinance for straight -zoned districts. A site plan must be approved prior to the issuance of a building permit. That does not have to happen at this time, however. The only thing to consider at this time, is whether or not this type of zoning is appropriate for the area in which it is requested. The authority given to the Planning & Zoning Commission in the state of Texas for zoning is dictated by the Texas Local Government Code, Chapter 212. Cities are authorized to zone land in accordance with their Comprehensive Land Use Plan. The first item to look at in reviewing this item is the Comprehensive Plan. The Land Use Plan for this area shows single family or low density residential. It does not show commercial recreational. However, what is appropriate to do is look at the text portion of the plan for land use principals. This does meet those principals. Therefore, it can be said that this proposal would be in agreement with the Comprehensive Land Use Plan. Mr. Boutwell's recommendation is to review the Comprehensive Land Use Plan and revise as necessary. Also, if this is approved, it does not signify approval of the site plan. That will be required to be presented at a later date. K 5E• • • •Mm• •• � I •41' �1111111111111111 11,111 � I• •- 111 Chairman Hill clarified that dirt may be moved on the site, prior to approval of the site plan. Mr. Harbin addressed the Commission. The exhibit is very simple in that it does establish the boundaries of the site. Mr. Harbin showed the Commission how the boundaries of the site were determined, by showing a concept plan for the surrounding land. There is no reason to bring this land in under a PD because it does not require any item different from the requirements of Commercial Recreational. The land will contain a pool, basketball, tennis and roller hockey court as well as a playground. The trails will ultimately connect to the Town's pathway system. There is a space where a community center building may be constructed, anywhere from three thousand two hundred (3,200) to three thousand five hundred (3,500) square feet. There are seventy (70) parking spaces currently planned with the possibility of ninety (90). The land surrounding the area will have single family residential. The platting for this site will be lot one (1), block one (1). 4. PLANNING & ZONING COMMISSION TO CLOSE PUBLIC HEARING AND/OR CONTINUE TO A DATE CERTAIN. Chairman Hill moved to agenda item nine (9). Vice Chairman Gilliland asked to be excused from the meeting early and wished to discuss this item before his departure. Vice Chairman Gilliland addressed the Commission regarding the roof modifications for the Tom Thumb building and ther rear building elevations for retail buildings "A" and "B". Vice Chairman Gilliland asked that a representative from Regency Realty be in attendance at the next Commission meeting in order to discuss each item. Ms. Fleck was directed to contact Regency Realty in order to discuss this item at the next Commission meeting with a representative that could speak on behalf of Regency Realty. 3 Planning & Zoning Public Hearing & Regular•i • • 11 REGULAR SESSION 6. Chairman Hill summarized the items the Commission will be responsible for updating. This information will be included in the next packet under FYI. Mr. Harbin addressed the Commission with a presentation concerning PD -16, The Knoll. 10. REPORTS FROM STAFF.
