Minutes P&Z 09/05/2002MINUTES OF A REGULAR SESSION FOR THE PLANNING & ZONING COMMISSION TOWN OF TROPHY CLUB The Planning and Zoning Commission of the Town of Trophy Club, Texas met in a Regular Session on 5 September 2002, at 7:00 pm in the Boardroom of the Trophy Club Administration Building, 100 Municipal Drive, Trophy Club, Texas 76262. CALL TO ORDER AND ANNOUNCE A QUORUM. Chairman Hill called the meeting to order at 7:03 pm, and announced a quorum was present. 2. PRESENTATION, DISCUSSION AND APPROPRIATE ACTION RELATIVE TO A REQUEST FOR A WAIVER TO FENCE ORDINANCE 2002-25P&Z, MORE SPECIFICALLY DESCRIBED AS SECTION 3, ENTITLED "FENCES", SUBSECTION "C" ENTITLED "TYPE OF FENCE AND CONSTRUCTION", (6) FOR A PROPERTY LOCATED AT 205 FRESH MEADOW DRIVE, LOT 326 OF SECTION THREE. Ms, Fleck stated that she would notify Mr, Burkhardt of the date and time this item will be on the Commission's next agenda. 3. PRESENTATION, DISCUSSION AND APPROPRIATE ACTION RELATIVE TO A REQUEST FOR A WAIVER TO TOWN ORDINANCE 2002-25P&Z, MORE SPECIFICALLY DESCRIBED AS SECTION 4, ENTITLED "RETAINING WALL REGULATIONS", SUBSECTION "C" ENTITLED "TYPE OF RETAINING WALL CONSTRUCTION", (1) FOR A PROPERTY LOCATED AT 104 FOREST HILL DRIVE, LOT 210 OF SECTION THREE. (APPLICANT: PATRICIA STOLTZ) Ms. Stoltz addressed the Commission. She explained that her rear -yard retaining wall collapsed a few months ago. The wall is rather large and she is seeking a waiver based on financial hardship to the requirements of Ordinance 2002-25P&Z, Ms. Stoltz has received quotes ranging from $15,000 for a masonry wall, which would comply with the provisions of the ordinance, to $5,000 for a cross -tie material wall, which would not comply with the ordinance. A motion was made to recommend approval of the request. Motion: Sheridan Second: Reed Ayes: Hill, Ashby, Stephens Nays: None Action: 5-0 Motion carried. This item will be recommended for approval to the Town Council at their 7 October 2002 meeting. Chairman Hill asked the Commission to move forward to agenda item no,6 for the convenience of the applicant. 6. PRESENTATION, DISCUSSION AND APPROPRIATE ACTION RELATIVE TO THE REQUEST FOR A TEMPORARY USE PERMIT FOR "TEAM TROPHY CLUB DAYS", TO BE HELD 19 OCTOBER 2002. (APPLICANT: CAROL BROWN) Wanda Brewster addressed the Commission. A motion was made to recommend approval of the temporary use permit request. DISCUSSION AND APPROPRIATE ACTION RELATIVE TO AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS, REPEALING ORDINANCE NO. 1999-13, ESTABLISHING SIGN REGULATIONS, AND ADOPTING NEW PROVISIONS FOR SIGN REGULATIONS; PROVIDING DEFINITIONS; PROVIDING GENERAL STANDARDS RELATING TO THE HEIGHT OF SIGNS, APPLICABLE BUILDING AND ELECTRICAL CODES, ILLUMINATED SIGNS, FLASHING OR MOVING SIGNS, SIGNS ON TREES OR UTILITY POLES AND REQUIREMENT TO REPAIR; PROVIDING FOR TRAFFIC SAFETY; PROVIDING FOR POLITICAL SIGNS; PROVIDING FOR DEVELOPER/BUILDER AND REAL ESTATE SIGNS; ESTABLISHING PROVISIONS FOR ALL AREAS AND ZONING DISTRICTS; PROVIDING FOR COMMERCIAL SIGNS; PROVIDING SIGNAGE CRITERIA; PROVIDING FOR PERMISSIBLE SIGNS NOT REQUIRING PERMITS; PROVIDING PERMIT REQUIREMENTS; PROVIDING FOR TEMPORARY PERMITS; PROVIDING FOR NONCONFORMING USES; PROVIDING FOR MERITORIOUS EXCEPTIONS AND APPEALS; PROVIDING FOR PROHIBITION OF SIGNS NOT SPECIFICALLY AUTHORIZED; PROVIDING GRAFFITI REGULATIONS; PROVIDING A SAVINGS CLAUSE; PROVIDING A CUMULATIVE REPEALER CLAUSE; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE.
