The Planning and Zoning Commission of the Town of Trophy Club, Texas met in a Public
Hearing and a Regular Session on 7 February 2002, at 7:00 pm in the Boardroom of the
Trophy Club Administration Building, 100 Municipal Drive, Trophy Club, Texas 76262.

1. CALL TO ORDER AND ANNOUNCE A QUORUM.
Chairman Hill called the meeting to order at 7:03 pm, and announced a quorum was
present.
Chairman Hill asked and received the Commission's consent to move to agenda item 8
before conducting the public hearing.
8. PRESENTATION, DISCUSSION AND APPROPRIATE ACTION RELATIVE TO THE REQUEST
FOR A TEMPORARY USE COMMUNITY GARAGE SALE BY SPECIAL PRIVILEGE.
(APPLICANT CAROL BROWN, TROPHY CLUB WOMEN'S CLUB)
Ms. Brown addressed the Commission. The spring garage sale will be held Saturday, 13
April 2002, with the alternate rain day scheduled for Sunday, 14 April 2002. The fall sale
will be held Saturday, 26 October 2002, with the alternate rain day scheduled for
Sunday, 27 October 2002.
Ms. Fleck said Chief Tucker is aware of the event and the DPS will prepare accordingly.

Chairman Hill addressed the applicant and asked for clarification on the following
issues:
Q: You indicate on your plat that new perimeter fence will be constructed along
the north property line. What is the location and full extent of this fence?
A: Ms. Kramer stated the fence for phase 1 would be backing up to PD -10, the
Indian Creek Townhomes, a three (3) foot berm. The Phase 2 fence would back
up to the R-9, Single Family Residential area.
Q: In Exhibit J-1 you show a fence height of 5 feet atop a 3 -foot berm.
Does a 5 -foot fence on the boundary between commercial and residential
properties conform to the Town's existing fence ordinance?

A: Ms. Kramer said the fence would be brought out a little more than what is
shown..."We don't intend on berming off our property. We'll keep it on our
property".
Mr. Garrison said more than likely they will berm up to the fence and have it so
the backside of the fence will be the proper height.
Ms. Kramer said the they were trying to meet the eight (8) foot screening
requirement so the berm will be between two (2) and three (3) feet and the
fence will make up the difference.
Q: The box listing Phase 2 uses has multi -purposes. What is the likely intended use?
A: Mr. Hutchison said that at this point it's unclear as to what the use will be,
however, when the time to begin development draws near, they will apply for
an amendment to the uses.
Q: On page CI0-10, you indicate 24-hour operation of Phase 2. I'm reluctant to
endorse this being in the PID Ordinance without knowing what uses would be
there on a 24-hour basis.
A: Mr. Hutchison said the intent was to have the Retirement Home, Nursing Home,
Rest Home and Convalescent Home operating on a 24-hour basis, due to the
nature of their business.
Mr. Boutwell said that since these uses were already outlined in the ordinance,
the hours would not have to be amended in the future.
Ms. Fleck suggested that the applicant amend the hours if the use turns out to be
a medical office, at the same time the development schedule is being
addressed. Mr. Hutchison agreed.
Q: You indicate a "block retaining wall" along the 15 -foot building setback.
What type of blocks? What type of facing would be on the blocks?
A: The material would be a "keystone landscape lock -block" with a multi -faceted
shape to it. It's not a concrete block; it's a landscape block.
Chairman Hill asked the applicant to include an elevation of the retaining wall as
well as a cut sheet in the ordinance that will be forwarded to the Town Council.
Q: In the text on Parking, page C4-10, please clarify in item (iii) what "any
development" means.
A: Ms. Kramer said "any development" means phase I and 2, cumulative.
Mr. Boutwell suggested the following wording:

(iii) Total driveway entrances shall not exceed three (3) entrances for
phase I and 2 cumulative.
Q: On exhibits DI and D2, are the elevation drawings representative of nursing
home/convalescent home configurations for the building? If this were so, what
would the configuration be if Phase 2 were to be a medical office building?
A: Mr. Garrison said that they wanted to represent, with the balconies, a "worst
case" condition. If the use goes to a medical office building, then the balconies
will go away and the building will look like the phase 1 building.
Q: In the text on page C6-10 does the wording on Tree Preservation coincide with
the Tree Ordinance provisions?
A: Mr. Rosenberger said that the replacement measurement is actually (11/2)
Q: Site Section E-01 shows a 9 -foot retaining wall that is approximately at the 15 -foot
building line and the limit of the parking lot. Examination of Exhibit G-1 Civil
Diagram, indicates this wall height (based on existing contour) rises from -1.5
feet at the south end to - 12 feet at the north end. How would this be
engineered, and what would you be able to do to stabilize the wall? Site
Section E-02 shows a tapered slope from the north property line extending to
within a few feet of the north side of Building 1. But Exhibits B-1 and G-1 show
parking spaces extending to the - 30 foot setback line. Also, Exhibit G-1
diagram indicates an - 12 to 13 foot change from existing ground surface to the
finished parking surface. It thus appears that almost all of the North parking area
will require construction of retaining walls, or that there will be some very steep
slope shaping within the 30 -foot setback area.
A: Mr. Garrison said the wall will be a keystone wall. It won't actually be twelve (12)
feet tall. They will re -grade the top section from the property line back down
towards the fence at a reasonable slope. The applicant agreed to provide
further detail in the ordinance to be presented to the Town Council.
Commissioner Ashby asked about the approaches getting approved by TXDOT.
Mr. Hutchison said that TXDOT is currently involved in the project and they will continue
to be.
Commissioner Ashby confirmed with Mr. Boutwell that the building lines are correct for
the entire proposal. He also asked about the signage. Ms. Fleck stated that she asked
the applicant to provide details on all of the signage they would require for the
construction and leasing stages. Because this is a PD, the total square footages can
exceed the requirements currently outlined in the sign ordinance.
Commissioner Sheridan asked if there had been any other comments from residents not
included in their packets. Ms. Fleck said she had not spoken with any other property
owners.

Commissioner Sheridan asked if he were standing on the Townhomes' property, how tall
would the fence be?
Ms. Kramer stated that the fence along that side would be matched up with the
existing fence. Mr. Garrison said that the screening requirement is a maximum of eight
(8) feet, so that fence will be somewhere between seven (7) and eight (8) feet. If they
berm up, that will be done on the Medical Plaza side.
Commissioner Sheridan asked for further detail on the reflective glass.
Mr. Hutchison said that the reflective glass does not have an above normal
reflectiveness. If is simply tinted glass. Given the distance the buildings are from the
residential areas, one hundred seventy four (174) feet, the impact to the residential
areas will be slight at best. Under no circumstances is the glass intended to be
reflective.
Commissioner Rodgers asked Mr. Hutchison to address the change to the site plan since
last time.
Mr. Hutchison said that the number of relocation offices was not as high as originally
anticipated. There are many satellite offices, but not as many doctors have opted to
totally relocate their practices therefore, the total space would not be as much as
previously anticipated.
Commissioner Reed asked about the applicant's contact with the Town of Westlake.
Ms. Kramer stated that they have been in contact with Westlake, they normally go with
TXIDOT's recommendation.
Mr. Boutwell stated that the applicant has addressed all of his concerns.
Mr. Rosenberger said that he forwarded his review to Ms. Fleck, the applicant should
have received a copy of it.

to the Town Council.

9. DISCUSSION AND APPROPRIATE ACTION RELATIVE TO THE PROPOSED REVISIONS TO
THE TOWN OF TROPHY CLUB ORDINANCE 1999-13, ESTABLISHING SIGN
REGULATIONS. (AMD -01-007)
Ms. Fleck gave a brief overview of the changes reflected in the most current version of
the ordinance.
The following revisions were made:
SECTION 2 - DEFINITIONS
AWNING: A roof -like structure, usually made of canvas that serves as a shelter, as over
a storefront, window, door or deck. Also, an architectural projection that provides
weather protection, identity or decoration, and is supported by the building to which it
is attached.
PREMISES: Land and the building upon it; a building or a part of a building.
PROGRAMMED ELECTRONIC DISPLAYS: Any display in which lamps are used to give
information such as, but not limited to time, temperature, stock market data and which
can be electronically programmed to deliver different messages.
SIGN, LEGAL NON CONFORMING: A sign which was lawfully erected and maintained
prior to the enactment of the Sign Ordinance and any amendments thereto, and
which does not conform to current applicable regulations and restrictions of the Sign
Code.
SIGN, PORTABLE: A sign that is not attached or affixed to the ground, a building or other
fixed structure or object. Portable signs include those signs installed on wheels, trailers,
skids and similar mobile structures. Portable signs are not to be left in place more than
thirty (30) days at one location. Portable signs are restricted to governmental use only.
